THE LAW
of 26 October 2021
amending Act No 352 / 2001 Coll., on the Use of State Symbols of the Czech Republic and amending certain laws, as amended
Parliament has decided on this law of the Czech Republic:
Act No 352 / 2001 Coll., on the use of national symbols of the Czech Republic and on the amendment of certain laws, as amended by Act No 213 / 2006 Coll., Act No 274 / 2008 Coll. and Act No 183 / 2017 Coll., is amended as follows:
1. in Article 1, the following paragraph 3 is added:
"(3) Baths and seals with a national emblem may be used only under the conditions laid down in this Act."
2. in Article 2 (1), the following points (v) and (w) are inserted after point (u):
"(v) units of voluntary municipal fire department, units of fire-fighting rescue corps of undertakings, units of voluntary fire-fighting corps of undertakings and associations operating in the fire protection sector;
(w) medical emergency services, ';
3. In Article 3, at the end of paragraph 2, the dot is replaced by a comma and the following point (g) is added:
"(g) use for the external identification of the uniforms of the members of the units of the voluntary fire-fighting units of the municipalities, of the fire-fighting units of the undertakings, of the units of the voluntary fire-fighting units of the undertakings and of the associations operating in the fire protection sector.";
4. In the first sentence of Article 6 (1), the words "Stamp on which a small national character is marked shall be rounded in diameter 20 mm, 25 mm or 36 mm 'shall be replaced by the words" Official stamp shall be a stamp producing a circular imprint of 20 mm, 25 mm or 36 mm in diameter, bearing a small national character' and the words "(" official stamp ')' shall be deleted.
5. The following Section 6a is inserted after Section 6, including footnote 6:
(1) The seal of the Ministry of Foreign Affairs is a seal which produces a circular imprint of 36 mm in diameter, marked with a small national emblem; a small national emblem shall be displayed within a circle around which the identification of the authorised person referred to in paragraph 2 and, where appropriate, the designation of its organisational component and seat. In the case of representative offices (6), the name of the representative office may also be considered as an authorised person. If the beneficiary uses more seals of the Ministry of Foreign Affairs, these seals must also include serial numbers.
(2) Only the Ministry of Foreign Affairs, including representative offices, may use the seal.
(3) The seal of the Ministry of Foreign Affairs can be used
(a) to confirm the inviolability of a copy of an international contract;
(b) to seal the diplomatic post,
(c) in other cases where this is normal.
6) Article 4 of Act No. 150 / 2017 Coll., on Foreign Service and on the amendment of certain laws (Act on Foreign Service). '.
6. In Paragraph 10, the present text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The flag of the President of the Republic may also be used in the context of the exercise of his duties."
7. in Article 11 (a):
"(a) to seal international treaties and full powers, instruments of ratification or other instruments issued in connection with the negotiation or termination of international agreements,"
8. in Article 13 (1), the following point (d) is inserted after point (c):
"(d) use the seal of the Ministry of Foreign Affairs in contravention of § 6a (2),"
Points (d) to (f) shall be renumbered as points (e) to (g).
9. In Article 13 (2), "(d) 'is replaced by" (e)' and "(e) or (f) 'is replaced by" (f) or (g)';
Efficacy
This Act shall take effect on 1 January 2022.
