DECLARATION
of 12 November 2012
amending Decree No 433 / 2009 Coll., on the method of submission, form and particulars of the statements of the insurance and reinsurance undertaking, as amended by Decree No 359 / 2010 Coll.
The Czech National Bank provides, pursuant to § 136 (1) (r) of Act No. 277 / 2009 Coll., on Insurance, and under § 110 (1) of Act No. 426 / 2011 Coll., on Pension Savings, for implementation of § 24 (1) of this Act:
Decree No. 433 / 2009 Coll., on the method of submission, form and particulars of the statements of the insurance and reinsurance undertaking, as amended by Decree No. 359 / 2010 Coll., is amended as follows:
1. In Article 1, at the end of point (h), the dot is replaced by a comma and the following point (i) is added:
"(i) the scope, form and time limits for the submission of statements on the operation of pension insurance pursuant to Article 24 (1) of Act No. 426 / 2011 Coll., on Pension Savings. '.
2. In Paragraph 3 (1) (c), the word 'applies' is replaced by 'applies'.
3. In Article 3, at the end of paragraph 1, the dot is replaced by a comma and the following point (e) is added:
"(e) annually and submit within 45 calendar days of the end of the reference calendar year to which it relates the POJ (CNB) report 30-01" Selected indicators for the life insurance sector relating to the length of life. "'
4. In Article 5, at the end of paragraph 1, the dot is replaced by a comma and the following point (e) is added:
"(e) annually and submit within 45 calendar days of the end of the reference calendar year to which it relates the POJ (CNB) report 30-01" Selected indicators for the life insurance sector relating to the length of life. "'
5. In Article 7, at the end of point (b), the dot is replaced by a comma and the following point (c) is added:

6. in Annex 1, the following statement is inserted after the POJ (CNB) statement 15 - 04 Additional information on the financial statements of the insurance / reinsurance undertaking:

The POJ (CNB) statement 30-01 "Selected indicators for the life insurance sector related to the length of life 'contains data concerning the number of contracts and selected financial indicators of life insurance according to Part A, point IX of Annex 1 to Act No. 277 / 2009 Coll., on Insurance, broken down by type of pension. The different types of pensions are listed in Section 18 (1) of the Pension Savings Act.

Selected indicators of the life insurance sector relating to the duration of human life
Content:
The data area shall include the number of contracts, the number of contracts newly concluded, the gross premiums written, the gross reinsurance premiums written, the gross amount of the insurance premiums costs, the share of the reinsurance undertaking's insurance premiums and the cost of insurance contracts. Other items are gross technical provisions, net technical provisions, technical provisions income from the placement of technical provisions and unused part of the premiums due to the more favourable course of pension insurance. All data are monitored according to the types of pensions referred to in Section 18 (1) of the Pension Savings Act. '
7. in Annex No 1, POJ (CNB) Report 46 - 04 Report of the insurance / reinsurance undertaking on investment composition, Part 1 Investment 1, Data area: DOP46 _ 41 Debt securities, Content, the words "relationship to the valuation of the security" are replaced by the words "accounting classification of portfolios of financial assets, subordination or investment security," and the words "without investment life insurance" are inserted after the words "of which the book value of the assets used to cover life insurance provisions relating to the length of life."
8. in Annex No 1, POJ report (CNB) 46 - 04 Statement of the insurance / reinsurance undertaking on the investment composition, Part 1 Investment 1, Data area: DOP46 _ 42 Property securities, Content, after the words "belonging to the group," the words "subordination or pledge of investments," and the words "without investment life insurance," shall be inserted after the words "of which the book value of the assets used to cover life insurance provisions relating to the length of life";
9. In Annex No 1, POJ report (CNB) 46 - 04 Report of the Insurance / Reinsurance undertaking on the investment composition, Part 1 Investment 1, Data area: DOP46 _ 43 Loans, loans and other claims, Content, the words "subordination or investment security," and the words "without investment life insurance," shall be inserted after the words "the carrying amount of the debt used to cover life insurance provisions relating to the length of life."
10. in Annex No 1, POJ report (CNB) 46 - 04 Statement of the insurance / reinsurance undertaking on the investment composition, Part 1 Investment 1, Data area: DOP46 _ 44 Other claims, Content, after the words "without investment life insurance" the words "and of which the carrying amount of the claim used to cover life insurance provisions relating to the length of life" shall be inserted;
11. In Annex No 1, POJ (CNB) Statement 46 - 04 Statement of the Insurance / Reinsurance Company on the investment composition, Part 1 Investment 1, Data area: DOP46 _ 45 Notes, Contents, the words "and of which the book value of the notes used to cover life insurance provisions relating to the length of life" shall be inserted after the words "without investment life insurance."
12. In Annex No 1, POJ report (CNB) 46 - 04 Statement of the insurance / reinsurance undertaking on the investment composition, Part 1 Investment 1, Data area: DOPO46 _ 46 Real estate, Content, the words "and of which the book value of the property used to cover life insurance provisions relating to the length of life" shall be inserted after the words "without investment life insurance."
13. In Annex No 1, POJ (CNB) Statement 46 - 04 Statement of the Insurance / Reinsurance Company of the investment composition, Part 1 Investment 1, Data area: DOPO46 _ 47 Real estate, summary, Contents, the words "and of which the book value of the property used to cover life insurance provisions relating to the length of life" shall be inserted after the words "without investment life insurance."
14. In Annex No 1, POJ report (CNB) 46 - 04 Statement of the Insurance / Reinsurance undertaking on the investment composition, Part 1 Investment 1, Data area: DOPO46 _ 48 Deposits and deposits confirmed by the deposit certificate, sheet, Contents, after the words "currency in which the deposit is made," the words "subordination or pledge of investments," and the words "non-investment life insurance" are inserted, and the book value of the deposit used to cover life insurance provisions relating to life expectancy, "shall be inserted after the words" subordination or pledge. "
15. In Annex No 1, POJ (CNB) Report 46 - 04 Statement of the Insurance and Reinsurance Company on the investment composition, Part 1 Investment 1, Data area: DOPO46 _ 49 Items and works of artistic cultural value, Content, the words "of which the book value of the assets used to cover life insurance provisions relating to the length of life" shall be inserted after the words "without investment life insurance."
16. in Annex No 1, POJ report (CNB) 46 - 04 Statement of the insurance / reinsurance undertaking on investment composition, Part 1 Investment 1, Data area: DOP46 _ 50 Claims on reinsurance undertakings, Content, the words "and of which the carrying amount of the claim used to cover life insurance provisions relating to the length of life" shall be inserted after the words "without investment life insurance."
17. In Annex No 1, POJ (CNB) Report 46 - 04 Report of the Insurance / Reinsurance Company on the investment composition, Part 1 Investment 1, Data area: DOP46 _ 51 Derivatives, Content, the words "and of which the accounting (real) value of the hedging derivative used to cover life insurance provisions relating to the length of life" shall be inserted after the words "without investment life insurance."
This Decree shall take effect on 1 January 2013.
