DECLARATION
of 11 October 2005
amending Decree No. 208 / 2004 Coll., on minimum standards for the protection of livestock
According to Section 29 (1) of Act No. 246 / 1992 Coll., for the protection of animals against abuse, as amended by Act No. 77 / 2004 Coll., for the implementation of Sections 10, 12a and 12c (3) of the Act:
Decree No. 208 / 2004 Coll., on minimum standards for the protection of livestock, is amended as follows:
1. in Paragraph 3 (8) (c), "28" is replaced by "21."
2. Paragraph 3 (12) is deleted.
Paragraphs 13 to 15 shall become paragraphs 12 to 14.
3. In Paragraph 3 (12) of the Introductory Part of the provision, the words "not applicable to holdings where less than 6 pigs are kept or 5 sows with piglets' are deleted.
4. in Article 3 (12) (e):
"(e) in the week prior to the expected birth, sows and sows shall receive a suitable litter in sufficient quantities, provided that the system allows for the removal of solid and liquid feces used in the establishment,"
5. In Article 3 (12) (f), the words "the system must allow the delivery with or without assistance; the birthing cages in which sows move freely must be equipped with barriers to the protection of piglets and must be so designed as not to cause injury to pigs; where cage barriers are used, the minimum dimensions of the area for sows shall be 2,1 m and a width of 0,7 m, and at least 0,3 m of free space shall be replaced by"; birthing cages in which sows move freely shall be equipped with piglets protection barriers'.
6. In Article 3, at the end of paragraph 12, the dot is replaced by a comma and the following points (g) and (h) are added:
"(g) the binding housing of sows or gilts, or the tether harness, may not be used;
(h) sows and sows must have permanent access to material that allows them to be ethological. "
7. Paragraph 3 (13) reads as follows:
"(13) The provisions of paragraph 9 (c) and (d) of the sentence after the second semicolon and paragraphs 12 (a) to (c) and (h) shall apply to newly built, reconstructed or first put into service of the said building for pigs and shall apply from 1 January 2013 to all structures for pigs. ';
Efficacy
1. This Decree shall take effect on 1 November 2005.
2. Point 6 of Article 3 (12) (g) shall apply from 1 January 2006.
