DECLARATION
of 18 August 2006
amending Decree No 642 / 2004 Coll., implementing the Civil ID Act and the Travel Documents Act, as amended by Decree No 299 / 2006 Coll.
The Ministry of Interior shall determine, pursuant to § 5 (1) (b) and § 26 (a) of Act No. 328 / 1999 Coll., on Civil Documents, as amended by Act No. 559 / 2004 Coll., pursuant to § 5 (6) (a) and § 20 (8) of Act No. 329 / 1999 Coll., on Travel Documents and on Amendment to Act No. 283 / 1991 Coll., on Police of the Czech Republic, as amended (Act on Travel Documents), as amended by Act No. 559 / 2004 Coll., and Act No. 136 / 2006 Coll.:
Čl. I
Decree No 642 / 2004 Coll., implementing the Civil ID Act and the Travel Documents Act, as amended by Decree No 299 / 2006 Coll., is amended as follows:
1. Paragraph 5, including the title, reads:
„§ 5
Requirements for the technical execution of the photograph for the issue of the identity card
(1) The photograph or similar image recording (hereinafter referred to as "photographs") attached to the application for the issue of a card has a smooth surface, shall conform to long-term image stability tests and shall be in black and white or colour. The photograph is rectangular with dimensions 35 mm x 45 mm, built on a shorter side, with straight or rounded corners with radius r = 3 mm + / - 0,5 mm, thickness from 0,13 mm to 0,27 mm. The picture dimensions are shown in Annex 7, Figure 1.
(2) The photograph shows the head and upper part of the arms of the person displayed in the front view so that the central vertical plane of the face is an extension of the vertical plane of the lens of the sensing system and the horizontal plane of the face formed by the eyes is an extension of the horizontal plane of the lens of the sensing system. The position of the lens of the sensing system vis-à-vis the person is shown in Annex 7, Figure 2. The view of the person displayed is directed to the lens.
(3) The photograph must correspond to the person displayed at the time of application. A view over the shoulder, twisted or tilted head are not allowed. The depicted person shall have a neutral expression and a closed mouth, the eyes shall be open and the hair shall not be covered.
(4) The distance between the upper edge of the head and the upper edge of the photograph is at least 2 mm. The height of the facial part of the head, which consists of a distance from eyes to chin, shall be at least 13 mm. The head size of the person displayed, including its location, is shown in Annex 7, Figure 3.
(5) The background behind the person displayed is white to light blue, or light grey, and the smooth transition of these colours is permitted. The photo is without glare which would hide or significantly change the characteristic identification characteristics of a person, which are in particular the shape and location of eyebrows, eyes, nose, mouth, chin and the overall shape of the face. It is not possible to retouch or otherwise modify the negative or positive image of the image or print of the citizen. '
2. In Section 6 of the heading: "Model of passport with machine-readable data and data carrier with biometric data '.
3. In Article 6 (1), the words "and with biometric data medium 'are inserted after the words" data'.
4. In Article 6 (2), "paragraph 2 'is replaced by" paragraph 3';
5. In Article 6, the following paragraph 3 is inserted after paragraph 2:
"(3) The biometric data carrier shall be located on the other side of the passport listed in Annex 8 and shall only be legible when the travel document is opened. ';
Paragraphs 3 and 4 shall be renumbered paragraphs 4 and 5.
6. In Article 6 (4), "4 'is replaced by" 3' and the words "(a) 'are inserted after the words" 7'.
7. In Article 6 (5), the words "and 7 'shall be inserted after the words" page 6'.
8. In Section 7, the heading reads: "Model of passport without machine-readable data and without biometric data carrier '.
9. In Article 7 (1), the words "and without a biometric data medium 'shall be inserted after the words" data'.
10. Paragraph 7 (2) is deleted.
Paragraph 3 shall become paragraph 2.
11. in Article 9, paragraph 3 is deleted;
Paragraph 4 shall become paragraph 3.
12. in Article 9 (3), the words "(a)" shall be deleted;
13. in Article 11 (1):
"(1) The model of the electronically processed application for the issue of a passport with machine-readable data and a biometric data carrier is set out in Annex 12. ';
14. In Article 11 (2), the words "and without a biometric data medium 'shall be inserted after the words" data'.
15. Annex 8 shall read as follows:

16. Annex 9 shall read as follows:

"Annex No 9 to Decree No 642 / 2004 Coll.

"
17. Annex 12 shall read as follows:

Čl. II
Transitional provisions
1. The forms of the application for a passport without machine-readable data issued in accordance with the model set out in Annex 13 to Decree No 642 / 2004 Coll., as effective until the date of entry into force of this Order, may be used until 31 December 2008 at the latest.
2. Passports without machine-readable data and without a data carrier with biometric data in accordance with the model set out in Annex 9 to Decree No 642 / 2004 Coll., as effective by the date of entry into force of this Order, may be issued no later than 31 December 2012.

Efficacy
This Decree shall take effect on 1 September 2006.
