DECLARATION
of 11 December 2008
on the medical fitness of a candidate for employment of an officer, a candidate and an officer of the municipal police
In agreement with the Ministry of Health, the Ministry of the Interior provides, pursuant to § 4c (2) of Act No. 553 / 1991 Coll., on the Municipal Police, as amended by Act No. 274 / 2008 Coll.:
Medical examination
(1) Medical examination to assess the medical fitness of a candidate for employment of an officer, candidate or officer means a medical examination to be carried out
(a) prior to entry into employment (hereinafter referred to as "entry tour"),
(b) during employment (hereinafter referred to as "periodic inspection"),
(c) on termination of employment (hereinafter referred to as "exit inspection"),
(d) in exceptional cases (hereinafter referred to as "emergency inspection").
(2) The medical examination referred to in paragraph 1 (a) and (b) may benefit from the result of a prior expert examination provided that it was carried out not later than 3 months before the start of the initial or periodic examination.
(3) The medical examination shall examine the medical condition of the person under assessment, including the information communicated for his or her progress. In addition, the entry or periodic examination shall be based on the information contained in the extract from the medical file kept by the doctor with whom the candidate for employment of an officer, candidate or officer is registered, a specimen of which is set out in Annex 1 to this Order, which shall be available at the latest on the day of the medical examination. The employer shall request information for the needs of a medical practitioner providing the employer's employees with preventive care (the "assessor ').
(4) In the context of a medical examination, data on the occupational classification of the person under consideration, the type of work, the mode of work and the health and safety risks under which the work is carried out and the extent of those risks should be communicated.
(5) When assessing medical fitness, the assessor shall evaluate the assessed medical condition of the person under assessment in relation to the requirements for the activity of the officer. The medical assessor shall issue a medical opinion on medical fitness to the person under consideration, which shall always contain data in accordance with the model set out in Annex 2 to this Regulation.
Entry check
(1) A comprehensive physical examination of the internal character, including an indicative examination of the vision, hearing, skin and supporting and movement apparatus, an indicative neurological examination, an electrocardiographic examination, a basic spirometric examination of the urine, an indicative chemical examination of the urine and a laboratory examination of the blood count and glycemia, shall be carried out during the initial examination. Further professional examinations necessary for the assessment of his medical fitness may be carried out on the basis of the current health status and requirements for a specific activity to be carried out by a candidate for employment of an officer, candidate or officer.
(2) An entry check shall be carried out prior to the admission of an officer to employment or before the transfer of an officer to another job.
Periodic examination
(1) During the periodic examination, a comprehensive physical examination of the internal character shall be carried out, including an indicative examination of the vision, hearing, skin, support and movement apparatus, an indicative neurological examination and an indicative chemical examination of the urine. According to the current state of health and the requirements for a particular activity carried out by an officer, further professional examinations necessary for the assessment of his medical fitness may be carried out.
(2) The periodical examination shall be carried out every 3 years from the date of the entry or last periodic examination, unless otherwise provided by other legislation or decision of the public health authority.
Emergency inspection
(1) The contents of the emergency examination shall be determined by the medical assessor or officer according to the medical condition currently established.
(2) Extraordinary inspection shall be carried out
(a) at the initiative of the candidate or officer,
(b) following an injury or illness which has caused the temporary incapacity of the candidate or officer for more than 8 weeks;
(c) if the candidate or officer suffers injury associated with unconsciousness, other severe injury or has been exposed to dangerous or harmful substances in the course of the employment of the candidate or officer;
(d) at the initiative of the treating physician.
Output search
(1) A comprehensive physical examination of the internal character shall be carried out during the exit examination, including an indicative examination of the vision, hearing, skin and support and movement apparatus and an indicative neurological examination, or any other necessary expert examination, as requested by the assessor.
(2) The exit check shall be carried out before the termination of the employment of the candidate or officer. As proof of the completion of the exit check, a certificate of completion of the exit check shall be issued instead of the medical examination, which shall include the identification of the person under consideration, the employer, the medical institution and the medical assessor. In addition, the certificate of completion of the exit check shall contain data on the working grade of the person under consideration, the type of work, the mode of work, the health and safety risks under which the work is carried out, the level of these risks, the date of completion of the exit check and the date of issue of the certificate of exit check.
Health
The list of physical and mental defects, diseases or conditions excluding the medical fitness of the candidate for employment of an officer, candidate or officer is set out in Annex 3 to this Decree. In assessing the medical fitness of an officer for the performance of the type of work for which specific medical requirements are laid down by other legislation1), the following rules shall be followed.
Duration of the medical opinion on medical fitness
The validity of the medical opinion on medical fitness shall expire at the latest on the day on which the periodical examination was to be carried out, on the day on which the date of the emergency examination was to be carried out, or on the day on which the medical evaluation was to be carried out.
Transitional provision
The periodical examination of the candidate or officer who is in employment with the municipality on 1 January 2009 shall be carried out no later than 31 December 2011.
Efficacy
This Decree shall take effect on 1 January 2009.

Physical and mental defects, diseases or conditions which exclude the medical fitness of a candidate for employment of an officer, candidate or officer
I. A person who has been found not to be fit for health
1. organic mental disorders including symptomatic disorders,
2. severe organically and symptomatic personality and behavioural disorders,
3. mental and behavioural disorders caused by the consumption of psychoactive substances (except for isolated acute intoxication),
(a) excessive consumption of alcohol and abuse of other psychoactive substances directly (at working time) and repeated (more than once) performance;
(b) active dependence on alcohol or other addictive psychotropic substances;
(c) residual conditions and psychotic disorders with late onset due to the effect of alcohol or other addictive psychoactive substances (personality or behaviour disorder, psychotic reminiscences, amnesty syndrome, dementia),
4. lasting (chronic) or recurrent psychotic disorders of perception and thinking, particularly schizophrenia, schizophrenia, delusion disorder, schizophrenia, mental retardation,
5. persistent or recurrent psychotic disorders, particularly periodic mania with psychotic symptoms, bipolar affective disorder with manic or depressive phases with psychotic symptoms, periodic depressive disorder with depressive phases with psychotic symptoms,
6. clinically severe (inducing incapacity) neurotic disorders, stress-induced disorders, somatoform disorders and behavioural syndromes, particularly phobic anxiety disorders, obsessive compulsive disorders, reactions to severe stress and adaptation disorders, dissociative disorders, somatoform disorders, other neurotic disorders (neurastenia),
7. systemic atrophy primarily affecting the central nervous system,
8. extrapyramidal and motion disorders,
9. degenerative diseases of the nervous system not included above,
10.
11. severe and prognostic diseases of the circulatory system,
12. Severe and prognostic respiratory and lung disorders,
13. Severe and prognostic diseases of the muscle and skeletal system, excluding load,
14. asthma bronchiale or other severe and prognostic adverse allergic diseases,
15. Uncorrected or severe visual disturbances, severe visual field and spatial vision disorders, or more severe colour-sensitive disorders which prevent space orientation and under difficult conditions, single-occlusion, reduction of visual acuity below 6 / 12 on each eye separately after correction,
16. hearing disorders which render it impossible to orient in space or communicate with speech over a distance of less than 6 metres
17. Inner ear diseases accompanied by imbalance.
II. Medical fitness, provided that the professional examination carried out by a doctor specialising in the relevant field is completed in a positive way, is the person in whom they have been found
1. organic diseases with psychopathology,
2. mental and behavioural disorders due to the consumption of psychoactive substances (except for isolated acute intoxication), a history of:
mental and behavioural disorders caused by the effect of alcohol and other psychoactive substances, in particular dependence on alcohol or other psychoactive substances (occupational fitness is conditional on a safe withdrawal period, i.e. uncontested withdrawal of at least three years),
3. affective disorders (mood disorders),
4. severe neurotic, stress and somatoform disorders, anxiety and phobic disorders, adaptation disorders,
5. personality and behaviour disorders,
6. personality structure and dynamics disorders,
7. demyelinating central nervous system diseases,
8.
9. Serious chronic diseases of the digestive system,
10. cancer 5 years after finding
11. Severe blood disease,
12. Severe skin and subcutaneous tissue disorders,
13. Circulatory system disease,
14. respiratory and lung disease,
15. severe diseases of the muscle and skeletal system,
16. serious diseases of endocrine, nutrition and substance conversion,
17. Serious allergic diseases,
18. Severe kidney, urinary tract disorders,
19. Severe liver disease,
20. Visual disturbances, visual fields and spatial visual disturbances or dyspnosis or other eye diseases and eye adnex which render it impossible to navigate in space and under difficult conditions, reduced visual acuity requiring permanent correction,
21. Unhearing, which limits the orientation in space or communication, in the cases in question a detailed audiological examination is necessary,
22. other ear diseases which reduce the safety of the officer's work, in contentious cases a detailed vestibular examination is necessary,
23. Other diseases that reduce the safety of the officer's work.
