DECLARATION
of 29 October 2025
on the register of discharges from sources of pollution into surface waters
The Ministry of the Environment, in cooperation with the Ministry of Agriculture, provides, pursuant to § 19a (5) of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 182 / 2024 Coll.:
Subject matter
This decree provides
(a) the extent and manner of keeping the registry of discharges;
(b) the extent and method of determining the area close to operations with an integrated permit for the discharge of waste water into surface water;
(c) the scope of the data and the method for its detection, transmission and entry into the register of releases.
Definition of terms
For the purposes of this decree:
(a) the identification of discharges in the field for the purpose of detecting and other information on the location of discharges;
(b) by positioning the release, the coordinates of the point which determine the position of the registered element.
Method of keeping the registry of discharges
Data registered under this Decree shall be transmitted and entered into the registry of releases in a structure that allows data sharing through a defined reference, shared and secure interface (1) in a way that allows remote access.
Scope and method of determination of the area close to plants with an integrated permit to discharge waste water into surface water
(1) The area close to plants with an integrated permit for the discharge of waste water into surface water is a section of water flow situated at a distance of one river kilometre upstream and five river kilometres downstream from the point of discharge of waste water from operations with an integrated permit (m2) for the discharge of waste water into surface water.
(2) In addition, sections of inflows into the water stream within the area defined in paragraph 1 at a distance of one river kilometre from the confluence shall be considered as being within the vicinity of operations with an integrated permit for discharge of waste water into surface waters.
Scope and manner of transmission and entry of data into the Release Register
(1) Discharges shall be transferred and entered into the discharge register by discharges which are construction sites which are, or may be, discharged into surface waters, in particular waste water, mining water, contaminated groundwater or water, or, where appropriate, defective substances, which flow from a complete operational area where the hazardous substances are handled, or the result of rain drainage. The discharge register shall not receive and enter data on discharges which are tubes with an internal diameter of less than 100 mm.
(2) In the case of discharges pursuant to § 19a (3) (b) of the Water Act, the discharges are also included in the register with data on discharges located in the covered sections of the water flows in the closed profile and in the water streams temporarily flowing through the natural cavities below the earth's surface.
(3) The scope of the data entered in the register of releases and the entities which insert them into the register of releases are set out in the Annex to this decree.
Method and scope of data collection
(1) The coordinates are determined in the reference coordinate system of the Single Trigonometric Catastral Network (S-JTSK).
(2) Only data on discharges located in the Czech Republic are collected in the water flow sections forming the national border.
Efficacy
This Decree shall take effect on 1 November 2025.
