DECLARATION
of 18 November 2021
amending Decree of the Ministry of Transport and Communications No. 32 / 2001 Coll., on the registration of road accidents
The Ministry of Transport provides pursuant to Section 137 (2) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws (Road Traffic Act), as amended by Act No. 478 / 2001 Coll., Act No. 53 / 2004 Coll., Act No. 411 / 2005 Coll., Act No. 226 / 2006 Coll., Act No. 274 / 2008 Coll., Act No. 133 / 2011 Coll., Act No. 297 / 2011 Coll., Act No. 230 / 2014 Coll., Act No. 249 / 2014 Coll., Act No. 48 / 2016 Coll., Act No. 199 / 2017 Coll., Act No. 193 / 2018 Coll., and Act No. 337 / 2020 Coll., implementing § 123 (4) of this Act:
Decree No 32 / 2001 Coll., on the registration of road accidents, is amended as follows:
1. Paragraph 1, including footnote 2, reads as follows:
This decree implements the relevant European Union2 regulations and regulates the way in which records are kept in the register of accidents and details of data kept in the register of accidents.
2) Directive 2008 / 96 / EC of the European Parliament and of the Council of 19 November 1998 on road infrastructure safety management. Directive (EU) 2019 / 1936 of the European Parliament and of the Council of 23 October 2019 amending Directive 2008 / 96 / EC on road infrastructure safety management. ';
2. in Article 2 (a), the words "(hereinafter referred to as" participant ")" shall be deleted;
3. footnote 1 shall read:
"1) § 122 (2) of Act No. 40 / 2009 Coll., penal code. '
4. In Article 2, at the end of the text in point (c), the words "; for the purposes of the provision of data under European Union3), severe injury shall be considered to be serious injury to health according to the MAIS3 + scale, ';
Footnote 3:
"(3) Council Decision of 30 November 1993 on the establishment of a Community database on road traffic accidents (93 / 704 / EC), as amended."
5. At the end of the text § 3, the words "except those which are not obliged to notify the police of the Czech Republic 'shall be added.
footnote 4:
"4) Paragraph 47 (4) and (5) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws (Road Traffic Act), as amended."
6. in Article 4 (1), the following point (a) is inserted:
"(a) his age, sex and nationality,"
Points (a) to (f) shall be renumbered (b) to (g).
7. In Article 5 (c), the word "production 'is replaced by" first registration';
8. in Article 5, the following point (e) is inserted after point (d):
"(e) details of the validity of the technical inspection;"
Points (e) to (h) shall be renumbered as points (f) to (i).
9. in Article 7 (a), the words "the coordinates of the global navigation satellite system at the scene of an accident" shall be inserted after the words "the whole."
10. In Section 8, the words "and the central register of road accidents' are deleted.
11. in Article 8, paragraph 2 is deleted and the designation of paragraph 1 is deleted;
Efficacy
This Decree shall take effect on 17 December 2021, with the exception of Article I (4), which shall take effect on 1 July 2023.
