DECLARATION
of 13 November 2009
on progress in the service evaluation of soldiers
According to § 17 (3) of Act No. 221 / 1999 Coll., the Ministry of Defence provides:
Staff evaluation
(1) The service rating of a soldier shall be processed by the nearest superior soldier who has a rated soldier in subordination of at least 3 months. If the immediate superior fails to comply with this condition, the assessment shall be carried out by his immediate superior or his designated commander from a level of procedure of one degree higher than that of the rated soldier who has known the rated soldier from his professional grade for at least 3 months (hereinafter referred to as the "evaluator '). Soldiers directly subordinate to the Minister of Defence, his Deputy and Chief of Staff of the Army of the Czech Republic are evaluated regardless of the period of direct subordination.
(2) A professional evaluation is an ongoing assessment of the professional qualities of a soldier. It shall be drawn up in writing on the form set out in the Annex hereto, once a year in the period 1 November to 31 January of the following year.
(3) A staff evaluation may also be carried out outside that deadline as a result of long-term non-performance of duties imposed or serious deficiencies in the performance of duties. The service evaluation shall be carried out before the soldier is transferred if in the new service classification he performs the service in a calendar year for less than 3 months.
(4) The staff evaluation is based on an interim evaluation. The evaluator of the rated soldier will be familiar with the written evaluation during the evaluation interview. After completion of the evaluation process, the evaluation shall be included in the personal file of the soldier.
(5) The staff evaluation of the evaluator does not work for soldiers who, at the time of the evaluation,
(a) have been seconded to courses with a study period of more than 6 months;
(b) have served in their official capacity for less than 3 months;
(c) have been unable to serve for more than 6 months in respect of a disease or accident or have been granted leave for that period without entitlement to cash requirements;
(d) have taken maternity or parental leave for more than 6 months; or
(e) they have a service evaluation which is not more than 3 months old.
Repeal
The following shall be deleted:
1. Decree of the Ministry of Defence No. 262 / 1999 Coll., on the procedure for the service evaluation of soldiers from the profession and its aspects.
2. Decree No. 138 / 2005 Coll., amending Decree No. 262 / 1999 Coll., on the procedure for the service evaluation of soldiers from the profession and its aspects.
Efficacy
This Decree shall take effect on 1 December 2009.
