DECLARATION
of 2 December 2003
which regulates the method of fixing the price for the final consumer of tobacco products
The Ministry of Finance provides pursuant to § 139 (1) for the implementation of § 131 (j) of Act No. 353 / 2003 Coll., on Consumer Taxes (hereinafter referred to as "the Act"):
Procedure for processing price proposals for final consumers
(1) Manufacturers or importers of tobacco products (hereinafter referred to as "the applicants") shall submit to the Customs office Kutná Hora (hereinafter referred to as "the authorised customs office") proposals for the final consumer of tobacco products by the 10th day of the current month, indicating the effective date. In case of proven necessity, exceptional effects may be taken into account and the proposal may be submitted earlier.
(2) The appellants shall process the price proposals for each tobacco product in accordance with the models set out in the Annex. A description of the tobacco product containing:
(a) the type of tobacco product under Section 101 of the Act;
(b) the exact trade name of the tobacco product;
(c) for cigarettes, the length of the tobacco rope and the total length;
(d) the number of cuts and, where appropriate, the quantity of kilograms in the unit pack intended for direct consumption;
(e) a description of the unit packaging intended for direct consumption;
(f) the currency in which the basic raw materials or tobacco products are paid;
(g) the country of origin in codes according to customs legislation.
(3) Proposals for tobacco products shall be sent or transmitted by the appellants to the customs office in writing and at the same time on the technical medium (disk) or by electronic mail in the form of an Excel or WORD file.
(4) Together with the draft price for the final consumer of the new product, the appellants shall submit to the authorised customs office a sample of the tobacco product or its photodocumentation and the consent of the proprietor of the trade mark to use this mark and to sell the tobacco products with that mark, if any.
(5) When processing proposals for price changes for the final consumer, a similar procedure shall apply as for new tobacco products, indicating the reason for the change.
Efficacy
This Decree shall take effect on 1 January 2004.
