DECLARATION

amending Decree No. 196 / 2001 of the Ministry of Justice Coll., on the remuneration and compensation of notaries and heirs
The Ministry of Justice provides, pursuant to § 35b (9) and § 107 of Act No. 358 / 1992 Coll., on notaries and their activities (notarial order), as amended by Act No. 317 / 2001 Coll.:
Decree No. 196 / 2001 Coll., on the remuneration and compensation of notaries and heirs, is amended as follows:
1. the following Part Seven is inserted after Part Six:
REFUNDS ON LEADER, OPERATING AND GOVERNMENT MANAGEMENT
(1) The notarial chamber of the Czech Republic (hereinafter referred to as the Chamber) is responsible for the reimbursement of the final expenses associated with the operation, management and administration of the register of collateral in the following lump sums:
| a) náhrada hotových výdajů v souvislosti se zápisem zástavního práva do Rejstříku zástav | 700 Kč, |
| b) náhrada hotových výdajů v souvislosti s výmazem zástavního práva z Rejstříku zástav | 700 Kč, |
| c) náhrada hotových výdajů v souvislosti se změnou v evidovaných údajích v Rejstříku zástav | 500 Kč, |
| d) náhrada hotových výdajů v souvislosti s vydáním opisu nebo výpisu z Rejstříku zástav nebo s vydáním potvrzení | 200 Kč. |
(2) Repayment of final expenses shall be paid by a notary who:
(a) record the lien or change of data in the register of liens;
(b) delete the lien from the register of liens; or
(c) issue a copy, extract or certificate. ';
Part seven shall be renumbered part eight.
2. The following Section 26a is inserted after Section 26:
For reimbursement of the final expenses incurred by the Chamber for the years 2002 and 2003 in connection with the recording of the lien in the Register of Deposits on the basis of a decision of the court or administrative office which has been sent by the Chamber by the Court or the Administration, or in connection with the change of the data in the Register of Deposits, the Ministry of Finance of the Chamber shall pay CZK 1 500 000. "
3. In the Annex, the current text of item A becomes point 1.
4. In the first sentence of point A (1), the words "or notarial entry authorised for enforcement 'are deleted.
5. The fourth sentence of item A (1) is as follows:
"Three quarters of the amount calculated in accordance with the first sentence and, where applicable, the amount laid down in the second sentence, and of the notarial entry on the pledge contract or notarial entry with the permission to enforce two thirds of the amount calculated in accordance with the first sentence and, where applicable, the amount laid down in the second sentence, shall always be at least CZK 800."
6. the following point 2 is inserted after entry A (1):
'2. For writing a notarial record of a lien contract, if the lien is established by registration in the register of liens, including the issue of one copy of the notarial record,

An amount of over 40 000 000 CZK is not included in the basic tariff value. "
7. The following entries M to P are added at the end of the Annex:
"Heading M
| Za zápis do Rejstříku zástav | 200 Kč. |
Item N
For the sum of the operations needed to delete from the register of collateral,
| a) provádí-li výmaz notář, který zástavní smlouvu sepsal | 500 Kč, |
| b) provádí-li výmaz jiný notář | 800 Kč. |
Item O
| Za úhrn úkonů potřebných k provedení změny údajů v Rejstříku zástav | 200 Kč. |
Item P
| Za vydání opisu nebo výpisu z Rejstříku zástav nebo potvrzení | 150 Kč“. |
Efficacy
This decree shall take effect on the day of its publication.
