DECLARATION
of 10 December 2009
amending the Ordinance of the Ministry of the Interior implementing electoral laws
The Ministry of Interior, in agreement with the Ministry of Labour and Social Affairs and the Ministry of Finance, pursuant to § 92 (1) (d) of Act No. 247 / 1995 Coll., on elections to Parliament of the Czech Republic and amending and supplementing certain other laws, as amended by Act No. 204 / 2000 Coll. and Act No. 320 / 2009 Coll., pursuant to § 59 (d) of the Act No. 491 / 2001 Coll., on elections to the representatives of municipalities and on amendments to certain laws, as amended by Act No. 320 / 2009 Coll., and under § 70 (d) of Act No. 62 / 2003 Coll., on elections to the European Parliament and on amendments to certain laws:
Amendment of Decree No. 233 / 2000 Coll., on the implementation of certain provisions of Act No. 247 / 1995 Coll., on Elections to Parliament of the Czech Republic and on the amendment and addition of certain other laws, as amended by Act No. 212 / 1996 Coll., the Constitutional Court found published under No. 243 / 1999 Coll. and Act No. 204 / 2000 Coll., as amended
Decree of the Ministry of Interior No. 233 / 2000 Coll., on the implementation of certain provisions of Act No. 247 / 1995 Coll., on the elections to Parliament of the Czech Republic and on the amendment and addition of certain other laws, as amended by Act No. 212 / 1996 Coll., the Constitutional Court found under No. 243 / 1999 Coll. and Act No. 204 / 2000 Coll., as amended by Decree No. 80 / 2002 Coll., Decree No. 188 / 2002 Coll., Decree No. 401 / 2002 Coll., Decree No. 565 / 2002 Coll., Decree No. 251 / 2006 Coll., Decree No. 368 / 2008 Coll., and Decree No. 321 / 2009 Coll., is amended as follows:
1. In Paragraph 12, the following paragraph 4 is inserted after paragraph 3:
"(4) A member of the District Electoral Commission and a special District Electoral Commission who is neither in employment nor in employment, but who is employed, shall be entitled, in addition to the remuneration referred to in paragraphs 1 to 3, to compensation for lost earnings for the duration of his duties as a member of the District Electoral Commission and a special District Electoral Commission of CZK 43 per hour, but not more than CZK 340 per day."
Paragraphs 4 and 5 shall become paragraphs 5 and 6.
2. In Article 12 (5), the words "and the flat-rate compensation for loss of earnings referred to in paragraph 4 'shall be inserted after the words" Remuneration under paragraphs 1 to 3'.
3. In Article 12 (6), the words "and the flat-rate compensation for the loss of earnings referred to in paragraph 4 'shall be inserted after the words" Remuneration under paragraph 1'.
Amendment of Decree of the Ministry of Interior No. 152 / 2000 Coll., on the implementation of certain provisions of Act No. 130 / 2000 Coll., on elections to regional councils and on the amendment of certain laws, as amended
Decree of the Ministry of Interior No. 152 / 2000 Coll., on the implementation of certain provisions of Act No. 130 / 2000 Coll., on Regional Councils and on the amendment of certain laws, as amended by Decree No. 401 / 2002 Coll., Decree No. 565 / 2002 Coll., Decree No. 251 / 2006 Coll. and Decree No. 368 / 2008 Coll., is amended as follows:
1. In Paragraph 17, the following paragraph 3 is inserted after paragraph 2:
"(3) In addition to the remuneration referred to in paragraphs 1 and 2, a member of the District Electoral Commission who is neither in employment nor in employment, shall be entitled to compensation for the loss of earnings for the duration of his duties as a member of the District Electoral Commission of CZK 43 per hour, but not more than CZK 340 per day."
Paragraph 3 shall become paragraph 4.
2. In Article 17 (4), the words "and 2 and the flat-rate compensation for the loss of earnings referred to in paragraph 3 'shall be inserted after the words" Remuneration under paragraph 1'.
Amendment of the Order of the Ministry of Interior No. 59 / 2002 Coll., on the implementation of certain provisions of Act No. 491 / 2001 Coll., on the elections to municipal councils and on the amendment of certain laws, as amended
Decree of the Ministry of the Interior No. 59 / 2002 Coll., on the implementation of certain provisions of Act No. 491 / 2001 Coll., on elections to municipal councils and amending certain laws, as amended by Decree No. 401 / 2002 Coll., Decree No. 565 / 2002 Coll., Decree No. 251 / 2006 Coll. and Decree No. 368 / 2008 Coll., is amended as follows:
1. In Paragraph 1, the following paragraph 2 is inserted after paragraph 1:
"(2) In addition to the remuneration referred to in paragraph 1, a member of the District Electoral Commission who is neither in employment nor in employment, is entitled to compensation for lost earnings for the duration of the term of office of a Member of the District Electoral Commission of CZK 43 per hour, but not more than CZK 340 per day."
Paragraph 2 shall become paragraph 3.
2. In Article 1 (3), the words "and the flat-rate compensation for the loss of earnings referred to in paragraph 2 'shall be inserted after the words" Remuneration under paragraph 1'.
Amendment of Decree No. 409 / 2003 Coll., implementing Act No. 62 / 2003 Coll., on elections to the European Parliament and amending certain laws, as amended
In § 10 paragraph 3 of Decree No. 409 / 2003 Coll., implementing Act No. 62 / 2003 Coll., on elections to the European Parliament and amending certain laws, the words "85 CZK 'are replaced by" 43 CZK' and the words "680 CZK 'are replaced by" 340 CZK'.
EFFECTIVE
This decree shall take effect on the day of its publication.
