amending Government Regulation No 178 / 2001 Coll., laying down conditions for the protection of workers' health at work, as amended by Government Regulation No 523 / 2002 Coll.
The Government orders pursuant to § 133a (6) and § 134c (7) and to implement § 134 (a) to (c) of Act No. 65 / 1965 Coll., Labour Code, as amended by Act No. 155 / 2000 Coll.:
Government Regulation No 178 / 2001 Coll., laying down conditions for the protection of workers' health at work, as amended by Government Regulation No 523 / 2002 Coll., is amended as follows:
1. footnote 1 shall read:
"(1) Council Directive 89 / 391 / EEC of 12 June 1989 on the introduction of measures to encourage improvements in the safety and health of workers at work. Council Directive 89 / 654 / EEC of 30 November 1989 on minimum requirements for safety and health at work. Council Directive 83 / 477 / EEC of 19 September 1983 on the protection of workers from the risks associated with exposure to asbestos at work, as amended by Directives 91 / 382 / EEC and 98 / 24 / EC, Council Directive 90 / 394 / EEC of 28 June 1990 on the protection of workers from risks related to exposure to carcinogens at work, as amended by Directives 97 / 42 / EC and 1999 / 38 / EC, Directive 2003 / 18 / EC of the European Parliament and of the Council of 27 March 2003 amending Council Directive 83 / 477 / EEC on the protection of workers from exposure to asbestos at work. Council Directive 90 / 269 / EEC of 29 May 1990 on minimum health and safety requirements for manual handling of loads associated with the risk of, in particular, damage to the spine for workers. Council Directive 90 / 270 / EEC of 29 May 1990 on minimum safety and health requirements at work with imaging units. Council Directive 98 / 24 / EC of 7 April 1998 on the safety and health of workers against risks related to chemical agents used at work, Commission Directive 2000 / 39 / EC of 8 June 2000 establishing the first list of indicative occupational exposure limit values by implementing Council Directive 98 / 24 / EC. Directive 2000 / 54 / EC of the European Parliament and of the Council of 18 September 2000 on the protection of workers from the risks associated with exposure to biological agents at work. Council Directive 94 / 33 / EC of 22 June 1994 on the protection of young workers. Council Directive 78 / 610 / EEC of 29 June 1978 on the approximation of the laws, regulations and administrative provisions of the Member States on the protection of the health of workers exposed to vinyl chloride monomer as amended by Directive 1999 / 38 / EC. Council Directive 92 / 85 / EEC of 19 October 1992 on the introduction of measures to improve the safety and health at work of pregnant workers, workers shortly after birth or breastfeeding workers. '
2. Paragraph 1 (2), including footnote 1a, reads as follows:
"(2) The work carried out
(a) the requirements set out in Sections 3 to 5, Sections 7 to 12, Sections 14 to 23, Sections 24 (1), 27 and 28 and Annexes 1 to 3, 5 to 9 and 11 to this Regulation shall apply in open and semi-open stations, unless otherwise provided for in specific legislation); and
(b) as an artistic and artistic activity, with the exception of works of art, the requirements set out in Sections 14, 17, 21 and 28 and Annexes 3 and 11 to this Regulation shall apply. The requirements set out in Sections 2 to 13, Sections 15 and 16, Sections 18 to 20, Sections 22 to 27 and Annex 1, Parts A, B, D and E, Annexes 2 to 5, 7 to 10 to this Regulation shall apply mutatis mutandis to artistic and artistic activities, with the exception of works of art. The requirements set out in Annex 6 to this Regulation shall apply only to works of art.
1a) Decree No. 347 / 2002 Coll., on sanitary requirements for the sale of food and the range of equipment of the shop according to the range of food sold. Decree No. 137 / 2004 Coll., on the hygiene requirements for catering services and on the principles of personal and operational hygiene in epidemiological activities. '
footnote 1a shall be renumbered footnote 1b, including the reference to that footnote.
3. In Paragraph 3, the sentences "Windows and lighting holes, including safety features, shall be added at the end of paragraph 4, to allow safe use, maintenance and cleaning and shall not endanger other persons present in or around the building during maintenance and cleaning. Staff shall be allowed to handle windows, open, close, set or provide skylights or ventilation devices from the floor safely; If opened, they shall be secured in such a position as to avoid risk of injury. ';
4. In Article 5, the sentence "Food supplements may also be part of the protective drink at the end of paragraph 1) is added."
footnote 3a is replaced by the following:
"3a) § 2 (i) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related acts, as amended by Act No. 306 / 2000 Coll. '.
5. in Article 10 (1) (e):
"(e) the risk to the health and health of other persons;"
6. Paragraph 10 (4) is deleted.
7. In Paragraph 14, the sentence "Excessive exposure 'shall be added at the end of paragraph 4, to the condition in which, as a result of an accident or similar unforeseen circumstances, an increase in the concentration of substances in the working air is particularly high.';
8. in Article 14 (5) (a):
"(a) until the causes of the situation which led to excessive exposure or a significant increase in exposure have been remedied, the number of employees shall be limited to those who carry out the necessary work in order to eliminate those causes;"
9. In Article 16 (3), the words "significant increase in exposure 'are replaced by the words" excessive exposure'.
10. in Paragraph 19 (3) (e), "abnormal" is replaced by "excessive."
11. in Paragraph 19 (3) (j), "abnormally high" is replaced by "excessive" and "abnormal" is replaced by "excessive."
12. In the first and second sentences of Paragraph 19 (4), "abnormal" is replaced by "excessive."
13. in Article 19 (5) (c), the words "an alert for possible exceeding the asbestos limit value" shall be inserted after the words "activities."
14.Paragraph 21 (1) reads as follows:
"(1) Asbest means fibrous silicates which are:
(a) Actinolite, Cas No 77536-66-4,
(b) Amosite Cas No 12172-73-5,
(c) Anthophyllite, Cas No 77536-67-5,
(d) Chrysotile Cas No 12001-29-5,
(e) Crocidolite Cas No 12001-28-4,
(f) tremolit Cas No 77536- 68-6. ';
15. in Article 21 (6) (c):
"(c) waste containing asbestos shall be treated as hazardous waste. Waste from materials containing asbestos shall be collected and removed from the workplace as quickly as possible and in sealed sealed containers bearing a label indicating that they contain asbestos; This does not apply to asbestos mining, '.
16. In Paragraph 21, at the end of paragraph 6, the dot is replaced by a comma and the following point (h) is added:
"(h) after the removal of the causes of excessive exposure, the employer shall carry out a control measurement corresponding to the properties of the substance and the nature of the causes of excessive exposure.";
17. in Article 21 (7), "and (f)" shall be replaced by "(f) and (h)";
18. In Paragraph 21, the following paragraph 8 is inserted after paragraph 7:
"(8) For staff who are or may be exposed to asbestos or dust from materials containing asbestos, free training shall be provided at regular intervals to enable knowledge and skills to be acquired to apply proper prevention to health at work, in particular by:
(a) the characteristics of asbestos and its effects on health, including the simultaneous effect of smoking;
(b) the types of products or materials which may contain asbestos;
(c) activities where there is a likelihood of exposure to asbestos;
(d) the importance of control mechanisms to minimise exposure to asbestos;
(e) safe working procedures and protective measures and monitoring their compliance;
(f) the selection of an appropriate breathing protection device, including conditions for its use;
(g) good working practices for excessive or increased exposure due to accidents or sudden leakage during maintenance or repair;
(h) working procedures for decontamination of dust-containing areas of asbestos;
(i) the correct procedure for the storage and disposal of dust containing asbestos;
(j) the scope of preventive medical care for workers exposed to asbestos. ';
Paragraphs 8 and 9 shall be renumbered paragraphs 9 and 10.
19. Paragraph 23 (2), including footnote 9, reads:
"(2) In activities involving exposure to several groups of biological agents, the risk must be assessed on the basis of the hazards posed by all biological agents present, with the level of risk expressed by the inclusion of the work in category 2, third or fourth under the special legislation9) determined by the most dangerous factor.
9) Decree No. 432 / 2003 Coll., laying down the conditions for the classification of works into categories, the limit values of the biological exposure test indicators, the conditions for the collection of material for carrying out biological exposure tests and the formalities for reporting work with asbestos and biological agents. '
20. Paragraph 24 (2) reads:
"(2) If the evaluation of the work proves that they are not linked to a conscious intention to treat biological agents, but the potential exposure to these agents cannot be excluded in work-related activities
(a) in food establishments;
(b) in agriculture,
(c) contact with animals or products of animal origin;
(d) health care, including sectures;
(e) in clinical, veterinary and diagnostic laboratories, with the exception of diagnostic microbiological laboratories, as the work carried out here is of a nature among the activities with a conscious intention of working with biological agents of groups 2 to 4;
(f) in waste disposal facilities; or
(g) in waste water treatment plants;
health protection requirements shall apply in a similar manner to those associated with the conscious intention to carry out work with biological agents of groups 2 to 4 until the results of the evaluation demonstrate that these measures are not necessary. ';
21. In Article 24 (4) (e), the words "on which work is carried out on biological agents of groups 2 to 4 classified under special legislation9) shall be inserted after the word" workplaces. "
22. In Article 24, at the end of paragraph 5, the sentence "For activities linked to the conscious intention of carrying out work on biological agents of groups 2 to 4 shall be added, according to the specific legislation (9a)."
Footnote 9a:
"9a) Act No. 281 / 2002 Coll., on certain measures related to the prohibition of bacteriological (biological) and toxin weapons and on the amendment of the Trade Act, as amended by Act No. 186 / 2004 Coll. '.
23. In Paragraph 28 (1), footnote 17 is replaced by footnote 1a and footnote 17 is deleted.
24. In the last sentence of Paragraph 28 (1), the words "limits under special legislation18) 'are replaced by the words" requirements under special legislature18'.
Footnote 18 reads:
"18) Sections 3 (3) and 41a of Act No. 258 / 2000 Coll., on the Protection of Public Health, as amended by Act No. 274 / 2003 Coll. '.
25. In Annex No 1, at the end of Part A, the sentence "At workplaces where the difference between the resulting temperature of the spherical thermometer tg and the dry temperature is less than 1 ° C, the resulting temperature may be used the value of Ta (° C) measured by the dry thermometer. '
26. In Annex 1, Part C, including the title:
Requirements for microclimatic conditions at work in deep-sea mines
1. The long-term and short-term working hours are set out in Tables 1 to 45.
2. In underground workplaces where the difference between the resulting temperature of the spherical thermometer (tg) and the dry temperature of the air (ta) is less than 1 ° C, values measured by the dry thermometer can be used to determine the permissible working time.
3. In workplaces where the short-term working time (tmax) and long-term working time (tsmm) according to Tables 1 to 45 is the same, no work and rest arrangements need be established. However, exchange effective working hours (PDef) shall not exceed the long-term working hours (tm).
4. The exchange effective working time (PDef) is determined by:
PDef = 480-tD-tPNP-tSMmin,
where:
tD - is the time of descent and exit, transport to the workplace by the designated means of work and walking to the workplace in inclination up to 3 ° and ta ≤ 26 ° C,
tPNP - conditionally necessary breaks at work, e.g. waiting time after tearing work,
tSM - the standard of shift times, such as work meeting, personal need, undressed and dressed, business interview, personal cleansing, food and rest break according to special legislation5).
5. In workplaces where the short-term working time (tmax) is shorter than the long-term working time (tm), a mode of work and rest must be provided.
6. The number of working cycles (c) is determined by the proportion of long-term working time (tm) and short-term work (tmax), the number of cycles being rounded to the nearest whole number. The number of operating cycles shall be calculated from the relation:
c = tm / tmax
The length of one working cycle (tprc) shall be calculated from the relation:
tprc = tsmm / cmin
The total working cycle time shall be calculated from the relation:
= tprc.cmin
7. The minimum duration of one break (tp) is set at 30 minutes.
(a) The total duration of the shift breaks shall be calculated from the relationship:
= tp.c-1 min
(b) At the time of breaks, mining workers must be able to rest in an environment where the air temperature does not exceed the following relative humidity:

8. Work shall be prohibited at workplaces where work and rest arrangements must be established and the conditions referred to in point 7 (b) are not met. Work is also prohibited in workplaces where tmax is less than 30 minutes.
9. The provisions laid down in the second sentence of point 8 shall not apply to emergency situations where the work necessary to protect the lives of workers is to be carried out.
27. In Annex 1, Part D, the table reads:

28. In Annex No 2, Part C, point 1 (a), the word "work 'and the word" work' shall be deleted after the word "If 'is inserted.
29. In Annex 3, point 1, the first sentence is deleted.
30. In Annex 3, Table 3, the entry "Ammonium salicylate 'is added to column" Substance' after the entry "Magnesite 'and column" PELc (mg. m-3)' is added to column "10,0 '.
31. 35. In Annex 5, Part B, point 4, "60 'is replaced by" 55- 70'.
36. Group 2 carcinogens are chemicals listed in the specific legislation7) under the name Karc. kat. 2, as well as cytostatics and hardwood dust. For the purposes of this Regulation, hardwood is: birch (Betula), beech (Fagus), white nut (Hikora), oak (Quercus), African cílon and under. (Diospyros), habru (Carpinus), jasana (Fraxinus), maple (Acer), elm (Ulnus), chestnut (Castanes), linden (Tilia), alsh (Alnus), walnut (Juglans), platinum (Platanus), plunus (Populus), cherries (Prunus), botanical group Dalbergia (Indian firewood, Brazilian black wood, etc.), Honduran pink wood (Prunus), white and redandura (Prunus), cherry (Prunus).
List of chemical carcinogenicity risk working processes
1. Production of auramine.
2. Work associated with exposure to polycyclic aromatic hydrocarbons present in coal soot, tar, pitch, steam or dust. Work associated with exposure to dust, smoke and liquid aerosols resulting from roasting and electrolytic refining of cuprokol ores.
3. Work in workplaces where heavy acid processes are carried out in the production of isopropanol.

47. In Annex No 11, Part In point 6, "j) 'is replaced by" c)', "k) 'is replaced by" d)' and the following point (e) is added:

48. In Annex 11, Part B, at the end of point 4, the word "meals' is replaced by" and food storage '.
Transitional and final provisions
1. Workplaces set up before the date of entry into force of this Regulation shall not be subject to the requirements set out in points 2 (a) and 3 of Part A of Annex 6 to Government Regulation No 178 / 2001 Coll., as amended by this Regulation.
2. Furthermore, the requirements of the workplace set up before 1 January 2003 shall not apply to:
(a) the bright heights of air-conditioned workplaces referred to in points 2 (d) to (e) of Part A of Annex 6 to Government Regulation No 178 / 2001 Coll., as amended by this Regulation;
(b) the clearance height referred to in point 4 of Part A of Annex 6 to Government Regulation 178 / 2001 Coll., as amended by this Regulation;
(c) the clearance height of the sanitary facilities referred to in point 2 of Annex 11 to Government Regulation No 178 / 2001 Coll., as amended by this Regulation.
Efficacy
This Regulation shall enter into force on 1 September 2004, with the exception of Article I (32), which shall take effect on 15 April 2006.
