GOVERNMENT REGULATION
of 30 January 2017
amending Government Regulation No 153 / 2005 Coll., laying down the way and the amount of the funds generated by the radiocommunication account and the way in which they are drawn up
The Government orders pursuant to Section 150 (1) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 261 / 2007 Coll., Act No. 304 / 2007 Coll., Act No. 468 / 2011 Coll., to implement Section 27 (8) of the Act on Electronic Communications, as amended by Act No. 468 / 2011 Coll.:
Government Decree No. 153 / 2005 Coll., on determining the method and amount of the creation of the funds of the radiocommunications account and the way in which they are drawn up, is amended as follows:
1. In Section 1, "6% 'is replaced by" 30%';
2. In Section 1, "30% 'is replaced by" 6%';
3. In Article 2, the text "§ 27 (1) 'is replaced by the text" § 27 (1) and (6)' and the text "§ 27 (3) 'is replaced by the text" § 27 (5)'.
Transitional provision
The funds of the radio-communications account which have been transferred to the radio-communications account by 31 December 2020 in excess of the funds transferred to the radio-communications account pursuant to Government Regulation No 153 / 2005 Coll., as effective by the date of entry into force of this Regulation and have not been used to cover the costs of the digital terrestrial television switchover process from DVB-T to DVB-T2 shall be transferred by the Czech Telecommunications Authority to the State budget pursuant to Article 133 of Act No 127 / 2005 Coll., as effective on the date of entry into force of this Regulation.
Efficacy
This Regulation shall enter into force on the 15th day following its publication, with the exception of Article I (2), which shall take effect on 1 January 2021.
