DECLARATION
Federal Ministry of the Interior
of 6 May 1974
on the demonstration of competence in the National Security Corps
The Federal Ministry of Interior provides, pursuant to Section 17 of Act No. 40 / 1974 Coll., on the National Security Corps ("the Act '):
(1) Members of the National Security Corps (hereinafter referred to as "members"), in the exercise of their powers under the law and other legislation, demonstrate their competence to the National Security Corps in the following ways:
(a) a uniform national;
(b) a service pass;
(c) a badge of criminal service;
(d) oral declaration (1)
(2) The demonstration of competence referred to in paragraph 1 shall be governed by the exercise by members of their powers in uniform or in civil clothes, in the character of specific service tasks, interventions or other service activities (hereinafter referred to as "the duty ').
Members exercising their powers in a uniform manner shall demonstrate their competence to the National Security Corps in a uniform manner and, where appropriate, by an oral declaration; a service pass only:
(a) upon entry into undertakings, establishments, offices, institutes, etc., where the entry is controlled by a member of the racing guard or by another authorised person;
(b) in the case of a service operation at the request of a citizen.
Members exercising their competence in civil clothing shall demonstrate their competence with the National Security Corps before the commencement of the service by oral declaration and by a service card or badge of criminal service.
The soldiers of the army of the Ministry of Interior, the Czechoslovak People's Army, the members of the People's militia, the Department of Correctional Education and the public fire services, who are called pursuant to Sections 51 (1) and (2) and 52 (1) of the Act to carry out the tasks of the National Security Corps, demonstrate the following:
(a) by his prescribed uniform with the external designation "SNB" 2) and, where appropriate, by oral declaration; in the cases referred to in points (a) and (b) of Paragraph 2, they shall always be required to demonstrate with a licence to carry out the tasks of the National Security Corps;
(b) an oral declaration and a document certifying the authorisation to carry out the tasks of the National Security Corps where they exercise competence in civil clothing.
Members in the exercise of their powers and persons referred to in Article 4 who are entitled to carry out the tasks of the National Security Corps shall not, in any event, issue the documents referred to in Articles 1 (b) and (c) and 4 (b), but shall, upon request, give them only for inspection and, where appropriate, communicate their number. They do not give their name, rank and function.
(1) The members and persons referred to in Article 4, in exercising their competence in an uniform manner, shall not be required, except in the case of an oral declaration, to demonstrate their competence with the National Security Corps or to carry out its tasks, even if requested:
(a) if they act under a uniform command in emergency situations and in other mass actions threatening public policy;
(b) for surveillance of objects and other similar services;
(c) persons affected by the operation, in particular:
- the drunk and committing a disturbance or other inappropriate behaviour,
- caught committing intentional criminal acts,
- an armed firearm or stabbing weapon, a mass-efficiency weapon or other subject capable of seriously endangering human life or health,
- to dangerous offenders,
- refugees from the execution of a sentence or detention,
- which, at the order of the prosecutor or court, are to be detained and delivered to custody or at the order of the court, until the execution of the sentence,
- on which a nationwide search is declared,
- presented, subpoenaed or made available for notification or enquiry to the National Security Corps's service room.
(2) The members or persons referred to in Article 4, where they exercise their competence in civil clothing in the cases referred to in the preceding paragraph, shall be required to demonstrate their competence with the National Security Corps or the authority to carry out its tasks by oral declaration; otherwise, i.e. by a service pass, a badge of a criminal service or an authorisation to perform the tasks of the National Security Corps, they shall demonstrate jurisdiction only if circumstances permit.
This Decree shall take effect on 1 July 1974.
