GOVERNMENT REGULATION
of 6 December 2017
amending Government Regulation No 112 / 2008 Coll., laying down certain conditions for granting national additional payments to direct aid, as amended
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Government Decree No. 112 / 2008 Coll., establishing certain conditions for the granting of national additional payments to direct aid, as amended by Government Decree No. 480 / 2009 Coll., Government Decree No. 86 / 2010 Coll., Government Decree No. 107 / 2012 Coll., Government Decree No. 332 / 2012 Coll., Government Decree No. 298 / 2013 Coll., Government Decree No. 29 / 2014 Coll., Government Decree No. 50 / 2015 Coll., Government Decree No. 185 / 2015 Coll. and Government Decree No. 61 / 2016 Coll., is amended as follows:
1. footnote 1 shall read:
"(1) Regulation (EU) No 1306 / 2013 of the European Parliament and of the Council of 17 December 2013 on the financing, management and monitoring of the common agricultural policy and repealing Council Regulations (EEC) No 352 / 78, (EC) No 165 / 94, (EC) No 2799 / 98, (EC) No 814 / 2000, (EC) No 1290 / 2005 and (EC) No 485 / 2008, as amended. Regulation (EU) No 1307 / 2013 of the European Parliament and of the Council of 17 December 2013 laying down rules for direct payments to farmers under support schemes under the common agricultural policy and repealing Council Regulation (EC) No 637 / 2008 and Council Regulation (EC) No 73 / 2009, as amended. Commission Delegated Regulation (EU) No 640 / 2014 of 11 March 2014 supplementing Regulation (EU) No 1306 / 2013 of the European Parliament and of the Council with regard to the integrated administration and control system and the conditions for refusal or withdrawal of payments and administrative penalties applicable to direct payments, support for rural development and cross-compliance, as amended. ';
2. In Section 1, the words "national additional payments and 'are deleted.
3. footnote 5 shall read:
"(5) Article 36 of Regulation (EU) No 1307 / 2013 of the European Parliament and of the Council, as amended. ';
4. Sections 7 and 8, including the headings, read:
Payment for sheep or goats
(1) The applicant for payment for sheep or goats may be a natural or legal person holding ovine or caprine animals from at least 15 June to 15 August of the relevant calendar year on a holding registered in the central register.
(2) The conversion factors for determining the number of livestock units to be paid for sheep or goats are set out in Part B of the Annex to this Regulation.
(3) The Fund will provide the applicant with a payment for the total number of livestock units determined according to the number of females over one year of age kept on the holding of the applicant between 15 June and 15 August of the relevant calendar year on the basis of data in the central register, with a minimum of 2 livestock units as a condition for payment.
Payment for suckler cows
(1) The applicant for the payment for suckler cows may be a natural or legal person who keeps suckler cows from at least 15 June to 15 August of the relevant calendar year on a holding registered in the central register.
(2) The conversion factors for determining the number of livestock units to be paid for suckler cows are set out in Part B of the Annex to this Regulation.
(3) The Fund provides the applicant with a payment for suckler cows for the total number of livestock units determined on the basis of the number of suckler cows kept on the holding of the applicant during the period from 15 June to 15 August of the calendar year concerned on the basis of the data in the central register, with at least 2 livestock units as a condition for the payment of suckler cows.
(4) The Fund shall not grant to the applicant a payment for suckler cows for a cow for which an application is submitted in the same calendar year for aid for cow breeding in a system with market milk production pursuant to Article 30 of Government Regulation No 50 / 2015 Coll., as amended. '

5. In Article 9 (1), the words "Section 3 of Government Regulation No 47 / 2007 Coll., on the establishment of certain conditions for granting the single area payment for agricultural land and certain conditions for providing information on the processing of agricultural products from land put up for rest 'are replaced by the words" Section 6 of Government Regulation No 50 / 2015 Coll., as amended'.
6. In Article 9 (2), the words "Section 4 of Government Regulation No 47 / 2007 Coll., on the establishment of certain conditions for granting the single area payment for agricultural land and certain conditions for providing information on the processing of agricultural products from land put up for rest 'are replaced by the words" Section 7 of Government Regulation No 50 / 2015 Coll., as amended'.
7. footnote 13 reads:
"(13) Article 37 of Regulation (EU) No 1307 / 2013 of the European Parliament and of the Council, as amended. ';
8. Paragraph 12 (1) reads as follows:
"(1) If the applicant delivers an application for payment in accordance with Article 2 after a specified time limit but no later than 25 calendar days after the expiry of that time limit, the Fund shall grant him a payment less 1% of the total amount of the payment concerned for each working day of delay in submitting the application; where the applicant receives the payment application only after the expiry of this extended period, the Fund shall not make payment to the applicant. ';
9. In Article 12 (2), the word "soils 14) 'is replaced by" soils under Government Decree No. 50 / 2015 Coll., as amended'.
footnote 14 is deleted.
10. in Paragraph 12 (3) and (4), "1 to 31 July" is replaced by "15 June to 15 August";
11. footnote 15:
"(15) Article 4 of Commission Delegated Regulation (EU) No 640 / 2014. ';
12. in Article 13 (1), the words "Commission Regulation (EC) No 1122 / 2009 of 30 November 2009 laying down detailed rules for the application of Council Regulation (EC) No 73 / 2009 as regards cross-compliance, modulation and integrated and control system under the direct support schemes for farmers referred to in the Regulation and Council Regulation (EC) No 1234 / 2007 as regards cross-compliance under the direct support scheme for the wine sector and under this Regulation" shall be replaced by the words "Regulation (EU) No 1307 / 2013 of the European Parliament and of the Council, as amended, and Commission Delegated Regulation (EU) No 640 / 2014 as amended."
13. in Article 13 (3), the words "undertaking or lease 17)" are replaced by the words "business plant or pacht of commercial race.17) ';
14. footnote 17 reads as follows:
"17) § 2175 to 2183 and § 2349 to 2357 of the Civil Code. '
Transitional provision
Applications initiated under Government Regulation No. 112 / 2008 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No. 112 / 2008 Coll., as effective before the date of entry into force of this Regulation.
Efficacy
This Regulation shall enter into force on 1 January 2018.
