DECLARATION
of 17 December 2024
on the application forms submitted to the water authority and the proposal form for the establishment of the water source protection zone
The Ministry of Agriculture and the Ministry of the Environment, pursuant to § 115b (1) of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 182 / 2024 Coll.:
Subject matter
(1) This Order sets out the application form for:
(a) a permit for the handling or modification of surface water or groundwater, except for an application for authorisation under points (b) to (d);
(b) a permit to collect groundwater for household use or to amend it;
(c) a permit for the discharge of waste water into surface water or its modification;
(d) authorisation to discharge waste water into or change groundwater;
(e) authorisation or amendment of certain activities;
(f) an authorisation for the discharge of waste water containing, or changing, a particularly dangerous substance or priority hazardous substance;
(g) consent under Article 17 of the Act,
(h) observations pursuant to Paragraph 18 of the Act;
(i) exemption from the achievement of the objectives of water protection;
(j) laying down the method and conditions for the discharge of mining water into surface or groundwater waters or its modification;
(k) laying down the conditions for the use of or the authorisation of an exemption for the use of or modification of defective substances;
(l) the approval of the waterworks control order.
(2) This decree also sets out a proposal form for the establishment or amendment of a water source protection zone.
Application for authorisation to handle or modify surface or groundwater
The application form for authorisation for the treatment or modification of surface water or groundwater is set out in Annex 1 to this Decree.
Application for a permit to collect groundwater for household purposes or to amend it
The application form for the permit to collect groundwater for household use or its amendment is set out in Annex 2 to this Decree.
Application for authorisation to discharge waste water into surface water or to modify it
The application form for authorisation for the discharge of waste water into surface waters or its amendment is set out in Annex 3 to this Decree.
Application for authorisation to discharge waste water into or change groundwater
The application form for authorisation to discharge waste water into groundwater or to amend it is set out in Annex 4 to this Decree.
Application for authorisation or amendment of certain activities
The application form for authorisation or amendment of certain activities is set out in Annex 5 to this Decree.
Application for authorisation for the discharge of waste water containing or amending a particularly dangerous substance or a priority dangerous substance into a sewer
The application form for authorisation for discharges of waste water containing a particularly dangerous substance or a priority dangerous substance into the sewerage or its amendment is set out in Annex 6 to this Decree.
Request for consent pursuant to Article 17 of the Act
The form of the request for consent under Section 17 of the Act is set out in Annex 7 to this Decree.
Request for observations pursuant to Article 18 of the Act
The form of the request for observations under Paragraph 18 of the Act is set out in Annex 8 to this Decree.
Application for exemption from the achievement of the objectives of water protection
The application form for exemption from the objectives of water protection is set out in Annex 9 to this Decree.
Application for or modification of the method and conditions for discharge of mining water into surface or groundwater waters
The application form for the establishment of the method and conditions for discharge of mining water into surface or groundwater waters or its amendment is set out in Annex 10 to this Decree.
Application for the setting of conditions for the use of defective substances or for the authorisation of an exemption for the use of defective substances or their amendment
The application form for the setting of conditions for the use of defective substances or for the authorisation of an exemption for the use of defective substances or their amendment is set out in Annex 11 to this Decree.
Application for approval of the waterworks control order
The application form for approval of the Water Works Manipulative Rules is set out in Annex 12 to this Decree.
Proposal for the establishment or modification of a water source protection zone
The design form for the establishment of or amendment to the water source protection zone is set out in Annex 13 to this Decree.
Transitional provision
In proceedings initiated before the date of entry into force of this Order, the documents submitted to the Water Authority pursuant to Decree No. 183 / 2018 Coll., on the particulars of the decisions and other measures of the Water Authority and on the documents submitted to the Water Authority, as effective before the date of entry into force of the Order.
Repeal
They shall be deleted:
1. Decree No. 183 / 2018 Coll., on the formalities for decisions and other measures of the Water Authority and on documents submitted to the Water Authority.
2. Decree No. 197 / 2019 Coll., amending Decree No. 183 / 2018 Coll., on the formalities for decisions and other measures of the Water Authority and on documents submitted to the Water Authority.
Efficacy
This Decree shall take effect on 1 January 2025.
