on compensation for carrying out the functions of associate
The Ministry of Justice, pursuant to § 93 (2) to (4) of Act No. 6 / 2002 Coll., on Courts, Judges, Addresses and Government Administration of the Courts and amending certain other laws (Law on Courts and Judges), as amended by Act No. 218 / 2021 Coll.:
Compensation for loss of earnings
§ 1
However, those who are neither in employment nor in a similar employment relationship are entitled to compensation for the loss of earnings for the duration of their duties as associate or other duties as demonstrated by them, but not more than three times the minimum wage or twenty-four times the minimum wage per day.
§ 2
(1) The basis for calculating the compensation for the loss of earnings of the members referred to in Section 1 is the income tax base of natural persons.
(2) The holder referred to in Paragraph 1 shall be entitled, for one hour, to compensation for the loss of earnings calculated by dividing the base referred to in paragraph 1 by the number of working hours per calendar year laid down by the Labour Code as the maximum working time set by the staff working under the one-shift working arrangements.
(3) For the calculation of the compensation for the loss of earnings referred to in paragraph 1, the amount of the taxable amount shall be used, according to which the last tax known to the associate for the last tax period ending before the date of entitlement to the loss of earnings and for which the tax has already been established.
§ 3
In the absence of proof of the amount of the income forgone as provided for in Section 2, the President of the Court of First Instance is responsible for the reimbursement of the loss of earnings corresponding to an hourly minimum wage, but not more than eight hourly minimum wage per day.
§ 4
Reimbursement of final expenditure
The expenditure incurred in carrying out the functions of associate or other duties relating to this function shall be reimbursed under the conditions, to the extent and to the extent laid down in the legislation governing travel refunds.
§ 5
Flat-rate compensation for the performance of the functions of associate
For each day of the hearing, the acceding is entitled to a flat-rate refund for the performance of their duties in the amount of CZK 500.
Final provisions
§ 6
The Order of the Minister of Justice of the Czech Socialist Republic No 14 / 1970 Coll., on Reimbursements to Judiciary of the People is hereby repealed.
§ 7
This decree shall take effect on the day of its publication.
