DECLARATION
of 2 December 2003
amending Decree No 384 / 2002 Coll., implementing certain provisions of the Weapons Act
According to Article 79 (2) of Act No. 119 / 2002 Coll., on firearms and ammunition and amending Act No. 156 / 2000 Coll., on verification of firearms, ammunition and pyrotechnic articles and amending Act No. 288 / 1995 Coll., on firearms and ammunition (Firearms and Ammo Act), as amended by Act No. 13 / 1998 Coll., and Act No. 368 / 1992 Coll., on administrative charges, as amended, and Act No. 455 / 1991 Coll., Act No. 8, § 49 (1) and (3), as amended by Act No. 228 / 2003 Coll., (Act No. 228 / 2003 Coll.) for the implementation of § 21a (8), § 39 (§ 39 (8), § 49 (3), § 49 (3) of the Act:
Decree No 384 / 2002 Coll., on the implementation of certain provisions of the Weapons Act, is amended as follows:
1. in Article 1, the following point (d) is inserted after point (c):
"(d) the content of the theoretical and practical part of the proficiency test and the overall assessment of the applicant's proficiency test for the issue of a group F armaments licence, ';
Points (d) and (e) shall be renumbered as points (e) and (f).
2. In Article 1, at the end of point (e), the word "a 'is replaced by a comma and the following point (f) is inserted:
"(f) the method of carrying out documentation of unexploded ammunition and explosives; and ';
Point (f) shall be renumbered as (g).
3. Part Three of Part 1 reads: "The applicant's proficiency test for the issue of a group A to E weapons licence '.
4. In Part Three, after Part 2, the following Part 3 is inserted, including the title and footnote (1a):

Content of the theoretical part of the test
The theoretical part of the test is carried out by a test consisting of 50 questions, 12 of which are from knowledge of legislation, 10 of which are from knowledge of regulations governing the handling of ammunition and explosives, 25 of which are from knowledge of ammunition, explosives and detection techniques, and 3 of which are from knowledge of health minima. The correct answer to each question is evaluated by 3 points, except for the correct answers to questions about knowledge of the health minimum, which are evaluated by 1 point. The theoretical examination shall also include an oral interview lasting no more than 45 minutes by which the applicant certifies knowledge under Section 21a (3) of the Act.
Content of the practical part of the test
In the practical part of the examination, the applicant shall gradually demonstrate all the acts contained in Section 21a (4) of the Act.
Overall test evaluation
(1) The overall assessment of the test consists of an evaluation of the theoretical part and the practical part of the test. The results obtained during the test are assessed by the Test Committee (1a) by a "benefit 'or" benefit' assessment. The degree of evaluation shall be indicated in the assessment form for the proficiency test, the model of which is set out in Annex 24.
(2) In the theoretical part of the test, the applicant shall be assessed by "benefit 'if, without the aid, he obtains at least 135 points from the test within 60 minutes and subsequently certifies knowledge in accordance with the provisions of Section 21a (3) of the Act.
(3) If, in the theoretical part of the test, the applicant is assessed as "non-profit ', the practical part of the test is no longer performed and the overall result is assessed as" non-profit'.
(4) In the practical part of the test, the applicant shall be assessed as "benefit 'if he can handle the activities referred to in Section 10b.
(5) If, in the practical part of the test, the applicant infringes the principles for the safe handling of ammunition and explosives, thereby endangering the safety of persons in practice, the test committee shall terminate the test and assess the "non-profit 'level.
(6) An applicant who, in the theoretical part of the examination, has been assessed as "benefited" and in the practical part "failed" may once repeat the practical part of the examination on the basis of a written request submitted to the Ministry of Interior within two months of the date on which the practical part of the examination failed.

'
5. The heading of Part Four reads:
"METHOD OF VERIFICATION AND DOCUMENTATION
(Paragraph 39 (5) and (8) of the Law) '.
6. After Paragraph 14, the following Section 14a is inserted:
Record book on unexploded ammunition and explosives
(1) The holder of a weapons licence (2) keeps documentation on the findings of unexploded ammunition and explosives in the record book on the findings of unexploded munitions and explosives (hereinafter referred to as the "Found Book").
(2) The list of findings shall include:
(a) the serial number of the registration;
(b) the place, date and time of the finding of unexploded ammunition or explosives;
(c) data identifying unexploded ammunition or explosive;
(d) the quantity of unexploded ammunition or explosives found;
(e) the date and time of deactivation;
(f) the date and time of receipt of the unexploded ammunition or explosives by a member of the Police of the Czech Republic, his identification number and signature; and
g name, surname and signature of the person making the registration. ';
7. In Paragraph 15 (1), the words "and only F-licence holders' shall be inserted after the words" Paragraph 40 of the Act '.
8. Paragraph 15 (2) reads as follows:
"(2) The books referred to in Sections 11 to 14 shall be kept separately for each category of weapon."
9. In Article 16, the words "(No 21) 'are replaced by the words" a comma, the dot at the end of the sentence is replaced by a comma and the words "applications for a proficiency test for the issue of a group F weapons licence (No 23), an assessment of the applicant's proficiency test for the issue of a group F arms licence (No 25), an application for the issue of a European firearms pass (No 26) and a model of a European weapons pass (No 27)' are added.
10. Annex 3 shall read as follows:

11. Annex 10 shall read as follows:

12. Annex 11 shall read as follows:

Forms issued in accordance with the models established in the current version of the Order may be used until stocks are exhausted.
Efficacy
This Decree shall take effect on 1 January 2004, with the exception of Annexes 26 and 27, as referred to in point 14, which shall take effect on the date of entry into force of the Treaty of Accession of the Czech Republic into force of the European Union.
