DECLARATION
of 21 December 2010
determining the number of foreigners who can reside in the transit area of an international airport in the Czech Republic only on the basis of an airport transit visa
The Ministry of Interior, after consulting the Ministry of Foreign Affairs, provides for Act No. 326 / 1999 Coll., on the residence of foreigners in the Czech Republic and on the amendment of certain laws, as amended by Act No. 428 / 2005 Coll., Act No. 379 / 2007 Coll. and Act No. 427 / 2010 Coll.:
This decree, following the directly applicable regulation of the European Union1) and contained in the list 2) regulates the range of foreigners who can reside in the transit area of an international airport in the Czech Republic only on the basis of an airport transit visa.
(1) A foreign national who is a national citizen or who is proved to be a travel document of a State which is included in the list set out in the Annex to this Regulation may reside in the transit area of an international airport within the territory of the Czech Republic only on the basis of an airport transit visa.
(2) The alien referred to in paragraph 1 may reside in the transit area of an international airport without an airport transit visa issued under the directly applicable European Union3).
Repeal
The following shall be deleted:
1. Decree No. 446 / 2005 Coll., laying down a range of foreigners who may reside in the transit area of an international airport in the Czech Republic only on the basis of an airport visa issued.
2. Decree No. 356 / 2006 Coll., amending Decree No. 446 / 2005 Coll., laying down a range of foreigners who may reside in the transit area of an international airport in the Czech Republic only on the basis of an airport visa granted.
3. Decree No. 418 / 2006 Coll., amending Decree No. 446 / 2005 Coll., laying down the range of foreigners who may reside in the transit area of an international airport in the Czech Republic only on the basis of an airport visa issued, as amended by Decree No. 356 / 2006 Coll.
4. Decree No. 13 / 2007 Coll., amending Decree No. 446 / 2005 Coll., laying down the range of foreigners who may reside in the transit area of an international airport in the Czech Republic only on the basis of an airport visa issued, as amended.
5. Decree No. 246 / 2007 Coll., amending Decree No. 446 / 2005 Coll., laying down a range of foreigners who may reside in the transit area of an international airport in the Czech Republic only on the basis of an airport visa issued, as amended.
6. Decree No. 111 / 2008 Coll., amending Decree No. 446 / 2005 Coll., laying down the range of foreigners who may reside in the transit area of an international airport in the Czech Republic only on the basis of an airport visa issued, as amended.
7. Decree No. 92 / 2010 Coll., amending Decree No. 446 / 2005 Coll., laying down the range of foreigners who may reside in the transit area of an international airport in the Czech Republic only on the basis of an airport visa issued, as amended.
Efficacy
This Decree shall take effect on 1 January 2011.
