DECLARATION
of 14 December 2016
amending Decree No. 194 / 2009 Coll., on determining the details of the use and operation of the data box information system, as amended
The Ministry of the Interior provides pursuant to § 9 paragraphs 3 and 4 and § 20 paragraphs 3 and 4 of Act No. 300 / 2008 Coll., on electronic acts and authorized conversion of documents, as amended by Act No. 190 / 2009 Coll. and Act No. 263 / 2011 Coll.:
Decree No. 194 / 2009 Coll., on determining the details of the use and operation of the data box information system, as amended by Decree No. 422 / 2010 Coll. and Decree No. 322 / 2015 Coll., is amended as follows:
1. Paragraph 1 (4) is deleted.
Paragraphs 5 and 6 shall be renumbered paragraphs 4 and 5.
2. in Article 2 (1) (b) and (e), the words "some of the hashing functions referred to" shall be replaced by the words "hashing functions referred to."
3. in Paragraph 2 (1) (c) of the introductory part of the provision, the words "according to the technical standard indicated" shall be replaced by the words "established in accordance with the standard indicated."
4. In Article 2 (1) (c) (2) and (3), the words "certification service provider 'are replaced by the words" qualified trust service provider'.
5. in Article 2 (1) (c) (2) and Article 3 (5), the words "certification service provider" shall be replaced by the words "qualified trust service provider."
6. In Article 2 (2), the words "accredited certification service provider 'are replaced by the words" qualified trust service provider'.
7. In Paragraph 3 (2), the word "do not permit 'is replaced by" is entitled to make it impossible' and the word "to 'is inserted after the word" for a period'.
8. In Article 3 (3), the word "system 'is deleted.
9. In Article 3 (5), the words "with the standard indicated 'are replaced by the words" with the technical standards indicated' and the words "and (c) 'are inserted after the words" (b)'.

Time of storage of the data message in the data box
The storage time of the data message in the data box
(a) 90 days from the date on which the person who has access to the document contained in the data message entered the data box;
(b) 90 days from the date on which the data box was accessed by means of an electronic file service system or other electronic application using a certificate;
(c) 3 years from the date on which the data message was delivered to the data box if it does not reach the data box referred to in (a) or (b). "
11. In Annex No 2, points II and III read:

(c) ETSI EN 319 411-1 v1.1.1 Electronic Signages and Infrastructures (ESI); Policy and security requirements for Trust Service Providers issuing certificates; Part 1: General requirements'.
Efficacy
This Decision shall enter into force on 1 January 2017.
