Regulation on the free sale of agricultural products and on agricultural markets

of 30 May 1953
on the free sale of agricultural products and on agricultural markets.
The Government of the Czechoslovak Republic orders pursuant to § 14 paragraph 1 of Act No. 56 / 1952 Coll., on delivery obligations and on the purchase of agricultural products:
§ 1.
The basic patriotic obligation of the single agricultural cooperatives, their members, individual farm farmers and other persons subject to delivery obligation is to comply with the compulsory supply of agricultural products to the State in due time.
§ 2.
(1) Unified agricultural cooperatives, their members, individual farmers and other persons subject to supply obligations may freely sell surpluses of their agricultural products and their products at freely agreed prices, namely:
(a) grains, grapes, potatoes, hay and straw - after full compliance with the compulsory delivery of the relevant agricultural crop according to the area or the order for filling, for grains after compliance with the compulsory delivery of all grains;
(b) poppy and individual types of spices - after full compliance with the mandatory delivery of poppy or the relevant type of spices under the delivery contract, the replacement notice or the order for performance;
(c) each type of vegetable and fruit - after completion of the delivery obligation of the relevant type of vegetable or fruit by area, after delivery contract, replacement notice or execution order;
(d) meat - after completion of the quarterly partial deliveries of meat by area, if it is a single agricultural cooperative, or after completion of the year-round delivery of meat by area or by order of completion, if it is members of single agricultural cooperatives, individually managed farmers or other persons subject to compulsory delivery of meat;
(e) cow's milk - after completion of the partial quarterly supply of milk according to the size or the order for compliance;
(f) chicken eggs - after completion of the partial deliveries of eggs for the preceding months from the beginning of the year and for the current month according to the order or order.
(2) The following restrictions shall apply to the free sale of surplus agricultural products:
(a) malting barley, bovine animals for slaughter, calves for slaughter, horses for slaughter and foals for slaughter shall be allowed to sell exclusively to the ransom plants of the county ransom undertakings;
(b) meat from necessarily slaughtered animals shall be allowed to be sold exclusively to the ransom plants of the regional ransom undertakings;
(c) wine grapes and hybrid grapes are allowed to be sold exclusively to national wine-growing enterprises.
(3) Oilseed growers (except poppy seed), sugar beet, chicory, flax, hemp, hops, tobacco, machorines, cocsagyz, medicinal and aromatic plants are required to sell to the State all harvests of these crops other than seed required for their own holdings, even after delivery is mandatory. Sheep farmers are also obliged to sell all wool to the State even after delivery is mandatory.
§ 3.
Single agricultural cooperatives, their members, individually farm farmers and other persons holding agricultural land or keeping livestock may also freely sell free agricultural products, i.e. products for which they have not been required to supply and products not subject to delivery obligations and products thereof.
§ 4.
Surpluses of agricultural products, their products and free agricultural products may be sold directly to consumers or undertakings authorised to purchase agricultural products or to undertakings authorised by the Ministry of Purchase to purchase surplus agricultural products, their products and free agricultural products. However, authorised undertakings may not purchase surplus agricultural products, their products and free agricultural products on agricultural markets organised in cities.
§ 5.
In agreement with the Ministry of Agriculture for certain types of agricultural products, the Ministry of Buying may provide that the free sale of their surpluses to consumer cooperatives and consumers may only be initiated after the completion of the buyout plan for the whole district, by county. However, State purchases will also be made in this case.
§ 6.
Agricultural establishments and persons referred to in Sections 2 and 3 may only sell surplus agricultural products, their products and free agricultural products directly to consumers on agricultural markets or on their holdings. At the time of sale, they shall at any time be required to report upon the invitation a declaration of compliance with the delivery obligations issued to them by the district supervisor of the Ministry of Purchase. The sale or sale of foreign products is not permitted.
§ 7.
(1) The national committees shall organise regular agricultural markets in accordance with the plan established by the Regional National Committee.
(2) Agricultural markets participate in:
(a) agricultural establishments and persons referred to in Sections 2 and 3, by selling their surplus agricultural products, their products and free agricultural products;
(b) collectors of forest crops by selling such crops;
(c) consumer cooperatives in places where they have their regular sales network, selling goods of their product range at national retail prices and other places by selling purchased surpluses of agricultural products, their products and free agricultural products at prices which may not exceed national retail prices;
(d) State-owned enterprises in places where they have their regular sales network, selling goods of their assortment;
(e) local industry and production cooperatives by selling their products;
(f) domestic producers selling their products.
§ 8.
The Ministry of Purchase shall issue more detailed provisions for the implementation of this Regulation. In agreement with the central authorities involved, the Ministry of Internal Trade will issue more detailed rules on the organisation of agricultural markets and the conditions for the sale of goods on these markets (market rules).
§ 9.
This Regulation shall enter into force on 1 June 1953; They shall be carried out by the ministers of redemption, internal trade and agriculture in agreement with the participating members of the Government.
