DECLARATION
of 18 August 2006
amending Decree No. 368 / 1999 of the Ministry of the Interior Coll., laying down the formalities and number of photographs required under the Act on the residence of foreigners, as amended
The Ministry of Interior provides pursuant to § 182 paragraph 1 (a) of Act No. 326 / 1999 Coll., on the residence of foreigners in the Czech Republic and on the amendment of certain laws:
§ 1 of Decree No. 368 / 1999 Coll., laying down the formalities and number of photographs required under the Act on the residence of foreigners, as amended by Decree No. 363 / 2001 Coll., including the title reads:
Photos
(1) A photograph or similar image recording (hereinafter referred to as "photograph") has a smooth surface, shall conform to long-term image stability tests and shall be in black and white or colour. The photograph is rectangular with dimensions 35 mm x 45 mm, built on a shorter side, with straight or rounded corners with radius r = 3 mm + / - 0,5 mm, thickness from 0,13 mm to 0,27 mm.
(2) The photograph shows the head and upper part of the arms of the person displayed in the front view so that the central vertical plane of the face is an extension of the vertical plane of the lens of the sensing system and the horizontal plane of the face formed by the eyes is an extension of the horizontal plane of the lens of the sensing system. The view of the person displayed is directed to the lens.
(3) The photograph must correspond to the person displayed at the time of application. A view over the shoulder, twisted or tilted head are not allowed. The depicted person shall have a neutral expression and a closed mouth, the eyes shall be open and the hair shall not be covered.
(4) The distance between the upper edge of the head and the upper edge of the photograph is at least 2 mm. The height of the facial part of the head, which consists of a distance from eyes to chin, shall be at least 13 mm.
(5) The background behind the person displayed is white to light blue, or light grey, and the smooth transition of these colours is permitted. The photo is without glare which would hide or significantly change the characteristic identification characteristics of a person, which are in particular the shape and location of eyebrows, eyes, nose, mouth, chin and the overall shape of the face. It is not possible to perform retouches or other modifications of the negative or positive photo, or digital processing of the image of the displayed person and its printing. '
This Decree shall take effect on 1 September 2006.
