DECLARATION
of 16 December 2022
amending Decree No. 505 / 2006 Coll., implementing certain provisions of the Social Services Act, as amended
The Ministry of Labour and Social Affairs provides pursuant to § 119 (2) of Act No. 108 / 2006 Coll., on Social Services, as amended by Act No. 261 / 2007 Coll., Act No. 206 / 2009 Coll., Act No. 366 / 2011 Coll., Act No. 313 / 2013 Coll. and Act No. 254 / 2014 Coll., for implementation of § § 73 (3), § 74 (3) and § 75 (1) of this Act:
Decree No. 505 / 2006 Coll., implementing certain provisions of the Social Services Act, as amended by Decree No. 166 / 2007 Coll., Decree No. 340 / 2007 Coll., Decree No. 239 / 2009 Coll., Decree No. 162 / 2010 Coll., Decree No. 391 / 2011 Coll., Decree No. 389 / 2013 Coll., Decree No. 218 / 2016 Coll., Decree No. 387 / 2017 Coll. and Decree No. 34 / 2022 Coll., are amended as follows:
1. Paragraph 5 (2) reads as follows:
"(2) The maximum amount of remuneration for the provision of personal assistance according to the time actually used to ensure the operation shall be:
a) 155 CZK per hour if the service is provided to a person not exceeding 80 hours per month,
b) 135 CZK per hour if the service is provided to the person in the range of more than 80 hours per month;
if the provision of the service, including the time necessary to ensure the operation, does not last an hour, the amount of the payment shall be reduced proportionately. ';
2. in Article 6 (2) (a):
"(a) according to the time actually used to ensure the operations referred to in paragraph 1 (a) and (b), (c) (3) and (4) and (d) (1) to (5) and (e)
1. 155 CZK per hour, if the service is provided to a person not exceeding 80 hours per month,
2. 135 CZK per hour if the service is provided to the person in the range of more than 80 hours per month;
if the provision of such operations, including the time necessary to ensure them, does not persist for an entire hour, the amount of the remuneration shall be reduced proportionately, ';
3. In § 6 (2) (b) (1), § 10 (2) (b) (1), § 11 (2) (b) (1), § 12 (2) (b) (1), § 13 (2) (b) (1), § 14 (2) (b) (1), § 15 (2) (b) (1), § 16 (2) (b) (1), § 17 (2) (a) (1), § 18 (2) (b) (1), § 22 (2) (a) (1), § 29 (2) (b) (1), § 32 (2) (a) (1), and in § 35 (2) (b) (1), the amount of CZK is replaced by "235 CZK."
4. In § 6 (2) (b) (2), § 10 (2) (b) (2), § 11 (2) (b) (2), § 12 (2) (b) (2), § 13 (2) (b) (2), § 14 (2) (b) (2), § 15 (2) (b) (2), § 16 (2) (b) (2), § 17 (2) (a) (2), § 18 (2) (b) (2) (2) (a), § 35 (2) (2) (a), "95 CZK" is replaced by "105 CZK."
5. in § 6 (2) (c), the amount "40 CZK" is replaced by "50 CZK."
6. in Paragraph 6 (2) (d), the amount "CZK 140" is replaced by "CZK 160";
7. In Paragraph 6 (2) (e), the amount "80 CZK" is replaced by "90 CZK."
8. Paragraph 8 (2) reads as follows:
"(2) The maximum amount of remuneration for the provision of guide and preset services according to the time actually consumed to ensure the operation shall be:
a) 155 CZK per hour if the service is provided to a person not exceeding 80 hours per month,
b) 135 CZK per hour if the service is provided to the person in the range of more than 80 hours per month;
if the provision of the service, including the time necessary to ensure the operation, does not last an hour, the amount of the payment shall be reduced proportionately. ';
9. Paragraph 9 (2) reads as follows:
"(2) The maximum amount of remuneration for the granting of aid for separate housing according to the time actually used to ensure operations is:
a) 155 CZK per hour if the service is provided to a person not exceeding 80 hours per month,
b) 135 CZK per hour if the service is provided to the person in the range of more than 80 hours per month;
if the provision of the service, including the time necessary to ensure the operation, does not last an hour, the amount of the payment shall be reduced proportionately. ';
10. in Article 10 (2) (a):
"(a) according to the time actually used to ensure the operations referred to in paragraph 1 (a), (b), (c) (2), (e) to (h)
1. 155 CZK per hour, if the service is provided to a person not exceeding 80 hours per month,
2. 135 CZK per hour if the service is provided to the person in the range of more than 80 hours per month;
if the provision of such operations, including the time necessary to ensure them, does not persist for an entire hour, the amount of the remuneration shall be reduced proportionately, ';
11. In Sections 10 (2) (c), 13 (2) (a), 14 (2) (a), 15 (2) (a), 16 (2) (a), 17 (2) (b), 18 (2) (a) and 35 (2) (a), the amount "250 CZK" is replaced by "280 CZK."
12. in Article 11 (2) (a):
"(a) according to the time actually used to ensure the operations referred to in paragraph 1 (a), (b) (2) and (c) to (f)
1. 155 CZK per hour, if the service is provided to a person not exceeding 80 hours per month,
2. 135 CZK per hour if the service is provided to the person in the range of more than 80 hours per month;
if the provision of such operations, including the time necessary to ensure them, does not persist for an entire hour, the amount of the remuneration shall be reduced proportionately, ';
13. in Article 12 (2) (a):
"(a) according to the time actually used to ensure the operations referred to in paragraph 1 (a), (b) and (d) to (g)
1. 155 CZK per hour, if the service is provided to a person not exceeding 80 hours per month,
2. 135 CZK per hour if the service is provided to the person in the range of more than 80 hours per month;
if the provision of such operations, including the time necessary to ensure them, does not persist for an entire hour, the amount of the remuneration shall be reduced proportionately, ';
14. in Article 17 (2) (c):
"(c) according to the time actually used to ensure the operations referred to in paragraph 1 (c) to (h);
1. 155 CZK per hour, if the service is provided to a person not exceeding 80 hours per month,
2. 135 CZK per hour if the service is provided to the person in the range of more than 80 hours per month;
if the provision of such operations, including the time necessary to ensure them, does not persist for an entire hour, the amount of the remuneration shall be reduced proportionately. ';
15. In § 22 (2) (b) (1) and § 23 (2), the amount "CZK 150" is replaced by "CZK 170."
16. In § 22 (2) (b) (2), "CZK 120" is replaced by "CZK 140" and "CZK 80" is replaced by "CZK 90."
17. in § 29 (2) (a) and § 33 (2) (b), "220 CZK" is replaced by "240 CZK."
18. in Article 35 (2) (c):
"(c) according to the time actually used to ensure the operations referred to in paragraph 1 (g),
1. 155 CZK per hour, if the service is provided to a person not exceeding 80 hours per month,
2. 135 CZK per hour if the service is provided to the person in the range of more than 80 hours per month;
if the provision of such operations, including the time necessary to ensure them, does not persist for an entire hour, the amount of the remuneration shall be reduced proportionately. ';
Efficacy
This Decree shall take effect on 1 January 2023.
