THE LAW
of 24 June 2004
amending Act No. 101 / 2000 Coll., on the protection of personal data and amending certain laws, as amended
Parliament has decided on this law of the Czech Republic:
Amendment to the Banking Act
Act No. 21 / 1992 Coll., on Banks, as amended by Act No. 264 / 1992 Coll., Act No. 292 / 1993 Coll., Act No. 156 / 1994 Coll., Act No. 83 / 1995 Coll., Act No. 84 / 1995 Coll., Act No. 61 / 1996 Coll., Act No. 306 / 1997 Coll., Act No. 16 / 1998 Coll., Act No. 127 / 1998 Coll., Act No. 165 / 1998 Coll., Act No. 120 / 2001 Coll., Act No. 239 / 2001 Coll., Act No. 319 / 2001 Coll., and Act No. 126 / 2002 Coll., is amended as follows:
1. in Article 37, paragraphs 3, 4 and 5, including footnote 7c, 7d, 7e, and paragraph 2 are deleted;
"(2) Banks and branches of foreign banks are required for the purpose of banking transactions to detect and process data on persons, other than sensitive data on natural persons, needed to enable the banking business to take place without undue legal and material risks to the bank. The data shall be proportionate to the legal and material risks of banking business with the data subject and relevant to the assessment of those risks. The provisions on banking secrecy shall apply to data thus obtained and processed (§ 38). '
footnote 7b is deleted;
2. In Paragraph 38, the following sentence is added at the end of paragraph 10, including footnote 10b: "The provisions of the Special Law 10b) are not affected. '
Footnote 10b) reads as follows:
"10b) Act No. 101 / 2000 Coll., on the protection of personal data and on the amendment of certain laws, as amended. '
3. In Paragraph 38a (1), the words "Banks and branches of foreign banks may inform each other 'are replaced by the words" In carrying out their obligation to act prudently in the performance of their activities, banks and branches of foreign banks may inform each other'.
4. In Paragraph 38b (1), the word "legal 'is deleted and the words" or places of business' are inserted after the word "registered office '.
PERFORMANCE TO DECLARATION OF THE COMPLETE VERSION OF THE LAW
The Prime Minister is hereby authorised to declare in the Collection of Laws the full text of Act No. 101 / 2000 Coll., on the Protection of Personal Data and on the Amendment of Certain Laws, as is apparent from the Laws amending it.
EFFECTIVE
This law shall take effect on the day of its publication, with the exception of the provisions of Article 5 (1) (a) and (b). I points 49 and 50, which take effect on 1 January 2005.
