DECLARATION
Ministry of Finance
of 24 February 2000
amending Decree No. 227 / 1998 of the Ministry of Finance Coll., which provides for a more detailed definition of the heading and amount of the income and expenditure of the public health insurance funds of health insurance companies, the conditions for their creation, use, admissibility of transfers of funds and their management, the limit of the cost of the activities of health insurance undertakings covered by the resources of the basic fund, including the procedure for calculating that limit, as amended by Decree No 235 / 1999 Coll.
The Ministry of Finance, after consulting the Ministry of Health, provides for Act No. 551 / 1991 Coll., on the General Health Insurance Company of the Czech Republic, as amended by Act No. 127 / 1998 Coll., and pursuant to Section 16 (6) of the Act No. 280 / 1992 Coll., on departmental, branch, corporate and other health insurance companies, as amended by Act No. 225 / 1999 Coll.:
Decree No 227 / 1998 Coll., establishing a more detailed definition of the heading and amount of the income and expenditure of public health insurance funds of health insurance companies, the conditions for their creation, use, admissibility of transfers of funds and their management, the limit of the cost of the activities of health insurance companies covered by the resources of the basic fund, including the calculation procedure for this limit, as amended by Decree No 235 / 1999 Coll., is amended as follows:
1. in Paragraph 1 (1), point (g) shall be deleted;
Point (h) shall be renumbered as point (g).
2. In Article 1 (4), the words "in the case of reimbursement of health care, collection of insurance premiums, fines, periodic penalty payments and premiums," shall be added at the end of point (e).
3. in Article 1 (4), point (h) is deleted;
Point (i) shall be renumbered as point (h).
4. In Article 1 (4), at the end of point (h), the dot is replaced by a comma and the following point (i) is added, including footnote 13a:
"(i) exceptional allocation to the operational fund to cover increased expenditure 13a) Military health insurance companies of the Czech Republic.
13a) For example, Act No. 148 / 1998 Coll., on the Protection of classified information and on the amendment of certain laws, as amended by Act No. 164 / 1999 Coll. '.
5. In Paragraph 3 (1), the dot at the end of point (e) is replaced by a comma and the following point (f) is added:
"(f) proceeds from the sale of capital goods."
6. In Paragraph 3 (2), the dot at the end of point (h) is replaced by a comma and the following point (i) is added:
"(i) transfer to the capital reproductions fund equal to the positive difference between the selling and the balance price of the capital goods sold."
7. Paragraph 3 (4) reads as follows:
"(4) In accordance with Article 7 (3), funds shall be transferred from the operational fund's bank account to the reproduction fund's bank account at the amount of the amortised depreciation of all assets, including the financial value of the outstanding price of the disposal assets and the positive difference between the selling and the outstanding price of the assets sold. ';
8. In Article 3, the following sentence is added at the end of paragraph 6, including footnote 22a: "The Military Health Insurance Agency of the Czech Republic is also engaged in the payment of operating expenses related to the creation and management of the preventive care fund and the provision of medical care. 22a)
22a) Decree No. 41 / 2000 Coll., laying down detailed conditions for the creation and use of funds by the Military Health Insurance Agency of the Czech Republic for the payment of medical care paid in excess of the public health insurance from the State Budget of the Ministry of Defence. "
9. in Article 5 (2) (a), "allocation to the reproduction fund" shall be replaced by "reduction of the fund."
10. in Article 5 (2) (d), the words "the allocation to the capital reproductions fund" shall be replaced by "the value."
11. in Article 6 (2) (c):
"(c) the transfer from the operational fund referred to in Article 3 (2) (i), equal to the positive difference between the selling and the balance price of the capital goods sold,";
12. Paragraph 6 (2) shall be replaced by a dot at the end of (e) comma and the following sentence shall be added: "The Military Health Insurance Agency of the Czech Republic shall proceed similarly to the calculation of the State Budget subsidy by means of the Ministry of Defence chapter to cover the share of investment expenditure related to the creation and management of the preventive care fund and the provision of medical care,"
13. in Article 7 (3) (b), the words "including the residual value of the disposal capital" shall be inserted after the words "accounting depreciation."
14. in Article 7, the following paragraph 5 is added:
"(5) The annual limit on the cost of the operation of the Military Health Insurance Corporation of the Czech Republic, determined in accordance with paragraph 1, does not include expenditure paid by means of an exceptional allocation from the basic fund to the operational fund pursuant to Paragraph 1 (4) (i). In the context of the evaluation of the annual report of the Military Health Insurance Corporation of the Czech Republic, this expenditure shall be calculated separately and the authorised amount shall be proposed by the Ministry of Health in agreement with the Ministry of Finance for approval by the Government. 28)

Transitional provision
The procedure laid down in Article I (8) and (12) of this Decree applies to the billing of expenditure 22a) Military Health Insurance of the Czech Republic since the effective date of Act No. 225 / 1999 Coll., amending certain laws in connection with the adoption of the Law on Occupational Soldiers.
Efficacy
This decree shall take effect on the day of its publication.
