DECLARATION
of 19 December 2023
amending Decree No. 115 / 2013 Coll., on the determination of the specialised competence of doctors investigating death and of doctors carrying out tests confirming irreversible death for the purpose of collecting tissues or organs intended for transplantation (Ordinance on the specialised competence of doctors investigating and confirming death for transplantation)
The Ministry of Health provides pursuant to Section 10 (7) of Act No. 285 / 2002 Coll., on Donation, Collection and Transplantation of Tissue and Organ and on the amendment of certain laws (Transplant Act), as amended by Act No. 44 / 2013 Coll.:
Decree No. 115 / 2013 Coll., on the determination of the specialised competence of medical practitioners investigating death and medical examiners carrying out irreversible death tests for the purpose of the collection of tissues or organs intended for transplantation (Ordinance on the specialised competence of doctors investigating and confirming death for transplantation) is amended as follows:
1. in § 1 (3) (a) (1), § 1 (3) (b) (1), § 2 (2) (a) (1) and § 2 (2) (b) (1), the words "or pediatrics" shall be inserted after the words "pediatrics."
2. in Article 1 (3) (a) (2), the words "or specific specialised competence" shall be inserted after the words "special competence."
3. in Articles 1 (3) (b), 2 (2) (a) and 2 (2) (b), the words "professional competence" shall be replaced at the beginning of point 2 by the words "specific competence or specialised competence."
4. In Article 2 (2) of the Introductory Part of the Provisions and in Article 3 (5) (b), the words "specific competence 'are replaced by the words" specialised competence, specific competence or specific competence'.
5. Paragraph 3 (1) reads as follows:
"(1) A physician performing an examination confirming the irreversible death of a possible donor's brain by means of angiography of the cerebral arteries shall have specific professional or specific specialised competence in radiology and imaging methods. ';
6. in Article 3, the following paragraph 2 is inserted after paragraph 1:
"(2) A physician performing an examination confirming the irreversible death of a possible donor's brain by means of a computer tomographic angiography shall have specialised competence in radiology and imaging methods. ';
Paragraphs 2 to 4 shall become paragraphs 3 to 5.
7. in Article 3 (4) (a) and (b):
"(a) specialised competence in radiology and imaging methods, neurology, neurosurgery or anesthesia and intensive medicine; or
(b) specialised competence, specific competence or specialised competence in the field of paediatric neurology, or specific professional or specialised competence in the field of intensive medicine. "
Efficacy
This Decree shall take effect on 1 January 2024.
