DECLARATION
of 10 December 2013
on the scope and manner of keeping records of decisions, measures of a general nature, binding opinions, endorsements and declarations for which consent has been given under the Water Act and parts of decisions under the Integrated Prevention Act (Water Registration Act)
The Ministry of Agriculture provides pursuant to § 19 (2) of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 150 / 2010 Coll.:
Subject matter
This decree sets out the scope and manner of keeping records of decisions, measures of a general nature, binding opinions and assents of administrative and local authorities issued under the Water Act and declarations submitted to them, to which they have given their consent under the Water Act, and parts of decisions which, under the Integrated Prevention Act, have replaced decisions issued under the Water Act ("Water Register '). The decree further defines the scope of the data and the way in which it is stored in the public administration information system (1).
Scope and method of keeping water law records
(1) The administrative and territorial authorities impose decisions in the public administration information system, measures of a general nature, binding opinions, endorsements, declarations for which they have given their consent under the Water Act, parts of decisions under the Integrated Prevention Act, which are final or effective, hereinafter referred to as "the Administrative Act," and the identification information referred to in Article 19 (3) of the Water Act to the extent set out in Annex 1 to that Decree, with the exception of decisions relating to administrative offences.
(2) The river basin managers shall store in the public administration information system selected data from administrative acts pursuant to Article 19 (4) of the Water Act, within the scope of Annex 2 to this Decree, if the relevant administrative act contains them and if it is not an administrative act for the needs of individual citizens.
(3) The identification data referred to in paragraph 1 shall always be recorded in the water register by the administrative and judicial review procedure (2) by the administrative or local authority which took decisions at first instance.
(4) Administrative acts issued by the municipal authority in proceedings under Paragraph 105 (1) of the Water Act shall be sent by the municipal authority without delay after the acquisition of legal power or efficiency in electronic form by the municipal authority of the municipality with extended scope, in whose administrative district the municipal authority is situated, which shall deposit that administrative act and the identification information referred to in paragraph 1 in the public administration information system.
The administrative and local authorities which impose administrative acts and the identification data referred to in Article 2 (1) in the public administration information system shall transmit them, including the administrative acts referred to in Article 2 (3) and (4), and the identification data to the Ministry of Agriculture in electronic form no later than the 15th day of the first month of the following calendar quarter for the calendar quarter at the latest. The river basin managers shall subsequently store the selected data in accordance with Section 2 (2) on an ongoing basis.
Scope and manner of data storage in the public administration information system
Administrative authorities, local authorities and river basin managers shall store the data referred to in Article 2 (1) to (4) in the public administration information system in such a way as to ensure continuity with other public administration information systems through geographical and technical identifiers, standard data elements and management rules.
Removal of non-compliance in the water register
(1) The administrative authorities and the authorities of the local authorities shall remove any discrepancy in the water register, which means a change which does not alter the subject matter of the operative part of the administrative act and the correction of the errors resulting from the management of the current water register and the summary water register and the transfer of the data from the current water register and summary water registration to the public administration information system.
(2) Changes which do not alter the subject matter of the operative part of the administrative act are changes to the designation of the object while maintaining its position on the basis of evidence of a change of such data, such as changes resulting from changes in the statistical code lists issued by the measures of the Czech Statistical Office, changes in the territorial competence of the public authorities and changes in the contents of the property register which affect the content of the water register.
(3) The removal of non-compliance in the water register shall be indicated in the change report.
(4) The change report contains:
(a) a serial number,
(b) the number of the items or other indication of the summary of the items in the list of items of the water law records referred to in Annexes 1 to 5 for which the amendment has been applied;
(c) the date of entry into the change report; and
(d) the name and surname of the person who made the change.
Common provision
The Ministry of Agriculture provides uniform software to maintain water law records, store data in the public administration information system and to present data.
Repeal
The following shall be deleted:
1. Decree No. 7 / 2003 Coll., on Water Registration.
2. Decree No. 619 / 2004 Coll., amending Decree of the Ministry of Agriculture No. 7 / 2003 Coll., on water law.
3. Decree No. 7 / 2007 Coll., amending Decree No. 7 / 2003 Coll., on Water Registration, as amended by Decree No. 619 / 2004 Coll.
4. Article II of Decree No. 40 / 2008 Coll., amending Decree No. 432 / 2001 Coll., on documents of application for a decision or observations and on the terms of the authorisation, consent and expression of the Water Authority, as amended, and Decree No. 7 / 2007 Coll., amending Decree No. 7 / 2003 Coll., on water law, as amended by Decree No. 619 / 2004 Coll.
Efficacy
This Decree shall take effect on 1 January 2014.
