of 7 August 1945
amending the Government Decree of 5 May 1945, No. 4 Coll., on the Choice and Jurisdiction of National Committees.
According to Article 3 of the Constitutional Decree of 4 December 1944 of the President of the Republic, the Government of the Czechoslovak Republic hereby orders the President of the Republic, No 18 OJ No (Annex to Decree No. 43 / 1945 Coll.), on national committees and provisional National Assembly:
Čl. I.
Government Decree No. 4 / 1945 Coll. is amended as follows:
1. The following paragraph shall be inserted after Paragraph 1 (1):
"(2) Until more detailed provisions are laid down on the organisation of national committees and their rules of procedure, the internal organisation of national committees shall determine the manner in which they exercise their powers and the manner in which their constituents are to be held by the Minister of the Interior. '
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
2. the last sentence of Paragraph 1 (4) shall read as follows:
"The method of appeal and replacement shall be determined by the electoral order; until this happens, they shall ensure the proper establishment, withdrawal or addition of national committees by the authorities. ';
3. the following sentence shall be added to Article 2 (3):
"The local national committee shall also exercise the jurisdiction of the district national committee in cities which, according to its establishment, have also exercised the jurisdiction of the district national committee. '
4. Paragraph 2 (7) shall be amended and read as follows:
"(7) The Local National Committee shall be subordinate to the Regional National Committee, in cities with special status to the Regional National Committee. '
5. The following shall be inserted after Paragraph 2:
„§ 2 a.
(1) A central national committee of the capital of Prague (another central national committee) will be established in the capital of Prague.
(2) The Central National Committee manages all public matters within its remit, unless they are managed by another public authority.
(3) The Central National Committee exercises, in addition to other tasks, the power exercised by the Central Council of the City of Prague, the City Council, local committees, the City Council of the City of Prague and the Mayor of the City of Prague, directly or through its office. The scope of the building and complaint bodies shall cease to exist.
(4) The Central National Committee is subordinate to the Minister of the Interior and to the relevant Ministers in matters falling within the competence of other ministries. Details shall be provided by the Government Order, issued pursuant to Article 3 of the Constitutional Decree of the President of the Republic No. 43 / 1945 Coll. The special provisions on the competence of the Regional National Committee, in particular those on the procedure for instance, remain unaffected by this provision.
(5) The organisation of the administration of the capital city of Prague will be governed by a government decree issued pursuant to Article 3 of the Constitutional Decree of the President of the Republic No. 43 / 1945 Coll.
(6) Otherwise, the provisions of Sections 2 and 3 of the Central National Committee apply. "
6. Paragraph 3 (7) shall be amended and shall be worded as follows:
"(7) The Regional National Committee shall be subordinate to the Regional National Committee, and also to the Minister of the Interior or to any other Minister with regard to political administration. '
7. Paragraph 4, paragraph 7 shall be amended and shall be worded as follows:
"(7) In matters of political governance, the Earth National Committees are subordinate to the Minister of the Interior and, where such matters fall within the competence of other ministries, to the relevant ministers. Where an appeal is admissible, the relevant Ministry shall decide on the appeal from the decisions and measures of the Regional National Committees. '
Čl. II.
(1) This Regulation shall enter into force on 9 May 1945. All members of the government will do it.
(2) The Minister of the Interior is hereby authorised to draw up and publish in the Collection of Laws and Regulations the text of Government Decree No. 4 / 1945 Coll., as follows from the amendments provided for in this Regulation.
