DECLARATION
of 19 December 2016
amending Decree No 522 / 2006 Coll., on state professional supervision and controls in road transport, as amended
The Ministry of Transport provides, pursuant to § 41 paragraph 2 of Act No. 111 / 1994 Coll., on Road Transport, as amended by Act No. 304 / 1997 Coll., Act No. 150 / 2000 Coll., Act No. 103 / 2004 Coll., Act No. 186 / 2004 Coll., Act No. 229 / 2005 Coll., Act No. 253 / 2005 Coll., Act No. 411 / 2005 Coll., Act No. 226 / 2006 Coll., Act No. 227 / 2009 Coll., Act No. 194 / 2010 Coll., Act No. 119 / 2012 Coll., Act No. 102 / 2013 Coll., and Act No. 64 / 2014 Coll., for the implementation of Section 34 (3) of this Act:
Decree No. 522 / 2006 Coll., on state professional supervision and controls in road transport, as amended by Decree No. 39 / 2010 Coll., Decree No. 269 / 2012 Coll. and Decree No. 9 / 2015 Coll., is amended as follows:
1. At the end of footnote 2a, the sentence "Commission Regulation (EU) 2016 / 403 of 18 March 2016 supplementing Regulation (EC) No 1071 / 2009 of the European Parliament and of the Council as regards the classification of serious infringements of Union rules which may lead to the loss of reputation of road transport operator and amending Annex III to Directive 2006 / 22 / EC of the European Parliament and of the Council 'is added to the separate line.
2. Paragraph 5 (1), including footnote 7, reads:
"(1) The inspection authority shall always carry out checks at the premises of the carrier:
(a) when an infringement is found to be classified as the most serious infringement and falls under Group B in accordance with a directly applicable European Union provision on the classification of serious infringements of Union rules which may lead to the loss of reputation of road transport operator (7);
(b) in the detection of an infringement classified as a very serious infringement and falling within group H1 to H9, I1 and J1 in accordance with the directly applicable European Union regulation on the classification of serious infringements of Union rules which may lead to the loss of reputation of road transport operator (7); or
(c) in the detection of an infringement classified as a very serious infringement, it falls within Group B, C, D, I2 to I5 in accordance with the directly applicable regulation of the European Union concerning the classification of serious infringements of Union rules which may lead to the loss of reputation of road transport operator (7) and has been found repeatedly with the carrier.
7) Annex III to Commission Regulation (EU) 2016 / 403 of 18 March 2016 supplementing Regulation (EC) No 1071 / 2009 of the European Parliament and of the Council with regard to the classification of serious infringements of Union rules which may lead to the loss of reputation of road transport operator and amending Annex III to Directive 2006 / 22 / EC of the European Parliament and of the Council. ';
3. In Article 5 (2), the words "Annex No 8 to this Decree 'are replaced by the words" a directly applicable European Union regulation governing the classification of serious infringements of Union rules which may lead to the loss of reputation of road transport operator (7)'.
4. Annex No 8 is deleted.
Efficacy
This Decision shall enter into force on 1 January 2017.
