DECLARATION
of 15 December 2023
on the formalities and form of verification of the results of the surveying activities for State defence purposes and the content and manner of carrying out the proficiency test
According to Article 20 (2) of Act No. 200 / 1994 Coll., on Geometry and on the amendment and addition of certain laws related to its implementation, as amended by Act No. 319 / 2004 Coll., Act No. 189 / 2008 Coll. and Act No. 88 / 2023 Coll., ("the Act '):
Forms and form of verification of the results of surveying activities for State defence purposes
(1) The person responsible for verifying the results of the surveying activities carried out by the military installation pursuant to Article 16b (2) of the Act ("the verifier") shall indicate the verification of the result on all copies of the results of the surveying activities carried out by the military establishment.
(2) The verification of the outcome of the surveying activities carried out by the military equipment in analogue form, containing the elements referred to in Article 16b (5) of the Act, shall always indicate on the last page each separate part of the outcome of the surveying activities containing text or image.
(3) The verification of the outcome of the surveying activities carried out by military equipment in electronic form shall be carried out by the verifier by adding a document in the form of a data report to the outcome of the surveying activities carried out in electronic form or to the output of the authorised conversion of documents1), the input of which is the result of the surveying activities in analogue form; The data report shall contain the particulars referred to in Article 16b (6) of the Act. The verification of the outcome of the surveying activities consisting of a single set may be carried out without the connection of a document in the form of a data report according to the first sentence, provided that the result directly contains the elements referred to in Article 16b (6) of the Act.
(4) For the verified outcome of the surveying activities and the document in the form of a data report referred to in paragraph 3, the output data format shall be used as the output data format according to the Decree on the details of the performance of the file service2).
(5) Where a national map work or the creation and maintenance of a database file containing spatial information for State defence purposes is used for the result of surveying activities which are not the result of surveying activities carried out by military facilities, the formalities and form of verification must meet the relevant requirements for verifying the results of surveying activities authorised by the surveyor) or by the State administration of the surveyor and property cadastre of the Czech Republic (4).
Content of the proficiency test
(1) The proficiency test shall be divided into a part of the general, special and in defence of the outcome of the agricultural activities separately processed by the applicant for the performance of the proficiency test (the applicant).
(2) In the general part of the proficiency test, the applicant shall demonstrate knowledge in the field of:
(a) the legislation of the surveyor and the authorities of the surveyor and the cadastre, including the jurisdiction of the Ministry of Defence (hereinafter referred to as "the Ministry") in this field; and
(b) general regulations governing metrology and defence standardisation, cataloguing and state quality verification.
(3) In the specific part of the proficiency test, the applicant demonstrates knowledge
(a) geodetic reference systems binding on the territory of the Czech Republic, the principles of their use and procedures for transforming and transferring coordinates between them;
(b) a database of geodetic data, geographic data databases and national map works produced for the whole territory of the Czech Republic and the principles of their use;
(c) points in the territory of the Czech Republic and the subject matter and content of their administration;
(d) procedures for targeting and investigating measurement subjects which contain database files containing spatial information and state map works for State defence purposes;
(e) the object and content of the management of database files containing spatial information and state map works for State defence purposes;
(f) the procedures for measuring the half-book and the altimeter, including their accuracy;
(g) measurement procedures to ensure the completeness and correctness of the results of the agricultural activities;
(h) procedures for establishing, renewing or transferring points of the detailed point field and drawing up relevant documentation;
(i) spatial positioning procedures, including their accuracy and control measurements;
(j) documentation of the results of the agricultural activities and their storage;
(k) procedures for the calibration and comparison of instruments and aids and the processing of relevant documents; and
(l) professional terminology in the field of the pursuit of surveying activities, in particular the pursuit of surveying activities for the purpose of ensuring State defence.
(4) The applicant shall justify the accuracy of the procedures used in its preparation in defending the self-processing result of the agricultural activities.
Method for conducting the proficiency test
(1) Information on the location, date and time of the proficiency test shall be provided by the Ministry in an invitation to be delivered to the applicant not later than 14 days before the date of the proficiency test to the applicant by the designated address for service.
(2) The proficiency test shall be oral and shall be open to the public.
(3) Prior to the start of the proficiency test, the applicant shall demonstrate his identity to the Panel of Experts by submitting an identity card or another identification card issued by a public authority.
(4) The expert examination committee shall proceed during the proficiency test according to the test schedule issued by the Ministry. The Ministry shall publish the test schedule on its website.
(5) The Panel of Experts shall draw up a written report on the conduct of the proficiency test and its outcome.
(6) The expert panel assesses the applicant by "benefit" or "benefit." The Chairman of the expert panel shall declare the result of the proficiency test, in the presence of all the members of the expert panel immediately after evaluation of the course of the proficiency test.
Repeal
Decree No. 81 / 2014 Coll., on the conditions for granting official authorisation to verify the results of surveying activities for the purposes of the Ministry of Defence, is hereby repealed.
Efficacy
This Decree shall take effect on 1 January 2024.
