DECLARATION
of 18 December 2013
amending Decree No 215 / 2008 Coll., on measures to prevent the introduction and spread of harmful organisms of plants and plant products, as amended
The Ministry of Agriculture provides pursuant to § 88 (1) (b) of Act No. 326 / 2004 Coll., on Phytosanitary Care and on the Amendment of Certain Related Acts, as amended by Act No. 131 / 2006 Coll., Act No. 249 / 2008 Coll., Act No. 227 / 2009 Coll., Act No. 291 / 2009 Coll., Act No. 245 / 2011 Coll., Act No. 199 / 2012 Coll. and Act No. 279 / 2013 Coll., ("the Act '):
Decree No 215 / 2008 Coll., on measures against the introduction and spread of harmful organisms of plants and plant products, as amended by Decree No 159 / 2009 Coll., Decree No 76 / 2010 Coll. and Decree No 382 / 2011 Coll., is amended as follows:
1. In Article 2 (2), the words "State Plant Health Administration (hereinafter referred to as the" Plant Health Administration ") 'are replaced by the words" Central Agricultural Control and Testing Institute (hereinafter referred to as the "Institute")' and the words "State Plant Health Administration 'are replaced by the words" Central Agricultural Control and Testing Institute'.
2. in § 5 (1), (2), (7) and (8), § 9, § 13 (3), § 14 (2), § 21 (1), § 25 (2), § 28 (1) and (2) and § 31 (1) and (2), the words "plant health management" shall be replaced by the words "Institute."
3. in Articles 5 (5), 13 (b), (c) and (d), 11 (1) (e) and 11 (1) (3), 15 (2) (d) and 29, the words "plant health management" shall be replaced by "the Constitution."
4. in Articles 5 (6), (7) and (13), 14 (1) and 25 (1), the words "plant health management" shall be replaced by "Institute."
5. in Articles 5 (12) and 13 (a) and 27 (1), the words "plant health management" shall be replaced by "the Constitution."
6. in Article 8 (1) (i), (2), (17) (3), (21) (1), the words "the phytosanitary authorities" shall be replaced by the words "the Constitution."
7. In Paragraph 14 (1), the words "the competent plant health authority 'are replaced by the words" the Constitution'.
8. In Article 15 (2) (c), the words "State Plant Health Administration" or "SRS" shall be replaced by the words "Central Agricultural Control and Testing Institute" or "TASK." ';
9. In Article 16 (2), the words "locally competent plant health management and, where appropriate, plant health management at the place where import plant health checks are carried out pursuant to Article 25 of the Act on import of the relevant plants' are replaced by the words" Institute '.
10. In Annex 4, points 18.3 and 18.4, the words "plant health management 'are replaced by the words" the Institute'.
11. Annex 6 shall read:

Form of authorisation to import from third countries or to relocate from the Member States of the European Union harmful organisms, plants, plant products and other objects intended for experimental and scientific purposes or for work in the breeding of varieties

12. In Annex 9, Part point 2.1 is replaced by the following:
13. In Annex 9, in the title of Part III, the words "to the phytosanitary authorities' shall be replaced by the words" the Constitution '.
14. In Annex 10, the words "plant health management 'in the title are replaced by the words" the Institute'.
15. In Annex 11, footnote 1, the words "the district department of the State Plant Health Administration 'are replaced by the words" the Institute's workplace'.
16. In Annex 13, in the title, the words "plant health authorities' are replaced by the words" the Constitution '.
17. In Annex 13, footnote 1, the words "the District Department of the State Plant Health Administration 'are replaced by the words" the Institute's Institute'.
18. in Annex No 17 (a) (1), the words "the district, district and central workplace of the plant health administration" are replaced by the words "the Institute's workplace."
19. In Annex No 18, point 4, the words "phytosanitary management 'are replaced by the words" Constitution'.
20. In Annex No 19, footnote 1, the words "Department of State Plant Health 'are replaced by the words" Institute of Plant Health'.

Transitional provision
Plant passports of plants, plant products and other objects for which a systematic plant health check has been carried out by 31 December 2013, in which the responsible official plant protection organisation of the Czech Republic is designated by the text "State Plant Health Administration 'or by the abbreviation" SRS' may be used by 30 June 2015 at the latest.
Efficacy
This Decree shall take effect on 1 January 2014.
