DECLARATION

amending Decree No. 191 / 2000 Coll., on technical conditions for connection and operation of equipment for listening and recording telecommunications traffic
According to § 109 (3) of Act No. 151 / 2000 Coll., on Telecommunications and on the amendment of other laws, the Ministry of Interior provides for the implementation of § 86 (2) of this Act:
Decree No. 191 / 2000 Coll., on technical conditions for the connection and operation of equipment for the listening and recording of telecommunications traffic, is amended as follows:
1. In Paragraph 2 (4), the sentence "For mobile networks, the international identifiers IMSI and IMEI.2a are also considered as the user address' is inserted after the first sentence.
footnote 2a is replaced by the following:
"(2a) International identifiers for IMSI and IMEI are defined in the Recommendation of the European Telecommunications Standardisation Institute ETS 300 523. ';
2. in Article 3 (2), the following point (c) is inserted after point (b):
"(c) data identifying the user address available to the network or service in its activity; for mobile networks, international identifiers IMSI and IMEI are also considered to be such data; ';
Points (c) to (e) shall be renumbered as points (d) to (f).
3. in Article 3 (2), the following point (g) is added:
"(g) data identifying their source when transmitted through a common channel from multiple nodes of network or services.";
4. Paragraph 4 (5) reads as follows:
"(5) Data on the activation and deactivation of the wiretap shall be kept for the purpose of checking the wiretap by the authorised authority4) by the technical means of the network or service for a period of six months in a manner which does not permit their change."
5. Paragraph 5 (4) reads as follows:
"(4) If the output is not equipped with a channel with an SS74a signal (or DSS1,4b), the content of the messages transmitted to the output shall be indicated and ended by DTMF tags. ';
footnotes 4a and 4b are as follows:
"4a) The signalling of SS7 is defined in the recommendations of the International Telecommunications Union Q.761 to 769.
4b) The signalling of DSS1 is defined in the Recommendation of the European Telecommunications Standardisation Institute ETS 300 102-1. '
6. In Paragraph 6 (4), the words "is a workplace 'are replaced by the words" are the end points of the network at the workplace'.
7. Paragraph 10 (2) reads as follows:
"(2) Other networks and services are private telecommunications networks, Internet services and circuit rental services. '
Efficacy
This Decree shall take effect on 1 November 2002.
