GOVERNMENT REGULATION
of 2 February 2011
amending Government Regulation No 597 / 2006 Coll., on the monitoring and evaluation of air quality
The Government mandates pursuant to Article 55 (1) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Air Protection Act), as amended by Act No. 92 / 2004 Coll., Act No. 180 / 2005 Coll., Act No. 385 / 2005 Coll. and Act No. 180 / 2007 Coll., ("the Act ') to implement Article 6 (9) of the Act:
Čl. I
Government Decree No. 597 / 2006 Coll., on monitoring and evaluation of air quality, is amended as follows:
1. In Article 1, the words "European Communities' are replaced by the words" European Union '.
2. In Article 2 (5), the words "or established legal person" shall be inserted after the word "Ministry."
3. In Article 3, at the end of paragraph 2, the dot is replaced by a comma and the following point (g) is added:
"(g) particles which pass through a size-selective input filter showing a 50% separation efficiency of 2,5 µm aerodynamic mean (PM2,5)."
4. in Article 3 (3) (d):
"(d) benzo (a) pyrene,"
5. In Article 3, the following paragraphs 6 and 7 are inserted after paragraph 5:
"(6) The target limit on the urban background is set for PM2,5.
(7) The decrease in the rolling average annual concentration of PM2,5 is set out in Part E of Annex 1 to this Regulation. "
Paragraph 6 shall become paragraph 8.
6. In Annex 1, Part A, Table 1, the following row is inserted:

7. In Annex No 1, Part A, Table 3 is deleted.
8. In Annex No 1, Table 4 is added at the end of Part C:

The values shall be collected from the sampling points established under point 1.6 of Part A of Annex 5 to this Regulation. ';
9. In Annex 1, Part D, point 1 is deleted.
Points 2 to 4 shall be renumbered 1 to 3.
10. In Annex 1, Part E is added:

The values shall be collected from the sampling points established under point 1.6 of Part A of Annex 5 to this Regulation. ';
11. in Annex 3 (1) (c):

Notes:
(1) At least one site shall be established for nitrogen dioxide, benzene, carbon monoxide and PM10 or PM2,5 to measure the background level of air pollution and one site shall be designed to measure the impact of transport, unless this increases the number of sampling points;
2) The total number of sampling points for PM2,5 shall not be less than half the number of sampling points for PM10. The aim is to double the number of sampling points for stationary measurement compared to the minimum number when it comes to a highly geographically degraded and unevenly populated zone or agglomeration with high industry density, where there is a long-term exceeding of the values of the imitation limits. '
13. In Annex No 5, Part A, point 1, the following points 1.6 and 1.7 are added:
"1.6. For conurbations and other urban areas with a population greater than 100 000, one sampling site per million inhabitants shall be operated. These sampling points may be identical to those referred to in subpoint 1.1.
1.7. Notwithstanding the concentrations, at least one sampling point shall be established at the rural background site to measure the annual average data on the total mass concentration and on the chemical components PM2,5. The chemical components PM2,5 shall measure at least the concentrations of total organic carbon, elemental carbon, magnesium, calcium, sodium, potassium and ammonium cation and sulphate, chloride and nitrate anions. ';
14. In Annex 6, point 1, the text under the heading reads: "For gaseous pollutants, the volume shall be converted into standard conditions. For PM10, PM2,5 and pollutants analysed in PM10, the volume of sampling refers to external conditions, namely temperature and atmospheric pressure on the day of measurement. '
Čl. II
Transitional provisions
1. No later than 31 December 2014, the limit of imitation for PM2,5 set out in Table 1 of Part A of Annex 1 to Government Regulation No 597 / 2006 Coll., as effective from the date of entry into force of this Regulation, shall be reached. Until then, the limit of this imitation is the target limit.
2. Achieving the target limit for the urban background sites pursuant to § 3 (6) of Decree No. 597 / 2006 Coll., as effective from the date of entry into force of this Regulation, is evaluated on 31 December 2015.
3. The achievement of the decline in the rolling average annual concentration of PM2,5 pursuant to Article 3 (7) of Decree No 597 / 2006 Coll., as effective from the date of entry into force of this Regulation, is evaluated on 31 December 2020.

Efficacy
This Regulation shall take effect on the 15th day following its publication.
