DECLARATION
of 21 October 2005
amending Decree No. 323 / 2004 Coll., implementing certain provisions of the Vineyard and Wine Act
The Ministry of Agriculture provides pursuant to Section 42 of Act No. 321 / 2004 Coll., on Vinohradship and Wine and on the amendment of certain related laws (Vinohradship and Wine Act):
Decree No. 323 / 2004 Coll., implementing certain provisions of the Law on wine-growing and wine-growing, is amended as follows:
1. Paragraph 1, including footnote 1, reads as follows:
List of varieties for the production of quality wine in a specified area
[K § 4 (4) (d) of the Act]
(1) The list of wine grape varieties from which it is permitted to produce the quality wine of a specified region is given in the State Variety Book (1).
(2) The names of certain varieties referred to in paragraph 1 may be replaced by the synonyms listed in Annex 1.

Footnotes 1 and 2 to date shall become footnotes 2 and 3, including the footnotes.
2. In Paragraph 9 (1), "in an oak barrel of 225 litres' is replaced by" in an oak barrel of more than 210 litres and less than 250 litres'.
3. In Article 9, at the end of paragraph 2, the dot is replaced by a comma and the following points (g) and (h) are added:
"(g)" botrytic collection "shall mean where a quality wine with the addition of the types of selection of grapes or selection of berries or selection of cibebes has been produced from grapes which have been at least 30% infected by the noble mould grey Botrytis cinerea P.,
(h) "aged on yeast" or "trained on yeast" or "adorned on yeast" if the wine in production has been left on yeast for at least 6 months. "
4. In Article 9 (6), the words "placed on the back of the packaging 'are deleted.
5. in Article 12 (3) (a), including footnote 2a:
"(a) in the case of an actual alcoholic strength by volume, in accordance with the provisions directly applicable to the European Community2a),
(2a) Article 3 (2) of Commission Regulation (EC) No 753 / 2002. "
6. In Paragraph 14 (1), "9 'is replaced by" 12'.
7. In Article 14 (5) (b), the sentence "the purchase note shall be kept by the producer and the grower for a period of 5 years," shall be replaced by a sentence "the purchase note may also be replaced by another document, in particular by a serious note or delivery note, provided that the document has all the particulars and particulars contained in the purchase note; the purchase note or the document replacing it, both the manufacturer and the grower, for a period of 5 years, ';
8. In Paragraph 14, the following paragraph 12 is inserted after paragraph 11:
"(12) The provisions of paragraph 11, second and third, shall not apply to producers whose manufacture of the products for the wine year does not exceed 100 hlices. This manufacturer shall keep a record of the stocks of products and of the addition of substances other than wine to the product, together for all his products, on a single form according to the category of wine in accordance with the model set out in Annex No 33a or the lot in accordance with the model set out in Annex No 33b. ';
Paragraph 12 shall become paragraph 13.
9. In Paragraph 14 (13), the words "or 33a or 33b 'are inserted after the number" 33'.
10. Annex No 1 shall read as follows:

11. In Annex 3, under the table, the sentence "The grant of the replanting right provided for in Article 9 (1) (b) of the Act is subject to the lodging of a security to the State Agricultural Intervention Fund 'is deleted.

Notes:
For pink wine the values prescribed for white wine shall apply.
Limits for density, total dry extract, reducing sugars, ash, ash alkalinity, all acid content, bound acids, pH and free SO2 are not fixed. '

Transitional provisions
1. Annexes No 23, 25 and 27 to Decree No 323 / 2004 Coll., as effective until the date of entry into force of this Order, may be used until 31 July 2006.
2. Products whose production started before the date of entry into force of this Order may be labelled in accordance with Decree No. 323 / 2004 Coll., as effective from the date of entry into force of this Order, if they comply with the requirements laid down in this Decree.
Efficacy
This decree shall take effect on the day of its publication.
