on the increase in pensions in 2006
The Government mandates the implementation of Act No. 155 / 1995 Coll., on Pension Insurance, as amended by Act No. 134 / 1997 Coll., Act No. 289 / 1997 Coll., Act No. 224 / 1999 Coll., Act No. 18 / 2000 Coll., Act No. 118 / 2000 Coll., Act No. 132 / 2000 Coll., Act No. 220 / 2000 Coll., Act No. 116 / 2001 Coll., Act No. 188 / 2001 Coll., Act No. 562 / 2004 Coll., Act No. 353 / 2001 Coll., Act No. 198 / 2002 Coll., Act No. 85 / 2004 Coll., Act No. 261 / 2002 Coll., Act No. 362 / 2003 Coll., Act No. 424 / 2003 Coll.
§ 1
(1) Old-age pensions, full-time invalidity, partial invalidity, widower's, widower's and orphan's pensions awarded before 1 January 1996 shall be increased from the payment of the pension due after 31 December 2005 to:
a) the basic amount of the pension is increased by CZK 70 per month,
(b) the percentage rate of the pension shall be increased by 6% on the date on which the percentage rate is increased.
(2) Old-age pensions, full invalidity pensions, partial invalidity pensions, widower's, widower's and orphan's pensions granted from 1 January 1996 to 31 December 2005, with the exception of those referred to in Article 4, are increased from the payment of the pension due after 31 December 2005 to:
a) the basic amount of the pension is increased by CZK 70 per month,
(b) the percentage area of the pension shall be increased by 4% of the percentage area of the pension due on the date from which the percentage area increases.
§ 2
The basic rates of pensions granted after 31 December 2005, referred to in § 33 (1), § 41 (1), § 45 (1), § 51 (1) and § 53 (1) of the Act, are CZK 1,470 per month.
§ 3
(1) The percentage rates of widower's, widower's and orphan's pensions are only increased if they have not been calculated from the percentage rates of pensions raised under this Regulation.
(2) If the pension is adjusted to coincide with another pension or income from a gainful activity, an increase in the percentage of the pension referred to in Articles 1 (1) (b) and 1 (2) (b) shall be adjusted when the amount of the pension paid is changed, according to the rate of the pension payable from the date of the change.
§ 4
For the purposes of this Regulation, pensions awarded before 1 January 1996 shall also be:
(a) widower's, widower's and orphan's pensions for a person who was awarded a pension before 1 January 1996, if the right to such a pension lasted on the date of his death or for a person who died before 1 January 1996;
(b) the old-age pensions of persons who were entitled to such a pension before 1 January 1996 and the old-age pension was calculated in accordance with the rules in force before 1 January 1996 only because the condition laid down in the first sentence of Paragraph 72 (1) of the First Law was not met;
(c) the full invalidity and partial invalidity pensions of persons who were entitled before 1 January 1996 were paid after 31 December 1995 if the full or partial invalidity occurred before 1 January 1996;
(d) old-age pensions pursuant to § 76 of the Act, if their percentage rate has been established pursuant to § 71 (1) and (4) of the Act and limited by § 4 (1) of the Second Law No. 76 / 1995 Coll., on the increase of pensions paid and pensions awarded in 1995,
(e) widow's, widower's and orphan's pensions calculated from the pensions referred to in points (b) to (d).
§ 5
This Regulation shall enter into force on 1 January 2006.
