of 2 July 2004
on the acquisition of competence to handle hazardous chemicals and chemical products classified as highly toxic
According to § 44b (3) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the Amendment of Certain Related Acts, as amended by Act No. 356 / 2003 Coll., hereinafter referred to as "the Act ':
§ 1
Subject matter
This decree provides
(a) the method of setting up and composition of the Commission for the examination of proficiency for the management of hazardous chemicals and chemical products classified as highly toxic (1) (hereinafter referred to as test);
(b) the form and content of the application for the test;
(c) the basic content and conditions of the test.
§ 2
Commission for proficiency checks
(1) The Commission is three members pursuant to Article 1 (a). The chairman and the other members shall be appointed by the head of the competent public health authority in which the commission is set up.
(2) Only persons who are competent under Section 44b (1) (a) of the Act may be appointed members of the Examination Board, including its chairman, and only a person who has been active in the labour hygiene sector for at least five years may be appointed chairman.
(3) The examination committee shall act by a majority of its members.
§ 3
Application for test
(1) In the application referred to in Article 1 (b) for the examination, the applicant shall indicate:
(a) the name and, where appropriate, the name, surname, address of residence and date and place of birth;
(b) the educational attainment, including the accredited programme and, where appropriate, the field of study;
(c) the practice carried out and its length;
(d) groups of chemicals or preparations with which the candidate is or will be treated;
(e) date and signature.
(2) The application shall be accompanied by:
(a) proof of completed education;
(b) proof of the practice carried out and its duration.
(3) The application for a test shall be sent by the applicant to the competent public health authority. The application can be sent either by paper or by electronic means.
§ 4
Test
(1) The oral test is carried out.
(2) The knowledge required to pass the test is given in Annex 1 to the Decree.
(3) After successful completion of the test, applicants shall be issued a certificate of competence for the management of hazardous chemicals and chemical products classified as highly toxic (1). If the candidate has failed the test, the test may be repeated at least six weeks later. On the basis of one application, the test may be repeated only twice.
§ 5
(1) A test report shall be drawn up by the chairman of the examination panel, indicating:
(a) the names and surnames of the members of the examination committee;
(b) the date and place of the test and the time of their commencement and termination;
(c) the list of candidates for the examination and, for each tenderer, the name, name, surname and, where applicable, title, residence and date and place of birth and the list of the test questions referred;
(d) the evaluation of the results of the tests has failed in words of success;
(e) the date of completion of the Protocol.
(2) The test report shall be signed by all members of the examination committee.
(3) The test report, together with copies of test certificates issued, shall be kept at the place of the competent public health authority for a period of six years.
§ 6
Certificate of test composition
(1) The requirements of the certificate of proficiency test for the management of hazardous chemicals and chemical products classified as highly toxic (1) are laid down in Annex 2 to the Decree.
(2) The certificate shall be valid for 5 years from the date of issue. The validity of the certificate shall not be extended. An application for a new test may be submitted in accordance with § 3 before its expiry.
(3) The certificate shall not be required for a person who is established in another Member State of the European Union and intends to carry out the activity referred to in Section 44a (1) of the Act on a temporary basis if he proves that:
(a) is a national of a Member State of the European Union;
(b) hold an authorisation to carry out the activity referred to in paragraph 1 under the legislation of another Member State of the European Union where such authorisation is required in that State.
§ 7
Efficacy
This Decree shall take effect on 1 August 2004.

Knowledge required to pass a proficiency test for the management of hazardous chemicals and chemical products classified as highly toxic
1. Legislation (Act No. 356 / 2003 Coll., § 44a and 44b of Act No. 258 / 2000 Coll., as amended)
2. routes of entry into the human organism of substances and preparations classified as highly toxic (hereinafter referred to as "substances") in general and focusing on substances with which the candidate treats or will dispose,
3. the action of substances on human health (acute poisoning, chronic poisoning) with a focus on substances with which the candidate treats or will dispose,
4. principles of safety and hygiene in the management of substances in general and with a focus on substances with which the candidate is handling or will handle;
5. the principles of first pre-medical assistance for the intervention of substances in general and with a focus on substances with which the candidate is or will be handling;
6. the disposal of substances and the principles of environmental protection, with a focus on substances with which the candidate treats or will dispose.
