of 23 March 1960
on the implementation of project, scientific research, art and other work in higher and industrial schools for socialist organisations
According to the XI. Congress of the Communist Party of Czechoslovakia and the 1959 meeting of its Central Committee in April, the level of scientific and artistic work is increasing in universities, combines with practice and focuses on the needs of production, technology and culture; the principle of bringing teaching together with production work applies to industrial schools. Higher and industrial schools represent a large capacity of experts in their totality, whose cooperation in managing some of the difficult problems of our national economy is very important and important in terms of production needs. In order for this cooperation to be consistent with the performance of the teaching and scientific research tasks of these schools, it is desirable to limit as much individual cooperation as possible between university and industrial staff and socialist organisations. Comprehensive participation of whole schools in such tasks must be passed through their scientific and educational activities.
Therefore, the aim of the new regulation of the implementation of project, scientific research, artistic and other work in these schools for socialist organisations is an even closer combination of these schools with life and teaching with practice, the stimulation of scientific activity by universities and the consistent application of collective methods in research and scientific work. In the field of art it will mainly be the creation of significant, material-intensive works of art, which are usually used by studios and other operating facilities of art schools.
The application of collective methods in the implementation of these works also envisages the education of students in conjunction with teaching with practice and their involvement in the working collective of higher and industrial schools.
The Government of the Czechoslovak Republic therefore provides:
Preliminary provisions
(1) Universities are entitled
(a) in a subcontracting manner for socialist organisations, carry out research and project work, consultation and expertise on such works, which are included in a set of research works and which are set out in the project work by the State Committee for Construction; *)
(b) both supply and sub-supply methods for socialist organisations
carry out scientific research work;
work on artistic tasks;
develop expertise, opinions, consultations and similar work.
(2) The authorisations referred to in paragraph 1 shall apply mutatis mutandis to industrial schools. *)
Submission, takeover and execution of works
(1) Socialists' organisations which will require from higher or industrial schools or their workers the work referred to in Article 1 are required to discuss their takeover with those schools (Rectorate, Dean, Directorate) as a supplier, if any, by a subcontractor.
(2) The required work will be assessed and taken over by the Director, after consultation with the trade union, in higher education institutions (the Dean), in more serious cases following the observations of the Scientific or Artistic Council of the College (the Faculty), in industrial schools. Higher or industrial schools may take over the work referred to in Section 1 only if they are highly demanding, if they allow for an increase in the level of scientific and artistic work, its closer focus on the needs of production, technology and culture, as well as links with practice, and if this allows the performance of teaching and already planned scientific research and artistic tasks of the school.
(3) For each work taken over, the Rector (Dean) or the Head of the School shall designate the Head responsible for its implementation; the work taken over, except for experts, opinions, consultations and similar work, shall include schools in their research and project plans, scientific research or artistic work.
(4) In the interests of central management and planning of the scientific and artistic activities of universities and the pedagogical activities of industrial schools, the Ministry of Education and Culture may reserve the designation of the maximum part of the working time for which universities and industrial schools may participate in the work to which this Decree authorises them. For the implementation of the provisions of paragraphs 2 and 3 of the Directive, the Ministry of Education and Culture shall issue a university or an industrial school for the purpose of implementing the provisions of paragraphs 2 and 3 of the Directive governing the procedure for the adoption and implementation of the awarded work.
Relations between the client and the supplier
In order to carry out the work referred to in § 1, higher or industrial schools conclude economic agreements under Act No. 69 / 1958 Coll., on Economic Relations between Socialist Organisations and under the special regulations of the main arbitration of the Czechoslovak Republic.
Financing and remuneration
(1) The remuneration to be paid by a higher or industrial school after the contract has been awarded shall be paid by the Directives to be issued under paragraph 2 to the collective or to the workers who have performed the task under the contract; artistic workers shall also be reimbursed for the costs associated with the purchase of the material and the direction of the production of the work of art, provided that the material is not provided and that the school is not reimbursed by the director. The remaining part of the remuneration remains a high or industrial school which will use it to obtain the equipment needed for its further development.
(2) The details of the financing of the work taken over by a university or industrial school under this decree and the remuneration of the collective or workers who have performed their tasks under the contract shall be laid down in the directives to be issued by the Ministry of Education and Culture in agreement with the Ministry of Finance and the Secretariat of the State Labour Commission.
Final provisions
(1) The staff of higher and industrial schools may participate, with the agreement of the school, in the carrying out of project and research work in project institutes as their staff in the secondary employment.
(2) Workers of universities and industrial schools may take over the work referred to in § 1 as individuals under the conditions laid down in the specific regulations, *) if such work cannot take over the school (§ 2 (2)); However, in all cases the school must ensure that the work carried out is recorded and checked.
This decree does not affect regulations and directives
scientific research activities other than those referred to in Section 1;
literary and publicist activities under Act No. 115 / 1953 Coll., on Copyright Law, and Law under this Act;
the provisions and directives governing:
activity according to Act No. 47 / 1959 Coll., on the modification of legal conditions of experts and interpreters,
activities under the Order of the President of the State Planning Commission and Finance Minister No. 196 / 1959 Ú. l., to increase material interest in the development and implementation of new technology,
the activity of inventors and enhancers; and
provisions governing reporting and other obligations relating to the performance of the work of a university or industrial school for which they are provided by the relevant regulations.
This decree shall be amended or supplemented as appropriate.
(a) Paragraph 2 (2) of the Decree of the State Committee on Construction No 177 / 1957 Ú. l., on the implementation of research and project work for Socialist sector organisations;
(b) Paragraph 5 and Article 6 of Decree No. 91 / 1958 of the Minister for Education and Culture of the Czech Republic, on the purchase, sale and exhibition of works of fine arts and works of folk artistic creativity, on the award of proposals in the fields of art used and on the reproduction, display and other dissemination of portraits of constitutional agents and other significant figures, in the sense that socialist organisations may, in respect of the work referred to in § 1, turn directly to universities or industrial schools.
This decree shall take effect from the date of its publication.
