Ministry of Interior of the Czech Republic
of 10 August 1992
on the tasks of municipalities in providing elections for councils in municipalities and local referendums
The Ministry of Interior of the Czech Republic pursuant to § 93 paragraph 1 (a) of the Act of the Czech National Council No. 298 / 1992 Coll., on elections to councils in municipalities and on a local referendum (hereinafter referred to as "the Act") provides:
Permanent voting districts
(1) The municipal council shall establish a permanent voting district (hereinafter referred to as "districts") for election to the municipal councils and to the local referendum.
(2) The counties are established in such a way as to preserve the natural territory and the building blocks with regard to local conditions, and to:
- there has been no significant overrun of the number of 10001) eligible citizens (2) in one district,
- a disproportionately small number of votes were not compromised by the secrecy of the vote.
(3) After the creation of the districts, the municipal council shall ensure that the structure and territory of the districts are changed only in justified cases, in particular if, as a result of the changes in construction, the number of eligible citizens in the district deviates significantly from the number laid down by law. 1)
(4) The district must not exceed the limits of the constituency if it has been established.
(5) Each district in the municipality is marked with a serial number. Numbering shall be carried out in one numerical series by Arabic numerals. In the capital of Prague and in the statutory towns (3), subdivided into urban districts or urban areas (hereinafter referred to as "territorial subdivided statutory cities"), the numbering of districts may be carried out in separate numerical lines for each urban area or for each urban district.
(6) If a local referendum is held on the day of the elections to the council of the municipality, the districts are common.
Storage and elimination of tickets and other voting documents
(1) The municipal office shall keep the ballots and the official envelopes used for 20 days after the result of the vote is announced; after this deadline, the ballots and used envelopes may be discarded.
(2) The lists by district are returned to the municipal authority for further use.
(3) For documentation relating to the holding of a local referendum, the following shredding features and deadlines shall be established:
(a) a proposal to hold a local referendum, a signature, a resolution on the announcement of a referendum, 3 pieces of the ballot, the minutes of the district and local electoral commission, the announcement of the outcome of the vote, the documentation on the financial costs of the referendum - A 10,
(b) other documentation - S 5.
(4) For documentation concerning the holding of elections to the council of the municipality, the following shredding characteristics and deadlines shall be established:
(a) candidate lists with all the necessary features, a record of the local registration commission, of the renunciation or appeal documents, of 3 ballots, of the county and local election committee entries, the announcement of the results of the vote and of the financial costs of the election to the council - A 10,
(b) other documentation - S 5.
The Order of the Ministry of the Interior of the Czech Republic No. 381 / 1990 Coll., on the tasks of national committees in securing elections for councils in municipalities is hereby repealed.
This decree shall take effect on the day of its publication.
