DECLARATION
of 6 December 2012
on the method and timing of accounting and payment of the component of the price for electricity transmission, gas transport, distribution of electricity and gas to cover costs associated with the promotion of electricity, decentralised electricity production and biomethane, and on the implementation of certain other provisions of the Act on Supported Energy Sources (Settlement Order)
According to § 53 (2) (h) to (k) and (n) of Act No. 165 / 2012 Coll., on Supported Energy Sources and on the amendment of certain laws, the Energy Regulatory Authority provides for the implementation of § 11 (9) to (11), § 13 (1), § 36 (3) and § 43 (3) of this Act:
Subject matter
This decree provides
(a) the method and timing of accounting and payment of the component of the electricity transmission price and the electricity distribution price to cover the costs associated with the electricity support;
(b) the method and timing of accounting and payment of the component of the gas transport price and the gas distribution price to cover the costs associated with the promotion of biomethane;
(c) the method and timing of accounting and payment of the component of the electricity distribution price associated with the promotion of the decentral generation of electricity;
(d) the method and procedure for determining the difference between the hourly price and the purchase price and its remuneration between the purchaser and the market operator;
(e) the dates and manner of informing the manufacturer of a negative price on the day-ahead electricity market and of a situation where the supply and demand of electricity in the day-ahead market are not reconciled.
Method and timing of accounting and reimbursement of the component of the electricity transmission price and the electricity distribution price to cover the costs associated with electricity support
(1) The regional distribution system operator shall charge the electricity distribution price component to cover the costs associated with the electricity support to the local distribution system operator for the amount of electricity covered by the electricity transmission price component or the electricity distribution price to cover the costs associated with the electricity support1). The local distribution system operator shall communicate the amount of electricity at which the price is charged to the regional distribution system operator in accordance with the Electricity Market Regulation Regulation (2).
(2) The market operator shall charge the regional distribution system operator and transmission system operator a payment to cover the costs associated with the support of electricity up to the 15th calendar day for the preceding month. The payment to cover the costs associated with the promotion of electricity shall be determined as the product of the component of the electricity transmission price or the electricity distribution price to cover the costs associated with the promotion of electricity and the preliminary value of the quantity of electricity at which the electricity transfer price component or the electricity distribution price to cover the costs associated with the support1), taking into account part of the correction factor provided for in Section 7. The transmission system operator and the regional distribution system operator shall communicate the amount of electricity for which the payment according to the second sentence is accounted for to the market operator in accordance with the electricity market rules decree (3).
(3) On the basis of the final value of the quantity of electricity at which the component of the electricity transmission price or the distribution price of electricity to cover the costs associated with the electricity promotion, communicated to the market operator of the transmission system operator and the regional distribution system operator pursuant to the electricity market rules decree (3), the market operator shall immediately charge the component of the electricity transmission price or the electricity distribution price of the electricity distribution for the potential difference between the final value of the electricity quantity and the preliminary value of the electricity quantity referred to in paragraph 2, taking into account part of the correction factor referred to in Section 7.
(4) The transmission system operator or the regional distribution system operator shall pay the market operator the payment referred to in paragraph 2 and the payment referred to in paragraph 3 if the final value of the amount of electricity referred to in paragraph 3 is higher than the preliminary value of the amount of electricity referred to in paragraph 2 within 5 working days of receipt of the payment settlement document.
Method and timing of accounting and payment of the component of the gas transport price and gas distribution price to cover costs associated with the promotion of biomethane
(1) The market operator shall charge the distribution system operator and transmission system operator a payment to cover the costs of supporting biomethane by the 15th calendar day of the preceding month. The payment to cover the costs associated with the promotion of biomethane shall be determined as the product of the amount of the component of the price for the transport of gas or the price for the distribution of gas to cover the costs associated with the promotion of biomethane and the value of the quantity of gas at which the component of the price for the transport of gas or the price for the distribution of gas is charged to cover the costs associated with the aid of biomethane (4).
(2) On the basis of the corrective value of the quantity of gas at which the component of the gas price or the gas distribution price is charged to cover the costs associated with the biomethane support (4), established by the market operator under the Gas Market Rules Regulation (5), the operator shall immediately charge the component of the gas price or the gas distribution price to cover the costs associated with the biomethane support (4) for any difference between the corrective value of the gas quantity and the value of the gas quantity referred to in paragraph 1.
(3) The transmission system operator and distribution system operator shall pay the market operator the payment referred to in paragraph 1 and the payment referred to in paragraph 2 if the corrective value of the quantity of gas referred to in paragraph 2 is higher than the value of the quantity of gas referred to in paragraph 1 within 10 working days of receipt of the payment settlement document.
Method and timing of accounting and payment of the component of the electricity distribution price associated with the promotion of decentral electricity production
(1) The parent distribution system operator shall charge the component of the electricity distribution price associated with the promotion of the decentralised electricity production of the connected distribution system operator for the quantity of electricity at which the component of the electricity transmission price or electricity distribution price is paid to cover the costs associated with the support of the decentralised electricity production (6). The connected distribution system operator shall communicate the amount of electricity at which the price is settled to the parent distribution system operator in accordance with the electricity market rules decree (2).
(2) The market operator shall charge the regional distribution system operator a payment to cover the costs of supporting the decentralised generation of electricity by the 15th calendar day of the preceding month. The payment to cover costs associated with the promotion of decentral electricity production shall be determined as the product of the amount of the electricity distribution price associated with the promotion of decentralised electricity production and the preliminary value of the amount of electricity at which the component of the electricity transmission price or the electricity distribution price is paid to cover the costs associated with the promotion of decentralised electricity production (6). The regional distribution system operator shall communicate the amount of electricity at which the price is settled to the market operator in accordance with the electricity market rules decree (3).
(3) On the basis of the final value of the quantity of electricity at which the component of the electricity transmission price or the electricity distribution price is paid to cover the costs associated with the promotion of the decentral generation of electricity communicated to the market operator by the regional distribution system operator under the electricity market rules decree (3), the market operator shall immediately charge the component of the electricity distribution price associated with the promotion of the decentralised generation for any difference between the final value of the electricity quantity and the preliminary value of the electricity quantity referred to in paragraph 2.
(4) The regional distribution system operator shall pay the market operator the payment referred to in paragraph 2 and the payment referred to in paragraph 3 if the final value of the quantity of electricity referred to in paragraph 3 is higher than the provisional value of the quantity of electricity referred to in paragraph 2 within 5 working days of receipt of the payment settlement document.
Determination of the difference between the hourly price and the purchase price
(1) The difference between the hourly price and the purchase price shall be based on the prices achieved on the day-ahead market, organised by the market operator for the following calendar day or calendar days, in the case of working days off, working time or public holidays.
(2) The buyer shall pay the market operator a payment resulting from differences between hourly prices and the purchase price for the business hours in which the offers and demand on the day-ahead market have been reconciled, determined in accordance with the procedure laid down in the Annex to this Order.
Information on the negative price or situation in which electricity supply and demand in the day-ahead market are not reconciled
The buyer or buyer shall inform the manufacturer of the negative price being reached or of the non-reconciliation of electricity supply and demand on the day-ahead market in a manner enabling remote access by referring to the information published by the market operator on the day-ahead electricity market.
Settlement method from previous periods
Where the Energy Regulatory Authority determines a positive correction factor related to the promotion of electricity from renewable sources, combined production of electricity and heat and secondary energy sources, the market operator shall reduce the market operator's cleared payment pursuant to Article 2 (2) by one twelfth of the fixed correction factor. Where the Energy Regulatory Authority determines a negative correction factor for a regional distribution system operator, the market operator shall increase the settled payment referred to in Article 2 (2) by one twelfth of the fixed correction factor.
Efficacy
This Decree shall take effect on 1 January 2013.

Determination of the monthly amount of payment resulting from differences between the hourly price and the purchase price
Monthly amount of payment resulting from differences between hourly price and purchase price P is calculated using the formula:

m is the number of categories and the rate of the purchase price according to the date on which the production source is put into service or the amount of the installed output referred to in the Energy Regulatory Authority price decision on the aid in the form of the purchase price of the renewable resource s,
n is the number of hours in the calendar month;
o is the number of types of renewable sources,
vcst is the purchase price of the renewable resource with the purchase price t,
MEst is the quantity of electricity supplied from renewable sources with the purchase price t per calendar month per hour in which the supply and demand on the day-ahead market has been reconciled,
the agreed hourly price on the day-ahead electricity market in hour i is the agreed hourly price; if the agreed hourly price on the day-ahead market is negative, the value of 0 shall be used for the purposes of calculating payment P;
MEi is the amount of electricity supplied from all renewable sources applying the form of aid by ransom prices both in the hour and in the calendar month.
