DECLARATION
of 11 December 2013
amending Decree No. 432 / 2011 Coll., on ensuring cryptographic protection of classified information
According to Articles 44 and 53 (j) of Act No. 412 / 2005 Coll., on the protection of classified information and on security competence, as amended by Act No. 255 / 2011 Coll.:
Decree No. 432 / 2011 Coll., on ensuring cryptographic protection of classified information, is amended as follows:
1. In Section 2, the words "or combinations thereof 'shall be added at the end of the text in point (e).
2. In Section 2, at the end of the text in point (i), the words "or other necessary means and material to ensure the function and safe operation of the cryptographic device 'are added.
3. In Article 8 (1), the words "establish safety standards [Paragraph 2 (j) of the Act] and 'are deleted.
4. In Article 8 (3), the words "and spaceable 'shall be inserted after the words" mobile'.
5. In Paragraph 8 (5), "3 'is replaced by" 5'.
6. In Article 9, the following paragraph 3 is added:
"(3) The other necessary means and material to ensure the function and safe operation of the cryptographic device and the requirements for its use shall be determined by the cryptographic device certification report. ';
7. In Section 12, the word "material 'is replaced by" means and material to ensure the functioning of the cryptographic device'.
8. Paragraph 12 (4) is deleted.
9. In Article 13 (1), the words "where the cryptographic document was created, instead of" are replaced by "where the cryptographic document was created."
10. In Article 15, the words "where the cryptographic document was created 'are replaced by the words" the place where the cryptographic document was created and the date of the drawing up' and the words "registered 'are inserted after the word" in the administrative aids referred to in Article 17 (1) (a)'.
11. in Article 17 (1) (c), the words "operational documentation" shall be inserted after the words "aids."
12. In Paragraph 17, the following paragraph 3 is inserted after paragraph 2:
"(3) The administrative assistance referred to in point (a) of paragraph 1 shall, before being taken into use, indicate the name of the authority of the State, legal person or natural person undertaking or the stamp of the natural person concerned, the registration number, the date of registration and the signature of the responsible person, or his authorised person or the security director or persons authorised by him. The person responsible for managing the administrative aid may not be the same as the person responsible for signing. ';
Paragraphs 3 to 5 shall be renumbered paragraphs 4 to 6.
13. In Article 17 (4), the words "the Security Director or the person responsible for the signature" shall be replaced by the words "the responsible person or the authorised person or the Security Director or the authorised person," and at the end of the paragraph the sentence "The person responsible for the administration of the administrative assistance may not be the same as the person responsible for the signature."
14. in Article 17 (6), the words "KRYPTO" shall be replaced by the words "KRYPTOGRAPHIC PROTECTION"; "
15. in Article 20 (1), the words "in paper form" shall be inserted after the word "document," and at the end of the paragraph the sentence "For the purposes of further manipulation with the cryptographic document, it may be converted into administrative equipment for cryptographic protection intended for its registration."
16. In Paragraph 20 (2), the words "in non-paper form 'shall be inserted after the word" document' and the words "intended for its registration 'shall be added at the end of the text of the first sentence.
17. in Article 20 (4), in the introductory part of the provision, the words "in paper form" shall be inserted after the word "document."
18. In Section 22, "4 'and" 5' are replaced by "5 'and" 6'.
19. in Article 24 (3) (b), the words "or the designated handling cards" shall be replaced by "the registration cards or the designated administrative aids referred to in the second sentence of Article 17 (2)."
20. In Article 25 (1), the words "designation by the word" KRYPTO "'shall be replaced by the words" INCREASING ONLY THE WORKER OF THE CRYPTOGRAPHIC PROTECTION "';
21. in Paragraph 26 (b), the words "protection and" shall be replaced by "protection or."
22. In Article 26, at the end of point (d), the dot is replaced by a comma and the following point (e) is added:
"(e) the electronic transmission of the cryptographic document shall be carried out in an information system certified by the Office and designated for such transmission."
23. In Article 28, paragraphs 8 and 9 are added:
"(8) Where the consignor transports a cryptographic consignment to the consignee via a cryptographic material manager who is not authorised to familiarise himself with the contents of the cryptographic consignment (hereinafter referred to as" the intermediary '), the consignor:
(a) issue a cryptographic consignment for the addressee and draw up a movement note in accordance with paragraph 4, which it shall enter in the envelope containing the data of the consignor and the addressee;
(b) draw up a movement note for an intermediary which contains only the identification mark of a cryptographic consignment for an intermediary;
(c) insert the envelope with the address of the consignee and the accompanying note for the intermediary together with the cryptographic consignment into the portable box for the intermediary and transmit it for transport.
(9) When receiving cryptographic shipments, mediator
(a) open a portable box for the intermediary and check that the cryptographic consignment is not broken;
(b) draw up a accompanying note for the addressee, which shall contain only the identification mark of the cryptographic consignment for the addressee, which shall be entered in the envelope with the details of the intermediary and the addressee;
(c) insert the envelope with the address of the addressee and the accompanying note for the addressee together with the cryptographic consignment into the portable box and transmit it for transport. ';
24. In the first sentence of Article 29 (1), the words "marked with the word" KRYPTO '' shall be replaced by the words "OPENING ONLY THE WORKER OF THE KRYPTOGRAPHIC PROTECTION ''; and in the second sentence, the words" marking 'shall be replaced by the words "KRYPTO';
Transitional provision
The administrative aids designated in accordance with § 17 (5) of Decree No. 432 / 2011 Coll., as effective before the date of entry into force of this Order, shall be designated in accordance with § 17 (6) of Decree No. 432 / 2011 Coll., as effective from the date of entry into force of the Decree.
Efficacy
This Decree shall take effect on 1 January 2014.
