DECLARATION
of 28 November 2008
laying down the formalities and content of the conservation plan for conservation of conservation and conservation zones
According to Article 45 (1) of Act No. 20 / 1987 Coll., on State Monument Care, as amended by Act No. 320 / 2002 Coll., Act No. 186 / 2006 Coll. and Act No. 307 / 2008 Coll., ("the Act '):
(1) The protection plan shall contain a text and graphic section.
(2) The text section of the protection plan contains:
(a) a list of buildings which are a cultural monument or a national cultural monument, an identification of urban and landscape values and real estate which are architecturally or urbanistically valuable construction or a set of buildings, historically important construction, a site or a set of buildings, a significant dominant character, a feature of the historical cultural landscape and are located in a conservation or conservation zone;
(b) identification of properties which are not a cultural monument but are located in a conservation or conservation zone, or identification of the types of works on which an obligation under Paragraph 14 (2) of the Act is excluded;
(c) the determination of the method of securing cultural values of the conservation or conservation zone from the point of view of national conservation;
(d) the justification for the protection plan.
(3) The graphic part of the protection plan contains:
(a) drawing No 1 showing the real cultural monuments, real national cultural monuments, urban and landscape values, architecturally or urbanistically valuable buildings or sets of buildings, historically significant buildings, sites or sets of buildings, significant dominance and features of the historical cultural landscape located in a conservation or conservation zone;
(b) Drawing No 2 with a designation of immovable property which is not a cultural monument but which is located in a conservation or conservation zone for which an obligation under Article 14 (2) of the Act is excluded in whole or in part, indicating the extent of the exemption from that obligation,
(c) Drawing No 3, in which the method of securing the cultural values of the conservation or conservation zone is indicated in terms of national conservation.
(4) The drawings referred to in paragraph 3 shall normally be drawn on a scale of 1: 1 000, 1: 2 000 or 1: 5 000.
(5) The protection plan shall always indicate whether it covers the territory of the whole or part of the conservation area; the border of the area covered by the conservation or conservation zone consists of a line along the parcel border; in exceptional cases it is formed by a link between the quarry points of the existing borders or points at those borders. This limit shall be indicated in the text part of the protection plan and shall be indicated in the graphic part of the protection plan.
(6) The justification for the protection plan includes:
(a) a general description of the cultural values of the conservation or conservation zones;
(b) a detailed description of the cultural values of the conservation or conservation zone according to the comprehensive sets of buildings or individual buildings, areas and public spaces;
(c) the reasons for excluding the obligation under Paragraph 14 (2) of the Act.
(7) The reserve or conservation zone referred to in paragraphs 2, 3 and 6 shall mean parts thereof, provided that the protection plan is issued only for those parts.
(8) The protection plan shall be drawn up in an electronic version in a machine-readable format that allows for display in geographical information systems.
This Decree shall take effect on 1 January 2009.
