DECLARATION
of 27 January 2016
amending Decree No 75 / 2010 Coll., on measures to ensure protection against the introduction and spread of Potato PWN and Potato PWN and amending Decree No 332 / 2004 Coll., on measures to ensure protection against the introduction and spread of potato cancer, Potato PWN and Yellowish PWN
According to Article 88 (2) of Act No. 326 / 2004 Coll., on Phytosanitary Care and on the Amendment of Certain Related Acts, as amended by Act No. 249 / 2008 Coll. and Act No. 279 / 2013 Coll., ("the Act '), the Ministry of Agriculture provides for the implementation of § 88 (1) (b) of the Act:
Decree No. 75 / 2010 Coll., on measures to ensure protection against the introduction and spread of Potato PWN and Jaundice and amending Decree No. 332 / 2004 Coll., on measures to ensure protection against the introduction and spread of potato cancer, Potato PWN and Jaundice shall be amended as follows:
1. in § 2 (a), "Lycopersicon lycopersicum (L.) Karsten ex Farw." shall be replaced by "Solanum lycopersicum L."
2. Paragraph 3 (4) reads as follows:
"(4) The survey referred to in paragraphs 1 to 3 shall be carried out at its expense by the propagator of potato propagating material, the farmer of potato seed or the grower of plants intended for cultivation listed in Annex 1 to this Regulation, including the timely delivery of samples to the place of analysis. Soil samples shall be taken under the direct supervision of an official of the Central Audit and Examination Institute of the Agricultural Institute (hereinafter referred to as the Institute) who shall seal the samples taken with an official seal. ';
3. in Articles 3 (6) and (8), 4 (1) to (3), 5, 6, 7 (1), 9 (1) and (2) and in Annex 7 (2) and (4), the words "plant health management" are replaced by the words "Institute."
4. Paragraph 3 (7), including footnote 6, reads:
"(7) The Institute confirms the resistance to the PWN pathogens listed in Annex 4 to this Decree for varieties and new breeding of potatoes registered for the testing of potato varieties for registration, carried out by the Institute under the Law on the circulation of seeds and seeds6).
6) § 30 of Act No. 219 / 2003 Coll., as amended by Act No. 178 / 2006 Coll. '
5. in Articles 3 (8), 4 (4), 7 (3) and 8 (3), the words "plant health management" shall be replaced by "the Institute."
6. In Paragraph 4 (4), the words "the phytosanitary authorities' are replaced by the words" the Constitution '.
7. in § 5 (2) (a), § 7 (2) (c) (1.2), § 8 (3) and (4), § 9 (1) (b) and Annex 8 (A) (4), the words "plant health authorities" shall be replaced by the words "Constitution."
8. in Article 5 (2), the word "or" and (b) shall be added after the comma at the end of point (a);
Point (c) shall be renumbered (b).
9. in § 7 (2) (c) (2), § 8 (2) and § 8 (5) (a), the words "plant health management" shall be replaced by "the Constitution."
10. in Article 7 (2) (c) (2), the words "the competent place of the plant health administration" shall be replaced by "the Constitution."
11. in Article 7 (4):
"(4) Potato propagating material shall not be grown on other parcels or other objects in the quarantine area in the year following the year of detection of PWN. In subsequent years, only potato varieties resistant to locally occurring pathogenic PWN may be grown on these parcels, but not more frequently on the same parcel than every 4 years [Paragraph 76 (1) (a) of the Law]. '
12. in Article 7, paragraph 7 shall be deleted;
13. in point 1 of Annex No 1, the words "Lycopersicon lycopersicum (L.) Karsten ex Farw. 'are replaced by the words" Solanum lycopersicum L.' and the words "Solanum melongena L. 'are deleted;
14. In Annex No 2, point 1, the words "at the end of the text of point (a) shall be added; the size of the standard volume of the sample taken shall not be changed at a smaller area of the parcel '.
15. In Annex 2, point 7, "100 'is replaced by" 200'.
16. In Annex 4, the following title is added: "Testing and evaluation of resistance of potato varieties'.
17. In Annex 4, Part B, point 17 is deleted.
Points 18 and 19 shall become points 17 and 18.
18. In Annex No 4, Part B, point 17, the words "given 'are inserted after the words" susceptible to' and the words "pathotype 'are inserted after the words" (i.e. it reaches 1 or 2 points in the table according to Part A),'.
19. In Annex 6, Part C, the words "territorial competent plant health management centre 'are replaced by the words" Institute'.
20. In Annex No 7, point 1, the words "the geographical location of the plant health administration centre 'are replaced by the words" the Constitution'.
21. In Annex No 8, points 2 and 4, the words "the responsible place of work of the plant health administration 'are replaced by the words" the Constitution'.
22. In the first sentence of point 4 of Annex 8, the comma after the word "places' shall be deleted.
23. in Annex 8, point 6 is deleted;
24. In Annex No 8, Part A, in the last sentence, "1 to 6 'is replaced by" 1 to 5'.
Efficacy
This Decision shall enter into force on 1 March 2016.
