Slovak National Council
of 14 March 1968
on the capital of the Slovak Socialist Republic
In order to highlight the position of Bratislava as the capital of Slovakia while at the same time trying to create appropriate conditions for the activities of the national committees and further development of Bratislava
The Slovak National Council decided on this law:
Basic provisions
The capital of the Slovak Socialist Republic of Bratislava constitutes a separate territorial unit; is not part of any region.
The National Committee of the Slovak Socialist Republic of Bratislava ("the National Committee of the Slovak Socialist Republic '), which is directly governed by the Government of the Slovak Socialist Republic, is the body of socialist state power and administration in the Slovak Socialist Republic.
(1) The territory of the capital of the Slovak Socialist Republic of Bratislava is divided into urban districts, namely Bratislava I, Bratislava II, Bratislava III and Bratislava IV.
(2) The territory of the Slovak Socialist Republic of Bratislava is connected from the district of Bratislava to the surrounding urban districts and is integrated into the territory of the municipalities: the Danube Bistrica, Vrakuňa, Záhorská Bystrica, Devín Nová Ves, Jarovce, Rusovka and Čunovo.
(3) The territory of the city consists of the following urban areas (cadastral territory): Old Town, Niva, Vinohrady, New Town, Ružinov, Prievas, Trnávka, Vajnory, Rača, Lamac, Dúbravka, Devin, Karlova Ves, Parržalka, the Danube Bistrice, Vrakuňa, Záhorská Bystrica, Devín Nová Ves, Jarovce, Rusovka and Čunovo.
(4) The detailed definition of the territory of urban districts will be declared by the Ministry of Interior of the Slovak Socialist Republic.
(5) It is possible to create or abolish the city district by law of the Slovak National Council. The Government of the Slovak Socialist Republic is to substantially change the territory of the city district, unless this changes substantially the territory of the West Slovak Region; other changes to the territory of the urban districts are carried out by the national committee of the capital.
(1) The authorities of socialist state power and administration in the urban districts of the Slovak Socialist Republic of Bratislava are district national committees.
(2) In the parts of the urban districts created by the integration of the municipalities referred to in § 3 (2) and in the urban areas of Petržalka, Rača and Vajnora, the local national committees are managed by the national district committees; have jurisdiction under the National Committees Act.
The National Committee of the Capital, with the National Circular Committees and the Local National Committees, shall carry out the tasks of the National Committees of all degrees on the territory of the City.
The National Committee of the Capital, the District National Committees and the Local National Committees are governed by the principle that the development of economic and cultural construction of Bratislava as the capital of the Slovak Socialist Republic is an important social interest. This principle is also governed by the Government of the Slovak Socialist Republic and by the central authorities of the Slovak Socialist Republic in the performance of their tasks as regards the interests of the city.
Management of the development of the Slovak Socialist Republic of Bratislava
The main task of the national committee of the capital and district national committees is to take care of the universal development of Bratislava as the capital of the Slovak Socialist Republic, in particular its planned construction, the development of services, the protection of cultural monuments, the creation and protection of the healthy environment and the safeguarding of public order.
The leading tasks of the National Committee of the Capital also include the care of creating favourable conditions for the activities of the Central Slovak National Authorities and, where appropriate, of the national institutions which have their seat in the capital of the Slovak Socialist Republic of Bratislava.
(1) The central authorities of the Slovak Socialist Republic address with the national committee of the capital all the problems within their competence concerning the economic, cultural, health and social construction of the city and assist the national committee of the capital in the performance of its tasks. They discuss with the national committee of the capital those parts of the draft development plan of their field which affect the interests of the city. If there are disputes between the central authorities of the Slovak Socialist Republic and the national committee of the capital, because the draft development plan, which the central authorities of the Slovak Socialist Republic discuss with the national committee of the capital, does not safeguard the needs of the city expressed in the draft city development plan, the Government of the Slovak Socialist Republic decides on them. The National Committee of the Capital Republic may propose to the Government of the Slovak Socialist Republic to impose tasks on the central authorities of the Slovak Socialist Republic in securing the needs of the Slovak Socialist Republic.
(2) The National Committee of the Capital shall coordinate the process of organisations and state bodies in carrying out tasks relating to the development of the city.
(1) All economic, cooperative and other organisations, including centrally managed organisations operating in the territory of the Slovak Socialist Republic of Bratislava, are obliged to:
(a) to cooperate with the national committee of the capital and, where appropriate, with the district national committees in ensuring the planned development of the city, to provide information and explanations and to submit the reports and other supporting documents needed by the national committees in the performance of their tasks;
(b) submit to the National Committee of the Capital to express its concept of development, studies, long-term prospects and economic plans, those parts of which concern the development of the city.
(2) In cases provided for in specific regulations, the opinion of the National Committee of the Capital for the Organisations referred to in paragraph 1 shall be binding: in other cases, if the opinion of the National Committee of the Capital is not taken into account, the Board of the National Committee may propose the Government of the Slovak Socialist Republic to discuss the matter.
(3) In order to place an organisation or part of it (plant, establishment, etc.) in the territory of the Slovak Socialist Republic of Bratislava, to abolish and alter its activities, if it affects a significant extent the life of the city, the agreement of the national committee of the capital is needed.
(1) The central government bodies of the Slovak Socialist Republic and other government bodies, national committees and organisations cooperate with the national committee of the capital, as well as in meeting the important interests of the capital of the Slovak Socialist Republic of Bratislava outside their territory and helping it with their measures.
(2) If the territory of Bratislava-rural counties and Dunajská Streda, the Zapodoslovenskaya Regional National Committee, or the relevant Regional National Committee in agreement with the National Committee of the Capital
- approve forward-looking national economic studies, overall development plans and territorial plans,
- discuss and adopt a common position on investment projects and project tasks for the construction and conversion of industrial buildings and equipment, transport, vohodossovská, energy and recreational equipment and related facilities for trade, supply and other services.
(3) The National Committee of the Capital shall act by analogy in an agreement with the West Slovak Regional National Committee to address the issues referred to in paragraph 2, insofar as they affect the interests of the districts of Bratislava - rural areas and the Danube Streda.
Scope of the National Committee of the Capital and the Circular National Committees
(1) The National Committee of the Capital, in close cooperation with the National Circular Committees, plans, manages and ensures the construction and reconstruction of the city and organises the planned development of economic, cultural, health and social construction within its territory. He participates in the preparation of the state plan for the development of the national economy, cooperates with the central authorities of the Slovak Socialist Republic and with the central authorities of the state administration and makes proposals to address issues affecting the development of the city. It approves the development plan of the Slovak Socialist Republic of Bratislava and, within the framework of it, regulates the correct proportions in the development of the city.
(2) The national committee of the capital manages and directs the activities of the district national committees, controls them, in particular oversees the implementation of laws and the maintenance of state discipline, and reviews their management. It provides comprehensive assistance to the national committees in their work and in solving 'urban challenges, advising them on the performance of their tasks, building on their knowledge and discussing their initiatives and comments. Proposals for serious measures shall be prepared and discussed with the national committees.
(3) The National Committee of the Capital shall establish and manage and, where appropriate, manage organisations and facilities which serve to meet needs beyond the perimeter and whose management (administration) is more efficient and economical to organise for the whole city.
(4) In addition, the National Committee of the Capital shall exercise its powers under other laws and regulations to the National Committees, unless the Law entrusts it to the Circular National Committees (Sections 12 to 14). In the areas of public policy, education, health, culture and information, and water management, state administration, which would otherwise belong to the national committees, if it were matters of urban importance; more detailed arrangements are laid down in the Statute of the National Committee of the Capital. The National Committee of the Capital may, at its plenary session, provide, in agreement with the Circular National Committees, that it will also carry out other tasks which would otherwise belong to the Circular National Committees, provided that this makes the administration more efficient or better satisfying the needs of citizens and organisations.
The District National Committees, in line with the planned development of the city, ensure the development of their districts through the widest participation of citizens. They take care of the enhancement and appearance of the circuits. They shall cooperate closely with the national committee of the capital in addressing urban-wide issues and shall make initiatives in this respect. They are involved in drawing up long-term concepts and plans for the development of the Slovak Socialist Republic of Bratislava, and formulating and approving plans for the development of their own economy and their budgets.
(1) The District National Committees shall exercise state administration in matters which, under specific regulations, belong to the District National Committees and in those parts of the urban districts in which local national committees do not operate, as well as in matters which, under specific regulations, belong to local national committees.
(2) The National Committee of the Capital may, in agreement with the respective National Circular Committees, provide, at its plenary session, that certain tasks falling within the competence of the Circular National Committees will also be carried out by the Circular National Committee in the territory of other Circular National Committees for reasons of effectiveness or other serious reasons. In the same way, it may entrust certain tasks under its responsibility to the National Circuit Committees.
(1) Circumstantial national committees establish and manage nursery, nursery schools, basic nine-year-olds, extracurricular educational facilities, cultural and educational facilities and social security facilities of peripheral importance.
(2) In order to carry out their tasks, the district national committees establish and manage the district organisations of the housing economy; may also establish and manage other organisations and facilities which satisfy predominantly local needs or which are more efficient to organise by circuit.
(3) The National Committee of the Capital shall determine, in agreement with the Circular National Committees, the scope and forms of their participation in the establishment of tasks and the control of the activities of the organisations directly managed.
(1) The National Committee of the Capital and the District National Committees, their bodies and Members are developing a wide range of organisational and cultural education activities, thus creating the preconditions for active participation of citizens in the administration of the city.
(2) The Circular National Committees establish civil committees, home committees and other their assets, familiarise them with the work of the National Committees, use their initiatives in the performance of their tasks and focus their activities on active cooperation between citizens and national committees.
Organizational construction of the national committee of the capital and district national committees and relations with local national committees
(1) At least 90 Members are elected to the national committee of the capital.
(2) The Circular National Committees shall determine the number of their Members, taking into account the size of their constituency, the scope of their responsibilities and the establishment of a competent working group. In so doing, the number of Members shall be such that the District National Committee shall have at least 60 Members.
(1) The National Committee of the Capital and the District National Committees establish executive bodies (Council, Commission, People's Control Committee, Administrative Commission, Trade Unions or other departments). The Government of the Slovak Socialist Republic by regulation determines which departments or departments establish a national committee of the capital and district national committees
(2) The Council of the National Committee of the Capital shall be composed of the Mayor of the Slovak Socialist Republic of Bratislava, its Deputy Deputy, Secretary of the National Committee of the Capital and other members elected by the National Committee of the Capital of Members. The Council of the National Committee of the capital has 12 to 20 members.
(3) The primary shall perform the functions which, under the Law on National Committees, are responsible for the chairman of the National Committee. As a representative of the Slovak Socialist Republic, Bratislava has the right to use historical primary insignia.
(4) The Council of the Circular National Committee shall be composed of the President, Vice-President (Vice-Presidents), Secretary and other members elected by the Circular National Committee of Members. The Council of the District National Committee shall have between 8 and 15 members.
(1) Local national committees shall participate in the performance of the tasks of the district national committees and the national committee of the capital and shall assist the development of the city.
(2) The national committee of the capital or the district national committee may, in agreement with the local national committee, assume certain tasks falling within the competence of that local national committee.
The national committee of the capital may, on a proposal from the local national committee, decide, after consultation with the citizens and with the relevant district national committee, to abolish the local national committee and to move it to the respective district national committee.
Character and colors of the capital of the Slovak Socialist Republic of Bratislava, honorary citizenship and other honours
(1) If the use of a state emblem is not prescribed, national committees operating in the capital of the Slovak Socialist Republic of Bratislava, as well as their managed and managed organisations, may use the emblem of the Slovak Socialist Republic of Bratislava.
(2) Other organisations may use the city emblem only with the permission of the national committee of the capital.
(3) The emblem and colours of the capital of the Slovak Socialist Republic of Bratislava and the manner in which they are used will be adapted to the status of the national committee of the capital.
(1) The national committee of the capital may grant the honorary citizenship of the capital of the Slovak Socialist Republic of Bratislava to persons who have been particularly deserving of the capital of the Slovak Socialist Republic and its population or of peace and friendship between nations.
(2) The National Committee of the Capital City can appreciate the significant activities of persons who have been responsible for the construction of the capital of the Slovak Socialist Republic of Bratislava by granting public recognition for merit.
(3) Excellent creative performances that enrich human knowledge or contributed significantly to solving the tasks of socialist construction or further development of the culture of the city can be rewarded by the National Committee of the Capital by the award of the Prize of the Slovak Socialist Republic of Bratislava.
(4) Details of the conditions and arrangements for granting honorary citizenship, public recognition for merit and the prices of the Slovak Socialist Republic of Bratislava will be laid down by the Statute of the National Committee of the Capital.
Final provisions
(1) The Statute of the National Committee of the Capital shall be approved by the National Committee of the Capital at its plenary session.
(2) The rules of procedure and employment of the national committee of the capital shall be further adapted in the Statute of the national committee of the capital, the organisation of its bodies, their responsibilities and the division of work between them, the organisation and the facilities managed or managed by the national committee of the capital and the assets which assist it in carrying out its tasks. To the extent defined by this law, the Statute of the National Committee of the Capital shall also provide for the division of tasks between the National Committee of the Capital and the Circular National Committees.
Unless this law provides otherwise, the provisions of the Law on National Committees in the Slovak Socialist Republic of Bratislava apply to national committees.
This Act shall take effect on the day of its publication.
