THE LAW
of 18 September 2002
amending Act No. 569 / 1991 Coll., on the Land Fund of the Czech Republic, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 569 / 1991 Coll., on the Land Fund of the Czech Republic, as amended by Act No. 546 / 1992 Coll., Act No. 161 / 1997 Coll., Act No. 269 / 1998 Coll., Act No. 95 / 1999 Coll., Act No. 144 / 1999 Coll., Act No. 148 / 2002 Coll. and Act No. 260 / 2002 Coll., is amended as follows:
1. In Article 2, paragraphs 11 and 12 are added:
"(11) The Land Fund may transfer part of its revenue to the State budget in the event of a natural or other disaster.
(12) The Land Fund is entitled to the person affected by the floods in 2002, with whom it entered into a contract prior to 1 August 2002 under Act No. 92 / 1991 Coll., on the Conditions for the Transfer of State Assets to Other Persons, as amended, or under Act No. 95 / 1999 Coll., on the Conditions for the Transfer of Agricultural and Forestry Property from State Property to Other Persons and amending Act No. 569 / 1991 Coll., on the Land Fund of the Czech Republic, as amended, and Act No. 357 / 1992 Coll., on the Inheritable Tax, Donation Tax and Real Estate Transfer Tax, as amended, as amended, as amended by Act No. 253 / 2001 Coll.
(a) repayment of the purchase price resulting from the repayment scheme;
(b) rental rent for real estate leased by the Land Fund;
relating to the period 1 August 2002 to 31 July 2003. '
2. In Article 6 (1), the dot at the end of point (h) is replaced by a comma and the following point (i) is added:
"(i) authorise, under the budget of the Land Fund, the transfer of part of the income of the Land Fund pursuant to Article 2 (11)."
3. in Article 15 (6) (a):
"(a) to mitigate the effects of floods in 1997, 1998 and 2002,"
4. In Article 15, paragraphs 8 and 9 are added:
"(8) The appropriations generated from the revenue of the Land Fund for the purposes referred to in paragraph 6 (a) shall be increased by the total revenue of the State Budget and the budget chapter of the Ministry of Agriculture and shall exceed the total expenditure of the State Budget for the relevant financial year in which the appropriations thus obtained are used. This overrun shall be amended in the relevant financial year by the balance of the State budget and by the appropriations.
(9) Unspent funds for the purposes referred to in paragraph 6 (a) shall be transferred at the end of the year to state financial assets and may be used for the same purposes in subsequent years. "
This Act shall take effect on the day of its publication.
