of 24 April 1978
issuing basic conditions for the supply of chemical products
The State Arbitration of the Czechoslovak Socialist Republic after discussion with the participating ministries and other central authorities pursuant to Sections 392 (1) and 394 (1) of the Economic Code No 109 / 1964 Coll., as published under No 37 / 1971 Coll., hereinafter referred to as "the Act ', provides:

INTRODUCTORY PROVISIONS
§ 1
Subject matter and scope of the adjustment
(1) This Decree regulates supplies
(a) chemical products;
(b) rubber, asbestos and plastic products; applies only to plastic materials and semi-finished products (1) and to parts and finished products of polyvinyl chloride,
(c) products of the paper and cellulose industry,
(d) spent petroleum oils; the provisions of Sections 2 and 3 do not apply to such supplies.
(2) The decree does not apply to supplies for export and import and to supplies of agricultural needs supplied by purchasing organisations to agricultural organisations.

§ 23
Tyres
(1) Class B tyres with design defects are supplied in particular for replacement at reduced price according to the respective price list. For the first equipment, these tyres shall only be supplied if the technical standards or technical conditions of the vehicles so permit. The supplier is responsible for Class B tyres with visual defects as products without such defects.
§ 34f
Consequences of non-compliance
(1) Where the delivery of processed oils contains water or impurities, other than chlorine, in the range exceeding 2% up to 10% of the quantity delivered, only 90% of that quantity shall be included in the performance of the supplier's obligation. Where the supply contains more than 10% of water or impurities or contains chlorine, the supplier's obligation to supply processed oils shall not be taken into account; the rights and obligations under Sections 201, 202 and 206 to 208 of the Act do not arise from organisations. However, the quantity of processed oils not included in the delivery obligation shall be withdrawn by the customer if the supplier demonstrates that the polluted processing oils cannot be used alone.
§ 34i
Transitional provision
For the calendar year 1982, the buyer shall submit to the supplier a draft contract for the delivery of processed oils (§ 34c) by 30 April 1982 at the latest. Where the buyer has submitted a draft contract before the entry into force of this decree, it shall be bound by the draft contract by 30 April 1982; that period also applies to the creation of a contract pursuant to Paragraph 34d (2).

§ 35
Decree No. 119 / 1964 Coll., on the basic conditions of supply of chemical products, is hereby repealed.
§ 36
This decree shall take effect on 1 July 1978.
