DECLARATION
of 15 October 2025
amending Decree No 388 / 2011 Coll., implementing certain provisions of the Law on the provision of benefits to disabled persons, as amended
The Ministry of Labour and Social Affairs provides pursuant to § 37 of Act No. 329 / 2011 Coll., on the provision of benefits to disabled persons and on the amendment of related laws, as amended by Act No. 331 / 2012 Coll., Act No. 313 / 2013 Coll. and Act No. 300 / 2025 Coll., to implement § 34a (7) of this Act:
Decree No. 388 / 2011 Coll., on the implementation of certain provisions of the Act on the provision of benefits to persons with disabilities, as amended by Decree No. 356 / 2012 Coll., Decree No. 409 / 2012 Coll., Decree No. 333 / 2013 Coll., Decree No. 388 / 2013 Coll., Decree No. 116 / 2014 Coll., Decree No. 337 / 2014 Coll., Decree No. 408 / 2017 Coll., Decree No. 57 / 2020 Coll. and Decree No. 442 / 2021 Coll., is amended as follows:
1. Paragraph 2a is deleted.
2. in Article 2c (3) (a), the words "Regional Branch of the Labour Office" shall be replaced by the words "Territorial Social Security Administration."
3. in Article 2c (3), the comma at the end of point (b) shall be replaced by a dot and point (c) shall be deleted;
4. In Article 2c (4), the word "applicant 'is inserted after the word" submitted' and the words "for the issue of a citizen's document (1) 'are replaced by the words" set out in Annex 6 to this decree'.
footnote 1 is deleted.
5. In Annex 1, Part In point 2, the word "voice" shall be inserted after the words "computer control."
6. Annex 3 shall be deleted;
7. Part A of Annex 5 reads as follows:

8. The following Annex 6 is added:
"Annex No 6
Technical requirements for the photograph submitted by the applicant for the issue of the licence
1. The photograph must be identifiable as a person at the time of transmission of the photograph to the local social security administration.
2. The photo has a smooth surface and is in black and white or colour.
3. The photo is rectangular with dimensions 35 mm x 45 mm and is height oriented. The photograph shall have straight or rounded corners with a radius of 3 mm, with a tolerance of 0,5 mm. The thickness of the photograph is between 0,13 mm and 0,27 mm.
4. The distance between the upper edge of the person's head and the upper edge of the photograph is at least 2 mm. The height of the facial part of the head, which consists of a distance from eyes to chin, shall be at least 13 mm.
5. The photo shows the head and upper part of the shoulders of the person displayed in the front view and the person's view is directed to the lens. A view over the shoulder or a facing or tilted head is not permitted.
6. The person's glasses must not cover his eyes in the photograph and create reflections. With the exception of blind persons, dark glass glasses are not allowed.
7. A person must have a neutral expression, a closed mouth and eyes that must not be covered with hair. The cover of the head is only allowed for religious or health reasons. This cover must not cover the face part or create shadows on the face.
8. The background behind the person must be uniform, white or light grey.
9. The execution of reproductions or other modifications of the acquired image recording is not permitted. ';
Efficacy
This Decree shall take effect on 1 July 2026.
