GOVERNMENT REGULATION
of 25 September 2002
implementing Act No. 285 / 2002 Coll., on Donation, Collection and Transplantation of Tissue and Organ and on the Amendment of Certain Laws (Transplant Act)
The Government hereby orders, in accordance with Article 78 of the Constitution of the Czech Republic:
Physicians who carry out examinations to confirm the irreparability of clinical signs of brain death shall include in the death report (1) the particulars listed in the Annex to this Regulation. A final diagnosis of the death of a possible donor of tissues or organs will be confirmed in this protocol by a lethal physician. 2)
(1) If, on the basis of the results of the autopsy, the doctor who performed the autopsy (3) finds that the deceased has suffered from a disease or condition likely to endanger the health or life of the recipient, (4) notify the medical institution which has carried out the collection of the tissue or organ. If a tissue or organ transplant has already been carried out by the recipient, the health care facility referred to in the sentence first in the case of an additional conclusion on the medical incompetence of the deceased donor shall immediately take precautionary measures to prevent the risk to the life or health of the recipient, or ensure that the recipient receives the necessary medical care.
(2) The medical devices which removed the deceased tissue donor or organs inform each other of the additional conclusion on the medical incompetence of the deceased donor.
This Regulation shall enter into force on the day of its publication.
