DECLARATION
of 7 February 2003
amending Decree No. 252 / 2002 Coll., implementing certain provisions of the Customs Act
The Ministry of Finance provides for the Customs Act pursuant to Sections 165 (4) and 167 (1) (b) of Act No. 13 / 1993 Coll., as amended by Act No. 1 / 2002 Coll.:
Decree No. 252 / 2002 Coll. implementing certain provisions of the Customs Act is amended as follows:
1. In Section 88, the words "and cases where inward processing is restricted 'shall be inserted at the end of the title.
2. In Section 88, in brackets under the heading, the words "Section 165 (4) (a) 'are inserted after the words" K'.
3. In Article 88 (2), at the end of point (e), the dot is replaced by a comma and the words "if not for agricultural products referred to in paragraphs 4 to 7 'are added.
4. In Section 88, paragraphs 4 to 7 are added, including footnote 1:
"(4) In the calendar year 2003, authorisation may be granted for the application of the inward processing procedure under the conditional system to goods of tariff heading and subheading 1)
(a) 1701 - cane or beet sugar and chemically pure sucrose in solid form,
(b) 1702 30 10, 1702 40 10, 1702 60 10 and 1702 90 30 - isoglucose,
(c) 1702 90 99 - other sugars, including invert sugars, other
(d) 2106 90 30 - syrups containing added flavouring or colouring matter, of isoglucose,
(e) 2106 90 59 - flavouring or colouring matter syrups, other, and
(f) 1806 10 90 - cocoa powder containing 80% or more by weight of sucrose,
a total quantity not exceeding 5 060 tonnes.
(5) The placing on the market of the authorised quantity of goods is governed by the timetable for the declarations made for the release of the goods referred to in paragraph 4 for the inward processing procedure in the suspension system and accepted in one calendar day.
(6) The Ministry of Finance - Directorate-General for Customs is responsible for the allocation of quantities each working day.
(7) Where the quantity requested for drawing is more than the balance available from the authorised quantity on one calendar day, the Ministry of Finance - Directorate-General for Customs - shall determine the allocation of the quantity of goods for that calendar day on a pro rata basis.

This Decree shall take effect on the date of its publication and shall expire on 31 December 2003.
