THE LAW
of 11 December 2024
amending Act No. 283 / 2021 Coll., Construction Act, as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Under Article 334a of Act No. 283 / 2021 Coll., Construction Act, as amended by Act No. 195 / 2022 Coll., Act No. 152 / 2023 Coll., Act No. 465 / 2023 Coll., Act No. 126 / 2024 Coll. and Act No. 183 / 2024 Coll., the following Section 334b is inserted:
„§ 334b
Use of construction management information systems in a transitional period
(1) For the purposes of paragraph 2, a transitional period shall mean the period until 31 December 2027 and for the purposes of paragraphs 3 to 9, the period until 30 June 2025.
(2) In the transitional period, Sections 173, 180 (2), 181 (2) and (3), 267 (5), 272 (3) to (5) and 273 (2) are not applicable in the matters of the construction rules.
(3) In the transitional period, the second sentence of § 22 (c), § 23 (2) (f), § 25 (f), § 105 (2), § 108 (3), § 113 (6), § 128 (2), § 130 (3), § 267 (5), § 269 (4) and (5) and § 303 (4) are not applicable.
(4) Other information systems may be used in the transitional period in order to exercise the responsibilities of the zoning authorities, the construction authorities and the authorities concerned. The zoning authority, the building authority and the authority concerned shall ensure that, at the request of the Ministry, data from another information system that has been created in the exercise of their competence in the transitional period can be transmitted to the Ministry for the purpose of transferring them to the information systems of the construction administration.
(5) The lists provided for in Articles 42 (4) and 50 (2) are published by the Ministry in a transitional period in a way that allows remote access instead of their publication in the national geographical planning portal.
(6) Where such a law provides that the Ministry or the acquirer places the document in a national zoning geoportal or publishes the document in a national zoning geoportal, that obligation shall be fulfilled in a transitional period where the Ministry or the acquirer publishes it in a manner that allows remote access, indicating the date of its publication. The address of the publication shall be sent by the purchaser to the superior authority. In the transitional period, the obligation referred to in Article 64 (1) cannot be fulfilled by entering territorial data into the national zoning portal. The period referred to in Article 69 (1) shall begin to run from the date of publication of the territorial study in a manner which allows remote access.
(7) Where that law provides that the Ministry or the purchaser refers to a document inserted into the national zoning portal, reference may be made to a document published in accordance with the procedure laid down in paragraph 6 during the transitional period.
(8) Territorial analysis documents, territorial studies, planning documents, its full wording, the definition of the built-up territory, the change in the definition of the built-up territory, the complete text of the definition of the built-up territory following its amendment, the territorial measures and the information on the verification of the building closures pursuant to Article 326 are published in a transitional period instead of their insertion into the national spatial planning geoportal in a manner enabling remote access. The acquirer shall enter the documents referred to in the first sentence in the national zoning geoportal by 31 December 2025.
(9) During the transitional period, the Ministry is responsible for accounting for the territorial planning activity. The subject of the land planning activity registration shall be metadata on land planning documentation, established territory, territorial measures and a territorial study, including the course of their procurement. The data shall be entered in the register by the relevant customer. The metadata shall include an indication of the address of the publication of the documents referred to in paragraph 8 in a way that allows remote access.
(10) The procedure and other procedures, with the exception of those referred to in Part Three, started from 1 July 2024 until the end of the transitional period, shall be completed in accordance with paragraphs 2 to 8. ';
Čl. II
Transitional provision
The legal effects of acts which took place between 1 July 2024 and the date of entry into force of this Act, in accordance with existing legislation or with Article 334b of the Construction Act, are not affected.
Čl. III
Efficacy
This Act shall take effect on the day following its publication.
