DRAFT GOVERNMENT REGULATION
of 29 November 2017
amending Government Regulation No 351 / 2013 Coll., determining the amount of interest on late payment and the costs associated with the claim, determining the remuneration of the liquidator, the liquidator and the member of the body of the legal entity appointed by the court and regulating certain issues relating to the Commercial Journal and the public registers of legal and natural persons
The Government mandates the implementation of Act No. 304 / 2013 Coll., on public registers of legal and natural persons and on the registration of trust funds, as amended by Act No. 87 / 2015 Coll., Act No. 192 / 2016 Coll., Act No. 298 / 2016 Coll., Act No. 368 / 2016 Coll., Act No. 460 / 2016 Coll. and Act No. 303 / 2017 Coll.:
Government Decree No 351 / 2013 Coll., determining the amount of interest on late payments and the costs associated with the claim, determining the remuneration of the liquidator, the liquidator and the member of the body of the legal entity appointed by the court and governing certain issues relating to the Commercial Journal and the public registers of legal and natural persons, is amended as follows:
1. In the title of the Government Order, the word "and 'after the word" Journal' shall be replaced by a comma and at the end of the title the words "and the records of trust funds and the records of data on beneficial owners' shall be added.
2. In Article 1, at the end of the text in point (d), the words "and the registration of trust funds and the manner in which the application for registration, amendment or deletion of registration in the register of beneficial owners' shall be added.
3. The heading of Part Five reads:
"PUBLIC REPRESENTATIONS, EVIDENCE OF HEALTH FUNDS AND EVIDENCE OF ACTUAL PROPERTY '.
4. In Part Five, the following Sections 18a and 18b are inserted after Section 18:
Paragraph 13 and the provisions of this Part shall apply mutatis mutandis to the registration of trust funds.
Where the registration, amendment or deletion of the registration in the register of beneficial owners is carried out by a court, the application for registration, amendment or deletion of the registration in the register of beneficial owners shall be made by means of an electronically completed form. The form thus completed may be sent to the court in both electronic and paper form. '
Efficacy
This Regulation shall enter into force on 1 January 2018.
